In a Monday email using the state party logo, state Sen. Nathan Dahm, R-Broken Arrow, urged members to demand U.S. Sens. James Lankford and Markwayne Mullin withdraw their support of Hill, a former Cherokee Nation attorney general who was often at odds with Gov. Kevin Stitt. Stitt, too, opposes Hill’s nomination. Lankford and Mullin supported Hill’s and Tulsa attorney John Russell’s nominations in an attempt to address the depleted Northern District judiciary by moving the pair through the confirmation process simultaneously. Lankford’s office said Monday he has not changed his position on Hill’s nomination. Mullin’s office did not respond to an inquiry. Then he took action Neither did Dahm. Loss of either senator’s support would likely doom Hill’s nomination. It is unclear what it might mean for Russell’s. Judicial nominations for Oklahoma’s federal courts during Democratic administrations have been difficult for almost 30 years because they must meet the approval of both the White House and Oklahoma’s two Republican senators — not to mention the Senate’s ruling party. To date, the administration has not even bothered to nominate a U.S. attorney for the Northern District. The Northern District has had to borrow judges from other courts to handle a backlog caused by retirements and the surge in criminal charges caused by the U.S. Supreme Court’s 2020 McGirt decision, which shifted jurisdiction of many cases previously handled by state courts to federal and tribal responsibility. Stitt has been highly critical of the McGirt decision and added tribal governments’ support of the argument that their reservations were never properly dissolved to his list of grievances against them. She also butted heads with Stitt on several other matters involving the state’s relationship with the tribe. The McGirt decision overturned the state court conviction of Jimcy McGirt for repeatedly molesting a 4-year-old girl in the 1990s, but he was retried in federal court and received the same sentence — life without possibility of parole. A new trial was ordered in June citing faulty jury instructions. Dahm’s email apparently refers to the McGirt case by claiming Hill “has actively advocated against the State of Oklahoma on numerous occasions. … Even worse, she joined a case in SUPPORT of a child rapist.” The email complains of “activist judges pushing their leftist ideology” but offers no specifics as to how that would apply to Hill. Tribal governments, including Hill and the Cherokees, say they supported arguments made by McGirt’s lawyers in regard to tribal jurisdiction, not McGirt himself.
