A 5-1 majority of the New Jersey Supreme Court has ruled that there is nothing
stopping a business owner whose company lost out on a public contract from suing
in his individual capacity to challenge the procurement process.

A 5-1 majority of the New Jersey Supreme Court has ruled that there is nothing
stopping a business owner whose company lost out on a public contract from
suing in his individual capacity to challenge the procurement process.
The justices instituted a new requirement, applicable in all future cases,
that any plaintiff claiming taxpayer standing in an action challenging the
process for awarding public contracts must submit a certification that he or she
is not acting on behalf of any company.
