REWARD LINK TERMS OF SERVICE

REWARD LINK TERMS OF SERVICE (“TERMS”)

 

Reward Link™ is provided by Tango Card, Inc. (“Tango Card”) to make available a
customized selection of rewards and incentives to Recipients. Reward Link may
only be redeemed by the Reward Link Recipient, and only for the specified Tango
Card catalog items.

 

Description of Reward Link

 

Reward Link provides access to a reward catalog selected by the Tango Card
customer (an “Enterprise”) from which you (a “Recipient”) received your
incentive or reward. The catalog landing page will display the balance available
to you which you may redeem for any of the rewards, incentives or other items
shown.

 

To use Reward Link, simply click the redemption URL and on the reward catalog
landing page proceed to select incentives or rewards up to your balance limit
and add them to your cart. When you check out, enter the name and email address
for the delivery of the reward(s) (your email address may be shown by default,
but you may change it at your discretion).

 

Any unused balance will remain available to you after Reward delivery using the
same Reward Link; please save the Reward email containing your Reward Link for
such future use. Please note that your Reward Link has an expiration date for
usage. The expiration date will be clearly stated in the Enterprise email
containing the Reward Link. Multiple Reward Links will need to be redeemed
separately as they cannot be combined.

 

Please note that the Reward Link is “active” when you receive it. You are solely
responsible for the security of the Reward Link after receipt.

 

The Usual Legal Stuff

 

You represent that you are of legal age to form a binding contract and are not a
person barred from receiving services under the laws of the United States.
Otherwise, you may not use the Reward Link.

 

Only the Recipient to whom the Reward Link is issued may use it. Reward Link
cannot be transferred, sold or exchanged. If Tango Card has reasonable grounds
to suspect that your usage of Reward Link constitutes fraud, Tango Card has the
right to disable the Reward Link.

 

Use of Reward Link may include certain communications from Tango Card, such as
administrative messages. We will not spam you or sell your name or email address
to others. You consent and agree that Tango Card may use, preserve or disclose
your name and email if required to do so in order to: (a) respond to your
request for assistance; (b) comply with legal process; or (c) protect Tango
Card, its users and the public.

 

Your selection and use of Merchant Gift Cards or other rewards options from the
Tango Card catalog will be subject to the terms and conditions and privacy
policy of the merchant or other party providing the reward; these terms and
policies are available for your review through the Reward Link. Tango Card does
not control the information posted by third parties (“Third Party Content”)
including, but not limited to, the terms and conditions of the Merchant Gift
Cards and privacy policies, and as such, does not guarantee the accuracy of such
Third Party Content. Under no circumstances will Tango Card be liable in any way
for any Third Party Content, including, but not limited to, any errors or
omissions in Third Party Content.

 

If a redemption option available via your Reward Link includes a donation to a
non-profit organization (an “NPO”), the treatment of and receipt for your
donation is a matter exclusively between you, the Enterprise, and the NPO. Tango
Card shall not be responsible in any manner for the provision of receipts to
individuals for tax purposes.

 

YOU EXPRESSLY UNDERSTAND AND AGREE THAT: (ii) REWARD LINK IS PROVIDED ON AN “AS
IS” AND “AS AVAILABLE” BASIS, (iii) TANGO CARD EXPRESSLY DISCLAIMS ALL
WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED
TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE
AND NON-INFRINGEMENT. TANGO CARD MAKES NO WARRANTY THAT: (i) REWARD LINK WILL
MEET YOUR EXPECTATIONS OR REQUIREMENTS, (ii) REWARD LINK WILL BE ERROR-FREE,
(iii) THE QUALITY OF ANY PRODUCTS OBTAINED BY YOU THROUGH REWARD LINK WILL MEET
YOUR EXPECTATIONS, (iv) THAT THE SITE OR OUR SERVERS ARE FREE OF VIRUSES OR
OTHER HARMFUL COMPONENTS; AND (v) ANY ERRORS IN THE SOFTWARE WILL BE CORRECTED.
NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM TANGO
CARD SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THESE TERMS.

 

You agree that in the event Reward Link does not work properly, our sole
obligation and your sole remedy is replacement of the damaged Reward Link for
one that works properly, if you contact us before its stated expiration date.

 

You further agree and understand that Tango Card has no liability for the loss
of a Reward Link after receipt by you for any reason, including in the event
your computer or mobile device is lost, hacked or stolen.

 

You further agree and understand that Merchants are solely responsible for your
ability to use, and the terms of usage of, Merchant Gift Cards. Each Merchant’s
terms of use for its gift card(s) are available through Reward Link. Those terms
and conditions exclusively govern your use of that Merchant’s Gift Card(s).
Tango Card is not and shall not be in any manner responsible or liable for any
Merchant actions, policies, or practices.

 

Tango Card may assign its rights and responsibilities hereunder without notice
to you. These Terms constitutes the entire agreement between you and Tango Card
concerning your Reward Link. These Terms shall be governed by the laws of the
State of Washington without regard to its conflict of law provisions. You agree
to submit any claim to the personal and exclusive jurisdiction of the courts
located within King County, Washington. Any claim arising out of or relating to
Reward Link will be settled by arbitration to be held in King County,
Washington, in accordance with the rules of the American Arbitration
Association. The decision of the arbitrator will be final, conclusive, and
binding on the parties to the arbitration. Any action brought by you with
respect to Reward Link must be brought, if at all, within one (1) year from the
accrual of such cause of action.

 


IF YOUR REWARD LINK IS DELIVERED TO YOU BY MAIL AND/OR INCLUDES AN OPTION FOR
MAILED GIFT CARDS , THESE TERMS ALSO APPLY:

 

THE FOLLOWING TERMS AND CONDITIONS APPLY TO REWARD LINK E-GIFT CARD: Usable
at rewardsgenius.com/reward-catalog. up to its balance ONLY to purchase gift
cards issued by participating merchants, including any nonprofits, if shown (the
“Participating Merchants”). Not redeemable for cash except as required by law.
Redeemable only by you as the Reward Recipient; cannot be transferred, assigned,
or sold by you. All redemptions are final. Reward Link e-Gift Card balances from
different programs cannot be combined. Not reloadable. Not redeemable on
websites or in stores of Participating Merchants. Participating Merchants are
subject to change. Rewards Link e-Gift Card is subject to additional terms
specified at rewardsgenius.com/reward-link-terms-of-service. Safeguard the
Reward Link e-Gift Card. It will not be replaced or replenished if lost, stolen
or used without authorization. Separate terms and conditions apply to purchased
gift cards. CARDCO CV, Inc. is the issuer of your Reward Link E-Gift Card and
sole obligor to you. CARDCO may delegate its issuer obligations to an assignee,
without recourse. If delegated, the assignee, and not CARDCO, will be sole
obligor to certificate owner. The certificate is distributed by Tango Card, Inc.
However, Tango Card, Inc. is not an obligor to certificate owner and is not
affiliated with CARDCO. Use or acceptance of the Rewards Link e-Gift Card
constitutes acceptance terms described above. Your Reward Link E-Gift Card
balance amount may be viewed by clicking the Reward Link URL. For full product
