After a youth has had contact with the juvenile justice system, it is difficult to start adult life with a clean slate. The principal problem is records of that contact will follow him or her indefinitely, with potential for harmful consequences well into adulthood. The records are held by the juvenile court, justice agencies, educational institutions, and businesses where a crime may have been committed, and most states have inadequate procedures for sealing or expunging those records. The result is that the records may have a negative impact on an adult’s efforts to live a productive life. The impact of juvenile records is an issue that has been neglected in the United States. In this article, Judge Leonard Edwards discusses the negative impact the existence of juvenile justice records may have on an adult, and proposes recommendations that will minimize the impact of these records on adults. The Consequences and Harm of Mandatory Reporting for Young People Emily Austin and Shannon Perez-Darby Many people who work with survivors of gender-based violence will also come in contact with sexual assault mandatory reporting laws in their states and jurisdictions. For all the good intentions wrapped up in states’ mandatory reporting laws, it remains true that mandatory reporting causes harm. It forces vulnerable communities and individuals into contact with systems that historically and currently have not been safe for them. This forced reporting separates children from families and support networks, and it chills and prevents outreach for help because of the threat of what can happen to one’s family and community. This article examines specific examples of how mandatory reporting harms people who already face disparate impacts, in policing and incarceration rates, and advocates for limiting its use in favor of more trauma-informed responses.
