UPDATES TO OUR TERMS AND POLICIES

You can review our revised terms and policies by clicking through each link
below. We recommend reading through the documents for yourself, but here’s a
short explanation of the changes:

Updates to Privacy Notice.

 * If you are a business user of our self-serve SurveyMonkey products, we want
   to be able to provide your organization with better recommendations on the
   features and plans which might be of interest to your organization, and to
   help our sales teams have meaningful discussions with your organization about
   use of our services. We are therefore going to be providing our teams with
   more information about usage data within accounts (for example, types of
   surveys you are creating, numbers of surveys deployed and numbers of
   responses you are receiving) so that they can share this with your
   organization and help them understand the value of our service offerings. 
 * For our SurveyMonkey Enterprise plan users, we included reference to a new
   functionality in that plan. Starting on or after September 17, 2021, we will
   begin allowing administrators to delete, transfer, and share a member’s
   survey questions and responses with other members of the plan.  This
   functionality may also allow the administrator to make changes to any aspects
   of a member’s survey questions and analysis.

New Privacy Terms in the TOU and New Data Processing Agreement (“DPA”)
Effective Date: September 1, 2021.
To address the introduction of new standard contractual clauses by the European
Commission (Commission Decision), we have deprecated our data processing
language in our TOU (previously Section EU2). We are also deprecating our
self-serve DPA which was available through a Wufoo application form. Instead we
are now incorporating a new DPA into our TOU so that it is directly applicable,
as appropriate, to all customers who require it. This references the fact that
we have put in place new standard contractual clauses between our European
affiliates and our non-European affiliates to address international personal
data transfers.

Updates to Terms of Use (“TOU”). We have simplified and reorganized our TOU to
make it clearer and easier to understand. In addition:

 * We clarified a few sections which we encourage you to review, including: 
   Section 2.2 (Confidentiality); Section 2.3 (Security); and Section 13.3
   (Limitation of Liability).
 * For all SurveyMonkey account holders, we’re moving to a new login system that
   requires logging in with your email address instead of a username. For a
   smooth transition, please go to the My Account page and confirm you can
   access the email address that’s listed.
 * For services provided by Momentive Inc., we made the state courts in San
   Mateo County, California the jurisdiction in the event of a dispute over
   services acquired through our websites.

Updates to Acceptable Uses Policy: We have clarified our expectations of users
of our Services and actions that we may take in the event of a violation of our
Acceptable Uses Policy.

Updates to Subprocessor List: We included our GetFeedback Direct subprocessors
within our main Subprocessor List here. We have also added a new subprocessor
for SM Apply, Bridgewater, to the list.

Other things to note:

 * Except for the dates outlined above, all changes we are introducing go into
   effect on October 17, 2021 for any users who have accounts with us prior to
   August 16, 2021.
 * For our key policies, we maintain archived versions as well so you can
   compare the changes.
 * We hope that you found the above summary helpful. We've highlighted what we
   think are the most noteworthy changes, but you should also review the
   documents in full yourself.
