A successful debt recovery process must take into account the ex-employee’s
financial circumstances and ability to repay the overpaid wages.

This said, a successful debt recovery process is also an escalation process and
our workflows will aim to gradually increase pressure whilst all communications
remain professional at all times.

Once the financial circumstances of the ex-employee have been assessed, we will
monitor and review repayment agreements regularly.


HOW DOES IT WORK

WO will make the initial contact with the ex-employee and reiterate the wage
overpayment situation inviting repayment proposals. Some ex-employee will ignore
the situation and refuse to engage with WO.

At this stage CLI will take over the management of the case and commence the
debt collection process.

CLI ‘s letters remain professional but the change of identity of the third party
handling the case will generate more responses and engagement.

The purpose of our emails or letters is to receive payment by return, but in
many cases, our written communications will start a dialog in the form of
incoming phone calls, emails or letters.

Our skilled negotiators will respond to your ex-employees, reiterate how the
overpayment occurred and they will check how and when the overpayment can be
repaid.




ADDITIONAL SERVICES


TRACING

Sometimes, your ex-employee will have moved to another address and our initial
letters will get returned to us marked “gone away”.

At this stage, we refer the case to our tracing department. More often than not,
we will be able to produce a new address and we will start our written
communications again.

LEGAL ACTION

A small minority of our clients’ ex-employees will decide to keep a low profile
hoping that this will go away and that they will never have to repay the wages
they received in error.

On 1st October 2017, a Pre-Action Protocol for Debt Claims has come into force.
This is a procedure which creditors have to follow prior to commencing legal
action against their debtors.

The Pre-Action Protocol have brought a new dimension to the debt collection
process. We like it because we get another bite of the cherry! Nothing gets
filed into Court at this stage but the forms are similar to Court forms and send
an ultimate message to ex-employees that unless they address the situation,
there is a strong likelihood that the matter will end up in Court.

Where the Pre-Action Protocol does not generate repayment of the overpaid wages,
we are able to manage the entire legal process on behalf of our clients.

We will organise the issue of Court Proceedings, request Judgments and organise
enforcement through the High Court Enforcement Officer.
