<p><strong>2024 All-Star Week<br>Participant Release, Waiver of Liability, Assumption of Risk, and Indemnity Agreement (“Release”)<br>PLEASE READ CAREFULLY - THIS IS A RELEASE OF LIABILITY AND WAIVER OF LEGAL RIGHTS</strong></p>
<p>In consideration of, and as condition to, allowing me and/or any child(ren) under eighteen (18) years old or any legally incapacitated adult(s) for whom I am the parent/guardian (each, a “Participant”; and collectively the “Participants”,
“we”, “us”, or “our”) to participate in the attractions, events and other activities of 2024 Major League Baseball All-Star Week, which may include, but are not limited to, batting practice, pitching or throwing competitions, virtual home run
derbies, and other activities inherent in the sports of baseball and softball; running, sprinting, or racing; riding in vehicles or driving vehicles; putting on a Velcro suit and jumping onto a Velcro wall; jumping onto a trampoline surface
that appears as a home plate; riding on a Ferris wheel; interacting with animals; and eating different types of ballpark food (collectively, the “Activities”), I, for myself and on behalf of all of the other Participants and our parents,
heirs, personal and legal representatives, estates, executors, administrators, next of kin, successors, and assigns, all of whom shall be legally bound by this Release, hereby agree as follows:</p>
<ul role="list">
<li>We will observe all rules concerning the Activities, and the locations and/or places at which the Activities take place.</li>
</ul>
<ul role="list">
<li>We are of good health, able bodied, and well enough to participate in the Activities. Our participating in the Activities is voluntary. If we become unwell, or are otherwise not physically able to participate, we will stop participating
in the Activities. Also, we will not participate in the Activities if we are required or recommended by Centers for Disease Control and Prevention guidance and/or applicable laws or policies of federal, state, city or local authorities to
stay at home, quarantine and/or isolate (e.g., as a result of testing positive for, experiencing symptoms of, or being in direct contact with someone who tested positive for, COVID-19 or other communicable disease).</li>
</ul>

<li>We understand the nature of the Activities, that the Activities are risky, and that those risks include serious bodily injury, illness (including COVID-19 or other communicable disease), death or property loss or damage, due to, without
limitation, contracting COVID-19 or other communicable disease, or being injured by bats, balls, projectiles, surfaces, equipment or other items, incidents or accidents associated with baseball or softball activities; running, jumping, or
throwing; eating; interacting with animals; being around crowds of people; the negligent acts or omissions of other participants in the Activities, or the negligent acts or omissions of any MLB Companies (as such term is defined below). I,
ON BEHALF OF MYSELF AND ALL OF THE OTHER PARTICIPANTS, VOLUNTARILY ASSUME ALL RISKS ASSOCIATED WITH THE ACTIVITIES AND PARTICIPATION IN THE ACTIVITIES, INCLUDING WITHOUT LIMITATION, THE RISK OF EXPOSURE TO COVID-19 OR OTHER COMMUNICABLE
DISEASE, NEGLIGENCE BY ANY OTHER PERSON OR ANY MLB COMPANIES, AND ANY OTHER RISK OF INJURY, ILLNESS, DEATH OR PROPERTY LOSS OR DAMAGE.</li>
</ul>

<li>MANDATORY AGREEMENT TO INDEMNIFY, DEFEND AND HOLD HARMLESS. I, ON BEHALF OF MYSELF AND ALL OF THE OTHER PARTICIPANTS, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WAIVE AND RELEASE ALL CLAIMS OF ANY KIND (INCLUDING ANY CLAIM FOR
NEGLIGENCE, BUT NOT INCLUDING GROSS NEGLIGENCE, RECKLESSNESS, OR INTENTIONAL MISCONDUCT) WITH RESPECT TO THE ACTIVITIES AND OUR PARTICIPATION IN THE ACTIVITIES (HEREINAFTER, INDIVIDUALLY AND COLLECTIVELY, “RELEASED CLAIMS”) AGAINST ANY
PERSON OR ENTITY ASSOCIATED WITH THE ACTIVITIES, including the Office of the Commissioner of Baseball, MLB Advanced Media, L.P., Major League Baseball Properties, Inc., The MLB Network, LLC, each of the Major League Baseball clubs, Major
League Baseball Youth Foundation, Major League Baseball Charities, Inc., Tickets.com, LLC, Verotown LLC, BaAM US LLC, the Cities of Arlington and Fort Worth, Major League Baseball sponsors and licensees (including Capital One Services,
LLC), the owners and operators of all venues where Activities are held and all other Major League Baseball-related entities, and each of their respective past, present and future related entities, subsidiaries, affiliates, officers,
directors, partners, owners, shareholders, governors, agents, servants, officials, employees, volunteers, successors, assigns, rightsholders, sponsors, insurers, and/or licensees (together, the “MLB Companies”). I COVENANT THAT NEITHER I
NOR ANY OF THE OTHER PARTICIPANTS WILL SUE ANY OF THE MLB COMPANIES WITH RESPECT TO ANY RELEASED CLAIMS OR ANY OTHER MATTER ADDRESSED BY THIS RELEASE AND I WILL INDEMNIFY, DEFEND, AND HOLD HARMLESS THE MLB COMPANIES FROM AND AGAINST ANY
RELEASED CLAIMS, INCLUDING IF SUCH CLAIM IS BROUGHT BY A THIRD PARTY, OR ANY OTHER MATTER ADDRESSED BY THIS RELEASE, INCLUDING WITH RESPECT TO CLAIMS THAT ARISE FROM THE SOLE OR CONCURRENT CONDUCT OF THE MLB COMPANIES (INCLUDING CLAIMS
BASED ON OR INVOLVING THE MLB COMPANIES’ NEGLIGENT ACTS OR OMISSIONS, STRICT LIABILITY, FAULT OR OTHER TORT).</li>
</ul>

<li>Mandatory Arbitration Agreement, Choice of Law, and Forum. If we do try to pursue any kind of legal claim arising out of or relating to this Release against the MLB Companies, we agree that we may only bring our claim via confidential,
final and binding arbitration held in Dallas, Texas, governed by Texas law, under the commercial arbitration rules of JAMS. The arbitrator shall have sole authority to determine any and all claims challenging the validity or enforceability
of this Arbitration Agreement. We waive the ability to join our claims with others in arbitration or any other forum or participate in any class action. ANY DISPUTE WILL BE ARBITRATED ON AN INDIVIDUAL BASIS, AND NOT AS A CLASS ACTION,
REPRESENTATIVE ACTION, CLASS ARBITRATION OR ANY SIMILAR PROCEEDING.</li>

<li>CLASS ACTION WAIVER. THE FOREGOING SHALL NOT BE CONSTRUED TO LIMIT THE CLASS ACTION WAIVER TO ARBITRATION. WE WAIVE THE RIGHT TO A CLASS ACTION BEFORE ANY COMPETENT JURISDICTION.</li>

<li>Permission to Use Name, Image, and Likeness: We agree that the MLB Companies may photograph or film us at the Activities. We also agree that the MLB Companies can use our likeness, name, words, voice, biographical information, or any
other identifying characteristics gathered during, or for purposes of, our engagement in the Activities, in any sort of media and any sort of promotion (including tv shows or movies, social media, advertisements or any forms of media
invented in the future). We understand that by accepting this Release, we are prevented from bringing any claims against the MLB Companies for such uses, including claims for invasion of privacy, defamation, misappropriation, or violation
of publicity rights.</li>
</ul>

<li>We understand and agree that the MLB Companies will obtain some of our personal information from this form, and from our registration for or participation in the Activities. We also understand and agree that the MLB Companies may use that
information for business purposes, including by sharing it with or selling it to other MLB Companies or third parties. We understand that - if we live in California - we may have the right in some circumstances to access our personal data
that the MLB Companies hold, to have the data deleted, or to tell the MLB Companies not to sell it. For details we can go to

I would like to receive commercial e-mails from MLB and their partners. 2024 All-Star Week Participant Release, Waiver of Liability, Assumption of Risk, and Indemnity Agreement (“Release”) PLEASE READ CAREFULLY - THIS IS A RELEASE OF LIABILITY AND WAIVER OF LEGAL RIGHTS In consideration of, and as condition to, allowing me and/or any child(ren) under eighteen (18) years old or any legally incapacitated adult(s) for whom I am the parent/guardian (each, a “Participant”; and collectively the “Participants”, “we”, “us”, or “our”) to participate in the attractions, events and other activities of 2024 Major League Baseball All-Star Week, which may include, but are not limited to, batting practice, pitching or throwing competitions, virtual home run derbies, and other activities inherent in the sports of baseball and softball; running, sprinting, or racing; riding in vehicles or driving vehicles; putting on a Velcro suit and jumping onto a Velcro wall; jumping onto a trampoline surface that appears as a home plate; riding on a Ferris wheel; interacting with animals; and eating different types of ballpark food (collectively, the “Activities”), I, for myself and on behalf of all of the other Participants and our parents, heirs, personal and legal representatives, estates, executors, administrators, next of kin, successors, and assigns, all of whom shall be legally bound by this Release, hereby agree as follows: * We will observe all rules concerning the Activities, and the locations and/or places at which the Activities take place. * We are of good health, able bodied, and well enough to participate in the Activities. Our participating in the Activities is voluntary. If we become unwell, or are otherwise not physically able to participate, we will stop participating in the Activities. Also, we will not participate in the Activities if we are required or recommended by Centers for Disease Control and Prevention guidance and/or applicable laws or policies of federal, state, city or local authorities to stay at home, quarantine and/or isolate (e.g., as a result of testing positive for, experiencing symptoms of, or being in direct contact with someone who tested positive for, COVID-19 or other communicable disease). * We understand the nature of the Activities, that the Activities are risky, and that those risks include serious bodily injury, illness (including COVID-19 or other communicable disease), death or property loss or damage, due to, without limitation, contracting COVID-19 or other communicable disease, or being injured by bats, balls, projectiles, surfaces, equipment or other items, incidents or accidents associated with baseball or softball activities; running, jumping, or throwing; eating; interacting with animals; being around crowds of people; the negligent acts or omissions of other participants in the Activities, or the negligent acts or omissions of any MLB Companies (as such term is defined below). I, ON BEHALF OF MYSELF AND ALL OF THE OTHER PARTICIPANTS, VOLUNTARILY ASSUME ALL RISKS ASSOCIATED WITH THE ACTIVITIES AND PARTICIPATION IN THE ACTIVITIES, INCLUDING WITHOUT LIMITATION, THE RISK OF EXPOSURE TO COVID-19 OR OTHER COMMUNICABLE DISEASE, NEGLIGENCE BY ANY OTHER PERSON OR ANY MLB COMPANIES, AND ANY OTHER RISK OF INJURY, ILLNESS, DEATH OR PROPERTY LOSS OR DAMAGE. * MANDATORY AGREEMENT TO INDEMNIFY, DEFEND AND HOLD HARMLESS. I, ON BEHALF OF MYSELF AND ALL OF THE OTHER PARTICIPANTS, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WAIVE AND RELEASE ALL CLAIMS OF ANY KIND (INCLUDING ANY CLAIM FOR NEGLIGENCE, BUT NOT INCLUDING GROSS NEGLIGENCE, RECKLESSNESS, OR INTENTIONAL MISCONDUCT) WITH RESPECT TO THE ACTIVITIES AND OUR PARTICIPATION IN THE ACTIVITIES (HEREINAFTER, INDIVIDUALLY AND COLLECTIVELY, “RELEASED CLAIMS”) AGAINST ANY PERSON OR ENTITY ASSOCIATED WITH THE ACTIVITIES, including the Office of the Commissioner of Baseball, MLB Advanced Media, L.P., Major League Baseball Properties, Inc., The MLB Network, LLC, each of the Major League Baseball clubs, Major League Baseball Youth Foundation, Major League Baseball Charities, Inc., Tickets.com, LLC, Verotown LLC, BaAM US LLC, the Cities of Arlington and Fort Worth, Major League Baseball sponsors and licensees (including Capital One Services, LLC), the owners and operators of all venues where Activities are held and all other Major League Baseball-related entities, and each of their respective past, present and future related entities, subsidiaries, affiliates, officers, directors, partners, owners, shareholders, governors, agents, servants, officials, employees, volunteers, successors, assigns, rightsholders, sponsors, insurers, and/or licensees (together, the “MLB Companies”). I COVENANT THAT NEITHER I NOR ANY OF THE OTHER PARTICIPANTS WILL SUE ANY OF THE MLB COMPANIES WITH RESPECT TO ANY RELEASED CLAIMS OR ANY OTHER MATTER ADDRESSED BY THIS RELEASE AND I WILL INDEMNIFY, DEFEND, AND HOLD HARMLESS THE MLB COMPANIES FROM AND AGAINST ANY RELEASED CLAIMS, INCLUDING IF SUCH CLAIM IS BROUGHT BY A THIRD PARTY, OR ANY OTHER MATTER ADDRESSED BY THIS RELEASE, INCLUDING WITH RESPECT TO CLAIMS THAT ARISE FROM THE SOLE OR CONCURRENT CONDUCT OF THE MLB COMPANIES (INCLUDING CLAIMS BASED ON OR INVOLVING THE MLB COMPANIES’ NEGLIGENT ACTS OR OMISSIONS, STRICT LIABILITY, FAULT OR OTHER TORT). * Mandatory Arbitration Agreement, Choice of Law, and Forum. If we do try to pursue any kind of legal claim arising out of or relating to this Release against the MLB Companies, we agree that we may only bring our claim via confidential, final and binding arbitration held in Dallas, Texas, governed by Texas law, under the commercial arbitration rules of JAMS. The arbitrator shall have sole authority to determine any and all claims challenging the validity or enforceability of this Arbitration Agreement. We waive the ability to join our claims with others in arbitration or any other forum or participate in any class action. ANY DISPUTE WILL BE ARBITRATED ON AN INDIVIDUAL BASIS, AND NOT AS A CLASS ACTION, REPRESENTATIVE ACTION, CLASS ARBITRATION OR ANY SIMILAR PROCEEDING. * CLASS ACTION WAIVER. THE FOREGOING SHALL NOT BE CONSTRUED TO LIMIT THE CLASS ACTION WAIVER TO ARBITRATION. WE WAIVE THE RIGHT TO A CLASS ACTION BEFORE ANY COMPETENT JURISDICTION. * Permission to Use Name, Image, and Likeness: We agree that the MLB Companies may photograph or film us at the Activities. We also agree that the MLB Companies can use our likeness, name, words, voice, biographical information, or any other identifying characteristics gathered during, or for purposes of, our engagement in the Activities, in any sort of media and any sort of promotion (including tv shows or movies, social media, advertisements or any forms of media invented in the future). We understand that by accepting this Release, we are prevented from bringing any claims against the MLB Companies for such uses, including claims for invasion of privacy, defamation, misappropriation, or violation of publicity rights. * We understand and agree that the MLB Companies will obtain some of our personal information from this form, and from our registration for or participation in the Activities. We also understand and agree that the MLB Companies may use that information for business purposes, including by sharing it with or selling it to other MLB Companies or third parties. We understand that - if we live in California - we may have the right in some circumstances to access our personal data that the MLB Companies hold, to have the data deleted, or to tell the MLB Companies not to sell it.
