TERMS AND CONDITIONS

 1.  To avoid fraudulent transaction, it is recommended not to reveal details of
     your card to anybody; make payment yourself without going through any
     channels/agents. 
 2.  Discount / Refund / Rebates will not be part of the online payment. It will
     have to be dealt with, directly with the Company representative. 
 3.  For additional services (including Custom Examination) which are availed
     subsequent to the initial online payment, payment will have to be made at
     actuals, prior to delivery. Supplementary payment can also be made online. 
 4.  Partial Payment will not be accepted. 
 5.  There will be a flat transaction fee as per prevailing market practices for
     Net Banking and will be collected on upfront basis. 
 6.  Credit card transactions and Debit card transactions will be charged per
     transaction at prevailing market practices.
 7.  Delivery of Cargo / Container will be effected only after TPSL (Tech
     Process) unique transaction reference number along with ‘Success’ status is
     received from Payment Gateway / Payee / Acquiring bank. In case of
     Corporate Net banking, the UTR reference number is provided on T+1 day. 
 8.  Service taxes will be applicable to services as per prevailing laws as
     specified by the Government of India. 
 9.  This Website is best viewed and full functional with 1280x1024 or more
     resolution screens. 
 10. Security | Allcargo Logistics Limited is committed to ensuring the security
     of your personally identifiable information. We will take reasonable
     precautions to protect this information from loss, misuse, unauthorized
     disclosure or alteration. We use encryption when collecting or transferring
     sensitive data (e.g., payment parameters). 
 11. Allcargo Logistics Ltd. assumes no responsibility and shall incur no
     liability if it is unable to affect any Payment Instruction(s) on the
     Payment Date owing to any one or more of the following circumstances: a) If
     the Payment Instruction(s) issued by the Customer is/are incomplete,
     inaccurate, invalid and delayed. b) If the Payment Account has insufficient
     funds/limits to cover for the amount as mentioned in the Payment
     Instruction(s). c) If the funds available in the Payment Account are under
     any encumbrance or charge. d) If the Customer’s Bank refuses or delays
     honouring the Payment Instruction(s). e) Circumstances beyond the control
     of Allcargo Logistics Ltd. (including, but not limited to, fire, flood,
     natural disasters, bank strikes, power failure, systems failure like
     computer or telephone lines breakdown due to an unforeseeable cause or
     interference from an outside force). NOTWITHSTANDING ANYTHING TO THE
     CONTRARY, OUR MAXIMUM AGGREGATE LIABILITY TO THE CUSTOMER FOR ANY CAUSES
     WHATSOEVER, AND REGARDLESS OF THE FORM OF ACTION (WHETHER LIABILITY ARISES
     DUE TO NEGLIGENCE OR OTHER TORT, BREACH OF CONTRACT, VIOLATION OF STATUTE,
     MISREPRESENTATION OR FOR ANY OTHER REASON), WILL AT ALL TIMES BE LIMITED TO
     THE AMOUNT PAID BY THE CUSTOMER. In no event will Allcargo Logistics Ltd.
     be liable to the Customer for any special, indirect, incidental,
     consequential, punitive, reliance, or exemplary damages (including without
     limitation lost business opportunities, lost revenues, or loss of
     anticipated profits or any other pecuniary or non-pecuniary loss or damage
     of any nature whatsoever) arising out of or relating to (i) this agreement,
     (ii) the services, the site or any reference site, or (iii) your use or
     inability to use the services, the site (including any and all materials)
     or any reference sites, even if Allcargo Logistics Ltd. or its authorized
     representative has been advised of the possibility of such damages. 
 12. Ownership, Trademarks and Copyrights; Confidentiality | Allcargo Logistics
     Limited owns all rights, title and interest, including, without limitation,
     copyright, in and to the Service and the Allcargo Logistics Limited
     Website. You may not copy, modify, translate, decompile, reverse engineer,
     reproduce, adapt or disassemble the Service. The display of any trademarks
     within this Website does not grant a license or other rights of any kind in
     those marks to the reader. Any downloading of material contained on the
     site, or on any site linked to the site, may be a violation of federal
     trademark and copyright laws. 
 13. Your Personal Information | When registering to use this site, making a
     payment or contacting Allcargo Logistics Limited through this site, you
     agree to provide accurate and complete information about yourself and your
     payment obligation(s). 
 14. Allcargo Logistics Ltd. reserves the right to change, modify, add, or
     remove portions of this Agreement at any time by posting notification to
     the Site or otherwise communicating the notification to you. The changes
     will become effective, and shall be deemed accepted by you, 24 hours after
     the initial posting and shall apply immediately on a going-forward basis
     with respect to payment transactions initiated after the posting date. 
 15. Allcargo reserves the right to make changes to this Web site (including,
     without limitation, discontinuing this Web site or the services offered on
     this site) and these Terms of Use at any time, with or without notice. If
     any of these terms and conditions shall be deemed invalid, void or for any
     reason unenforceable, that term or condition shall be deemed severable and
     shall not affect the validity and enforceability of any remaining term or
     conditions. 
 16. Privacy Policy | Allcargo Logistics Limited will never disclose any
     personal information about you to a third party unless compelled to do so
     by law. 
 17. Termination - The Customer agree that Allcargo Logistics Ltd., in its sole
     discretion, for any or no reason, and without penalty, may suspend or
     terminate the Customer’s account (or any part thereof) or the Customer’s
     use of the Services and remove and discard all or any part of the
     Customer’s account, the Customer’s user profile, or the Customer’s
     recipient profile, at any time. Allcargo Logistics Ltd. may also in its
     sole discretion and at any time discontinue providing access to the
     Services, or any part thereof, with or without notice. The Customer agree
     that any termination of the Customer’s access to the Services or any
     account the Customer may have or portion thereof may be effected without
     prior notice, and the Customer agree that Allcargo Logistics Ltd. will not
     be liable to the Customer or any third party for any such termination. Any
     suspected fraudulent, abusive or illegal activity may be referred to
     appropriate law enforcement authorities. These remedies are in addition to
     any other remedies Allcargo Logistics Ltd. may have under the provisions of
     law. Upon termination for any reason, the Customer agree to immediately
     stop using the Services. 
 18. Indemnity – The Customer agrees to indemnify and hold harmless Allcargo
     Logistics Ltd. including its officials from any damages, claims, demands,
     proceedings, loss, cost, charges and expenses whatsoever including legal
     charges and attorney fees which Allcargo Logistics Ltd. may at any time
     incur, sustain, suffer or be put to as a consequence of or arising out of
     (i) misuse, improper or fraudulent information provided by the customer and
     (ii) the customer providing incorrect number or providing a number that
     belongs to that of an unrelated third party. 
 19. Governing laws and Jurisdiction – This Agreement will be governed by and
     construed in accordance with the laws of India and shall be subject to the
     exclusive jurisdiction of the Courts at Mumbai only.
 20. Notice – Allcargo Logistics Ltd. may provide you with notices and
     communications by email, regular mail or postings on the Site or by any
     other reasonable means. Except as otherwise set forth herein, notice to
     Allcargo Logistics Ltd. must be sent by courier or registered mail to
     Allcargo Logistics Ltd., 6th Floor, Avvashya House, CST Road, Kalina,
     Santacruz (E), Mumbai – 400098. 1. Waiver – The failure of Tech Process to
     exercise or enforce any right or provision of this Agreement will not
     constitute a waiver of such right or provision. Any waiver of any provision
     of this Agreement will be effective only if in writing and signed by Tech
     Process.
