referred to a collection agency. If the member's account is referred to a collection agency, the delinquent member agrees to pay all costs including but not limited to collection agency costs, court costs and reasonable attorney

MEMBERSHIP</b>: Pre-paid annual memberships may be frozen once during the term of the membership. Short-term memberships (less than twelve months) may not be frozen. Memberships can be frozen for medical reasons only. Monthly
billing (EFT) memberships may not be frozen unless the initial one-year commitment is fulfilled. All freezing requests for monthly billing memberships must be received before the first of the month to avoid being billed for
the following month. Dues for the month the membership is reactivated will be prorated and are due immediately upon reactivation. The allowed length of freeze is one month minimum and three months maximum.
Freezes for medical reasons may be extended for up to nine months with a letter from a physician. Any membership that has not been unfrozen by the member after three months (nine months maximum with medical reason) will be
automatically unfrozen. Memberships may not be frozen retroactively. Members may not use the club at any time while the membership is on freeze. By checking in to the club, the membership will be automatically

I acknowledge receipt of a full completed copy of this agreement executed by both myself and C&J Fitness DBA CKO Kickboxing. 1. BUYER'S RIGHT TO CANCEL: If you wish to cancel this contract you may do so without any penalty or further obligation by submitting written notification to: CKO - Lodi,locationaddress] by certified or registered mail within (3) three operating days from the date of this agreement. If you cancel this contract within the three-day period, you are entitled to a full refund of your money. If the third operating day falls on a Sunday or holiday, notice is timely given if it is mailed or delivered as specified in this notice on the next operating day. Refunds will be made within thirty (30) days of receipt of the cancellation notice to the club. "Operating Day" means any calendar day on which patrons may inspect and use the club's facilities and services during a period of at least eight hours, except holidays and Sundays. 2. ADDITIONAL TERMS OF CANCELLATION: In addition to the "Buyer" right to cancel - stated above, a membership may also be canceled for the following reasons: a. If upon a doctor's written order, you cannot physically participate in services offered by CKO Kickboxing because of significant physical disability for six months or longer, b. If you permanently move your residence more than twenty-five (25) miles from this club or an affiliated club offering the same or similar services and facilities, or c. Upon the member's death. 3. CANCELLATION PROCEDURES: To cancel your membership, you must first fill out a cancellation request form, and if necessary, submit a proof of your change of address. You must submit a copy of a landline utility bill from your new residence showing your name and your new address as proof of address change. Apartment leases, bank statements, and driver's licenses are not acceptable proof of address change. If you are currently on the monthly billing (EFT) program, and your initial one-year commitment has not been fulfilled, you will continue to be billed until written notice of your cancellation and proof of address change is received or until your initial one year commitment has been fulfilled. If your one-year commitment has already been fulfilled, your membership becomes month by month with no long-term commitment, and it can be canceled at any time by written notification, as defined in the last sentences of this section. In a cancellation under the "ADDITIONAL RIGHTS TO CANCEL" subsection, the club may retain the portion of the total contract price representing the services used plus reimbursement for expenses incurred in an amount not to exceed 10% of the total contract price. In a premature termination of a long-term contract wherein the required documentation, i.e. medical or landline utility bill in your name, cannot be provided, the premature termination fee is $250.00. After the initial term, you will continue to be billed on a Monthly Basis until Written Request of Your Cancellation is received. PAST DUE BALANCES: If a member's payments on the monthly billing (EFT) membership become more than one month past due and their initial one-year commitment has already been fulfilled, their membership may be canceled. If a member's payments on the monthly billing (EFT) become more than forty-five (45) days past due and their initial one-year commitment has not been fulfilled, their entire balance will become due immediately in full and the account will be referred to a collection agency. If the member's account is referred to a collection agency, the delinquent member agrees to pay all costs including but not limited to collection agency costs, court costs and reasonable attorney fees. A $10.00 fee will be assessed to past due balances in 15-day increments. 5. REFUNDS: All refunds are subject to the terms of the cancellation. Short term memberships (less than 12 months) are non-refundable. Refunds for annual memberships are based on 12 months and are only for paid membership time and do not include any free time from membership promotions or referrals. All enrollment fees are non-refundable. Any refund due will be mailed to the address on the cancellation form within 30 days of cancellation approval by CKO executive office. 6. RETURNED CHECK OR OTHER ITEM: A $30.00 fee shall be charged by Seller for any returned check or other item. 7. WAIVER AND RELEASE: I, the purchaser, understand that fitness activities such as strength, flexibility, aerobic and kickboxing exercise including the use of the equipment, are potentially hazardous and involve the risk of injury and I am voluntarily participating in these activities and using equipment and facilities with knowledge of the dangers involved and I expressly agree to accept all of these risks. I do hereby declare myself to be physically sound and suffering from no illness, impairment, disease, disability or other condition that would prevent or limit my participation in an exercise program or the use of exercise equipment. I acknowledge that I have either had a physical examination and been given my physician's permission to participate, or that I have decided to participate in an exercise program without the approval of my physician and do hereby waive, release, and forever discharge C&J Fitness, Club KO Franchise LLC, CKO Kickboxing and its subsidiaries, franchisees, and affiliates, as well as, its owners, officers, employees, contractors, administrators and all others from any and all claims, suits, damages, demands, or actions including those caused by passive or active negligence by any of those mentioned arising from or connected with my participation in any services, activities, or exercise programs of C&J Fitness, Club KO Franchise LLC, CKO Kickboxing and its subsidiaries, franchisees, and affiliates, or from the use of any of its facilities, services, or machinery. 8. REVISIONS OF CLUB RULES & POLICIES: The written rules of this establishment are incorporated by reference into this agreement. The member represents to management that he or she has read these rules and regulations and had discussed them with management prior to signing this agreement and that the member agrees to abide by these rules and regulations for the duration of the membership period. The member also understands that management reserves the right to revise the rules and regulations periodically as the need arises. Any revised rules and regulations will be posted by management and the member agrees to abide by any revised rules and regulations. 9. REPRESENTATION: Member agrees that no other representation is made other than those which are agreed to in writing herein. 10. NON COMPETE: Member agrees not to operate, cause to operate, or be involved with the operation, either directly or indirectly, with any business enterprise or operation similar to CKO Kickboxing within a twenty-five (25) mile straight line radius from this establishment or any affiliated CKO Kickboxing. 11. MEMBERSHIP KEY TAGS & CHECK-IN: All members must check in before being permitted to enter the club. Checking in consists of swiping the barcode ID tag through the bar code reader or typing your membership number in the keypad. All members are required to have a current photo in the computer database. 12. GYM ATTIRE: Proper club attire is required. Members are not permitted to wear jeans or jean shorts. All members must wear some type of soft-soled gym shoes at all times while in the exercise area. No boots or sandals are allowed. If you are wearing a button-down shirt it must remain buttoned at all times. Changing is permitted in the bathrooms only. No torn, ragged, or dirty clothing is allowed. 13. GUESTS: All guests must check-in with the front desk staff to confirm visiting status. A photo ID is required to confirm the guest's identity. 14. USE OF EQUIPMENT: a. Plates and dumbbells are not to be dropped for any reason! b. All weights (plates, dumbbells, barbells, etc.) must be returned to their appropriate racks in the proper order. NO weights are to be left on the floor for any reason. c. All weights must be removed from bars and plate-loaded machines when you are finished using them. d. Do not place any additional weights or dumbbells on machine weight stacks. e. No weights or dumbbells are to be used in the kickboxing area. f. All jump ropes (hand weights etc.) must be returned to their appropriate place after the kickboxing class. 15. REFERRALS: From time to time, a referral bonus may be available when you refer your friends to the club. Details of such will be announced at the gym. 16. PERSONAL TRAINING MEMBERSHIP: A member can cancel a personal training session only by giving at least a 24-hour notice of cancellation. If a 24-hour notice of cancellation is not given to the trainer, you will be charged a session. If you are late for a personal training session, the time will be subtracted from that session. 17. FREEZING MEMBERSHIP: Pre-paid annual memberships may be frozen once during the term of the membership. Short-term memberships (less than twelve months) may not be frozen. Memberships can be frozen for medical reasons only. Monthly billing (EFT) memberships may not be frozen unless the initial one-year commitment is fulfilled. All freezing requests for monthly billing memberships must be received before the first of the month to avoid being billed for the following month. Dues for the month the membership is reactivated will be prorated and are due immediately upon reactivation. The allowed length of freeze is one month minimum and three months maximum. Freezes for medical reasons may be extended for up to nine months with a letter from a physician. Any membership that has not been unfrozen by the member after three months (nine months maximum with medical reason) will be automatically unfrozen. Memberships may not be frozen retroactively. Members may not use the club at any time while the membership is on freeze. By checking in to the club, the membership will be automatically unfrozen. 18. CONDUCT: Proper conduct is expected from all members. Please be respectful and courteous to others. Profanity, yelling, grunting, fighting and disruptive behavior is distracting and offensive to others and will not be tolerated. 19. TELEPHONES: The facility's business phones may not be used by members. Cell phones are not to be used by members during the fitness kickboxing classes. 20. SOLICIATION: Members and/or their guests are not permitted to solicit anyone on the club premises for anything including personal training, and are not permitted to picket, circulate or post notices, flyers, petitions, or statements of any kind on the club premises without the written permission of the management. NO personal training may be conducted by anyone other than a CKO Kickboxing staff trainer without the written permission of the management. 21. TRANSFERS: Under certain circumstances, management may grant courtesy permission to transfer the membership to another person. If permission is granted, a transfer fee will be assessed. Memberships may not be sold or loaned to another person. 22. VIOLATIONS: All employees are authorized to enforce the club's rules. Any member who breaks club rules may be asked to leave for the day. Repeat offenders may have their membership terminated without refund (at the discretion of the management). 23. FACILITY CLOSING: If the club is closed for a period longer than 30 days through no fault of the buyer, the buyer is entitled to either extend the contract for a period equal to that during which the facility is closed or to receive a prorated refund of the amount paid by the buyer under the contract. BILLING RETURN: A $10.00 fee shall be charged by Seller for any billing returns 24. TRANSFER BETWEEN CKO KICKBOING CLUBS: The home club is defined as the club where a member initially signs a contract, and a receiving club is defined as the club to which the member has requested transfer. A monthly member, within their initial contract term, may place a request in writing to their home club to transfer from their home club to another CKO Kickboxing club because the member has moved or because a new CKO Kickboxing has opened closer to their home. The immediate transfer (regardless of whether or not the member has made twelve months of payments to the home club) can be completed, provided the following criteria are met: a. The member provides the home club with proof of the move, along with the written request for transfer. b. If the receiving club has a higher monthly rate, the member will pay the higher rate. c. This is the member’s first transfer request; second and subsequent requests for transfer will entail a $50 transfer processing fee. If a member cannot produce proof of a move and is unwilling to pay an upgrade, the member can prematurely terminate their membership at the home club and must pay the $250 premature termination fee. PAID IN FULL MEMBERSHIPS, FREE MONTHS, AND PRE SALE MEMBERSHIPS ARE NOT TRANSFERRABLE. 25. IMAGE USAGE: You understand that, while on CKO Kickboxing premises, your image (including live or recorded video images), may be used or shown on the CKO Kickboxing website or social media outlets (Facebook, Instagram, YouTube, etc.) and that by entering the premises you consent to the use of these images.
