New York lawmakers are pushing for the passage of the New York Home Energy
Affordable Transition Act, or HEAT Act, which was passed by the Senate earlier
this year.

The bill, which would end the requirement for every building throughout the
state to be connected to the gas grid, is sponsored by Senator Liz Krueger and
Assemblymember Patricia Fahy.

Senators Samra G. Brouk and Jeremy Cooney and Assemblymembers Jen Lunsford,
Sarah Clark, Harry B. Bronson and Demond Meeks, who all represent parts of
Rochester and Monroe County, are co-sponsors of the bill.

Here's what to know about the bill.


HOW NY HEAT ACT COULD HELP NEW YORKERS



Currently, every building being built in the state is required to be connected
to the gas grid.

However, due to laws already passed by the state, such as the Climate Leadership
and Community Protection Act and the All Electric Buildings Act, lawmakers say
that's no longer necessary because the state is moving away from gas usage
within the next decade.



Ratepayers pay the costs associated with installing and repairing the state's
gas pipes through increased utility bills, says Krueger, but through the HEAT
Act, gas companies won't be spending that money, which has the potential to
ensure nobody's utility bill is greater than 6% of their income.


WHY IS IT STRUGGLING TO BE PASSED BY THE ASSEMBLY?



The bill was first passed by the Senate in June 2023 but after dying in Assembly
earlier this year, the Senate has pushed it through again, passing it for a
second time in March.

And now, it's back in the hands of the Assembly. So what's stopping them?



There are concerns that New Yorkers will be forced to stop using gas altogether
or gas companies won't be able to continue selling gas.

But Krueger says that's not the case.

"No, we're not telling companies they can't sell gas at this point," Krueger
said. "Although, it is true, over time, if you're left on a gas system, you're
going to end up paying more because people won't be using gas and it won't be as
available."

If this bill is passed, you'll still be able to file a petition with the Public
Service Commission to keep your gas even if they declare your area has adequate
alternatives to gas.

WHAT'S NEXT?

If the Assembly votes it through by the end of the session — June 7 — it then
lands on Gov. Kathy Hochul's desk.

If rejected, Krueger said she'll possibly return to the drawing board, figure
out what changes may need to be made and then reintroduce the bill.

"I won't give up," Krueger said. "I'll just have to try a different tactic."
