FEDERAL COURT PUTS GENDER NONDISCRIMINATION RULE ON HOLD

A federal district court in Mississippi granted 15 states' request to put a
federal gender nondiscrimination rule on hold across the country two days before
it was set to go into effect Friday.

The decision keeps the rule, which was designed to protect healthcare services
for LGBTQ+ patients, from kicking in while the lawsuit continues. While federal
courts Wednesday agreed to preliminary injunctions in Florida, Texas and Montana
in separate lawsuits over the Biden administration’s rule on Section 1557 of the
Affordable Care Act, the federal court in Mississippi put in place a nationwide
preliminary injunction and stay of the regulation.

Section 1557 prohibits treatment and coverage discrimination on the basis of
race, ethnicity, age, disability or sex, and each of the past three
administrations faced lawsuits over their varied interpretations. Oklahoma,
Indiana, Kentucky, Kansas, South Dakota, South Carolina, Ohio, Mississippi,
Alabama, Nebraska, Virginia, West Virginia, Georgia, Tennessee and Louisiana
filed a lawsuit against the rule in May.



The 15 states allege in a Mississippi federal court filing that the Health and
Human Services Department’s rule does not define sex and therefore can't dictate
what it means to discriminate on the basis of sex. They allege that HHS has
threatened states and providers with massive penalties for not lining up
coverage and care policies with patients' gender identities.

District Judge Louis Guirola, Jr. said he factored into his decision the
“substantial likelihood” that states could “suffer irreparable harm in the form
of either compliance costs or lost federal funding," if the rule were to go into
effect. HHS, on the other hand, would not face financial harm by putting the
rule on hold.



Providers' burden in complying with the rule also contributed to the judge's
decision to grant the preliminary injunction, according to court documents. 

“The administration has over and over again issued regulations that mangle the
law to advance an ideological agenda,” said Tennessee Attorney General Jonathan
Skrmetti in a statement. “This case is just one of many examples of Tennessee
working with other states to block the unlawful abuse of regulatory power.”

LGBTQ advocates pushed back on the court's decision. Kellan Baker, who helped
draft Section 1557 while working at the advocacy organization National Coalition
for LGBTQ Health, said the rule is critical to protect marginalized communities’
access to equitable, nondiscriminatory care.

“This ruling is part of a dangerous trend in which politicians deny and
disregard the clear evidence documenting the harms of widespread discrimination
against LGBTQ+ people, particularly transgender people, in healthcare and health
insurance,” said Baker, now the executive director of the Whitman-Walker
Institute, a LGBTQ+ research and advocacy organization.
