We may, at any time, and at our sole discretion, modify these Terms and Conditions of Use. Any such modification will be effective immediately upon public posting. GENERAL These terms and conditions ("Terms") do not affect Your statutory rights. To order Gift Cards or Digital Gift Vouchers (goods) through this Website You must be at least 18 years of age and accept delivery within the UK. From time to time the discounts advertised by Flex-eSave may be replaced or amended and may lead to a discount being temporarily unavailable. Any transfer, copying or misuse of the assigned discount code is not permitted in any way and may lead to its withdrawal. We do not warrant, represent, or guarantee that the Services will be available on your mobile device. If you do use a mobile device to access Services, you are subject to the terms of your agreement with your mobile device manufacturer and carrier. You may incur charges from your mobile carrier for accessing the Services, which are solely your responsibility. Insolvency of a Retailer. We have no direct link to any of the Retailers that issue the Gift Cards or Digital Vouchers that we offer via the Services. If a Retailer becomes insolvent, has an administrator or liquidator appointed or suffers a similar event, the Gift Cards or Digital Vouchers may become invalid. In this scenario, we are under no obligation to replace or exchange any previously issued, unspent Gift Cards or Digital Vouchers that we have provided to you. Multi option Gift Cards. Some Gift Cards or Digital Vouchers are 'multi-option' which are redeemable for goods in a variety of stores. We shall have no responsibility for any changes to the stores accepting such Gift Cards or Digital Vouchers, and for any changes to the terms and conditions applicable to each Gift Card or Digital Vouchers. Expiry of Gift Cards or Digital Vouchers. Some Gift Cards or Digital Vouchers are ‘open ended’ and do not have an expiry date. Some Gift Cards or Digital Vouchers do have an expiry date and you are responsible for checking any such dates. You should confirm the status of expiry on each Gift Card or Digital Vouchers prior to placing your order with us by checking the Retailer terms and conditions. GIFT CARDS You may order Gift Cards via our Website. Once You receive the cards You will need to activate each one by registering them online at our Website and in some instance you will also need to register with the retail partner whose card you have ordered which will be indicated on the despatch note or email we send You. If you are loading money to a Gift Card and the order has been processed by our retail partners, order cancellation or refunds are not possible. On loading funds on to a Gift Card, you will obtain the discount rate advertised on our Website. You can set up recurring orders to your Gift Cards that are activated within your My Digital Wallet. The loads will occur on a monthly basis and you will be able to manage your repeat orders via the “My Repeat Orders” feature on the Website. If a repeat order is made and there are insufficient funds in the “My Cash Pot” we will notify you by email and cancel the order. DIGITAL GIFT VOUCHERS Some offers are available through the Website which are delivered in digital or electronic format “Digital Gift Vouchers”. If You order a Digital Gift Voucher this will be delivered to You by email to the email address, You have registered on the Website. Digital Gift Vouchers will also be placed in your “My Digital Wallet” on the Website where they can be retrieved at any time. You can set up recurring orders Digital Gift Vouchers that you have placed and are shown with your My Digital Wallet. The repeat order will be processed on a monthly basis, and you will be able to manage your repeat orders via the “My Repeat Orders” feature on the Website. If a repeat order is made and there are insufficient funds in the “My Cashpot” we will notify you by email and cancel the order. MY CASHPOT To be able to place orders for Gift Cards or Digital Gift Cards through the Service you will need to have sufficient value for the order in “My Cashpot”. You can add funds at any time to Your My Cashpot using a suitable payment card. In the event of a technical, administrative or other error in the “My Cashpot” balance of Your account or if it exceeds the correct value then You must inform Us at the earliest opportunity. You are not permitted to spend funds in My Cashpot that You know You are not eligible to receive. Knowingly spending ineligible funds constitutes fraud. BW reserves the right to take legal and/or other remedies to recover these payments. All orders are subject to fraud prevention and security checks. We take all reasonable care to ensure there are no errors, we reserve the right to refuse an order where an error has occurred or for any other reason. BW cannot accept responsibility for any loss, liability, claim, damage, expense or cost whether as a consequence of negligence or otherwise arising in connection with an order placed for a Gift Card or Digital Voucher. The issuer of the Gift Cards and Digital Vouchers will account for tax under the face value voucher provisions in Schedule 10A VAT Act 1994. DELIVERY COSTS AND TIMESCALES The costs and timescales of delivery will be as displayed to you on our Website or as otherwise notified to you. We are not responsible for delays outside our control. If our supply of the Gift Cards or Digital Vouchers is delayed by an event outside of our control, including where you have provided incorrect delivery instructions, then we will contact you as soon as possible to let you know and will take steps to minimise the effect of the delay. Provided we do this we will not be liable for delays caused by the event but if there is a risk of substantial delay you may contact us to end the contract and receive a refund for any Gift Cards or Digital Vouchers you have paid for but not received. You should check your Gift Cards or Digital Vouchers promptly on receipt to ensure the quantities are correct and the Gift Cards or Digital Vouchers are not damaged. If the any are faulty or incorrect, you may contact us to receive a full refund within 30 days of the date you receive the Reloadable Gift Cards or Digital Vouchers. After the end of the 30 day period and before the end of the 6 month period from the date you receive your Gift Cards or Digital Vouchers we will, at our choice, repair, replace or issue a refund for any faulty or incorrect Gift Cards or Digital Vouchers. Replacement Gift Cards or Digital Vouchers. These terms apply to any replacement Gift Cards or Digital Vouchers We supply. PAYMENT METHODS We only accept consumer credit and debit cards such as VISA, MasterCard and Switch which are registered in the UK. We do not accept American Express payment cards. On the order You must provide us with Your exact billing address and telephone number - the address and phone number Your credit card bank has on file for You. Incorrect information will cause a delay in processing Your order. Your order will only be processed once authorisation of Your credit/debit card payment been properly received. YOUR ACCOUNT BW reserves the right to close Your account if You are deemed, at Our sole discretion, to be attempting to defraud, deception or any misuse of the Services or in any other unacceptable manner. Your account will also be closed if You leave Your employer or association or affinity sponsoring the scheme or You are in breach of these terms and conditions. Once the closure process is complete, You will no longer be able to access the value in your My Cashpot and it will be void.
