EXEMPTIONS UNDER SECTION 16. OF THE MOTOR VEHICLE TRANSPORT ACT

Pursuant to the Motor Vehicle Transport Act, the following exemptions from
certain regulatory provisions of the Commercial Vehicle Drivers Hours of Service
Regulations have been granted. Each exemption granted was deemed to be in the
public interest and includes terms and conditions that are intended to maintain
an equivalent level of motor carrier safety. The exemption is available to
qualified motor carriers who operate in an industry sector and are not just
members of the applicant association. The affected jurisdictions were consulted
before the Minister of Transport granted these exemptions:
APPLICANT: DRIVEAWAY OPERATIONS
Exemption from having to use an Electronic Logging Device (ELD) to maintain or
fill out a record of duty status under the Commercial Vehicle Drivers Hours of
Service Regulations [PDF, 182 KB]
The purpose of this exemption is to allow eligible motor carriers and their
drivers to record their record of duty status in accordance with s. 82 of the
Regulations, rather than under s.77. This is being done to address material and
operational problems presented by using electronic logging devices to monitor
compliance with the Regulations in these specific sectors of the motor carrier
industry.
APPLICANT: CANADIAN ASSOCIATION OF ENERGY CONTRACTORS
Exemption from having to maintain or fill out a record of duty status under the
Commercial Vehicle Drivers Hours of Service Regulations
The purpose of this exemption is to allow eligible motor carriers and their
drivers to avoid the duplication of having to complete both a record of duty
status and other industry documents, thereby making use of existing
documentation to demonstrate compliance with the work limits, rest requirements,
and record-keeping requirements.
APPLICANT: CANADIAN PACIFIC RAILWAY
Exemption to allow an alternative to the on-duty time limit before having to
take 24 hours off in cycle 2 under the Commercial Vehicle Drivers Hours of
Service Regulations
The purpose of this exemption is to allow Canadian Pacific Railway and its
maintenance of way workers who drive commercial vehicles as part of their duties
to take larger periods of daily consecutive off-duty time as an alternative to
meeting the mandatory off-duty time requirements of clause 27(b) of the
Regulations.
APPLICANT: FERTILIZER CANADA
Exemption to allow an alternative to operating under the duty cycles established
under the Commercial Vehicle Drivers Hours of Service Regulations
The purpose of this exemption is to allow extra-provincial truck undertakings
and their drivers to operate under a more flexible work schedule as an
alternative to the accumulation of on-duty hours by drivers under either cycle 1
or cycle 2.
Transport Canada is closely monitoring the COVID-19 situation. In response, we
