We consider this case breach of contract which can lead - by our sole decision - to the cancellation of your account with forfeiture of any funds paid to date. We also have a right to limit several and simultaneous logins by the same user or IP address. 3. PAYMENT 3.1 When you make purchases on CheckDecide, you must provide us true information of your real name, billing address, email address and credit/debit card or other account charge authorization information. 3.2 In case you request cashing out tokens you earned CheckDecide has the right to apply 5% fee if the amount is smaller than $1000. Cash outs over $1000 are free of charge. 3.3. CheckDecide uses personal and individual tokens for your in-app transactions. Prices are shown in tokens, revenue share, affiliate commission, refer-a-friend bonus all arise in tokens. When purchasing tokens, you have to pay 1 dollar for each token needed. When cashing out tokens you receive 1 dollar for each token. Price of content and services are deducted in tokens from the purchasing account, and are put a sum to vendor’s account in tokens. CheckDecide’s revenue share is deducted from vendor’s income, according to vendor’s personal revenue share. As a default, PURCHASED tokens cannot be cashed out or withdrawn, please keep this in mind when purchasing them. You can only cash out tokens you EARNED by selling or affiliating content and services. However, if you purchased tokens, spent them on a content and you found the description of the content misleading or the content is of low quality, please email us to support@checkdecide.com and we will investigate the issue thoroughly, potentially ordering a refund. 3.3.1. Our VAT Protocol. Prices always contain VAT, according to the country of the user making the purchase. Please keep in mind: when a purchase happens we first have to deduct the VAT. Your revenue share, affiliate commision, refer-a-pro bonus are always applied on the net amount. 3.3.2 Affiliate deals. Your revenue share, affiliate commission and refer-a-pro bonus always depends on your ranking amongst the users at the moment of the transaction. Ranking is based on the number of customers you affiliated and the list is updated every hour. UserA buys 100 tokens for $100. UserA spends the 100 tokens on your content. UserA is from a country with 18% VAT >> we have to pay 15,25 tokens as VAT >> the net sales is 84,75 tokens (=100/1,18) >> You receive 50,85 tokens as your 60% revenue share + 8,47 tokens as your 10% affiliate commission >> your affiliate parent receives 5,08 tokens as their 6% refer-a-pro bonus. >> approximately 3,5 tokens go to the payment provider >> 16,85 tokens are the gross profit of CheckDecide (please note: we still have to pay for servers, support, maintanance, marketing, security, taxes, etc.) Affiliate and refer-a-friend deals have 24 month pull-out period, starting from the sign up day of every new registrant. Please note: anyone who can access a content can create their own affiliate link by clicking on the SHARE button. This means other users can create their affiliate links pointing to your content and you can also create your affiliate links pointing to their content. It is always the creator of the LINK who receives the affiliate commission(Point 3.3.2.). The content creators are rewarded by the revenue share. By accepting the terms and conditions you agree that CheckDecide has the right to list your PUBLIC hands and use them to promote our services, and CheckDecide has the right to provide this list of your public hands to our affiliate partners who may create their own affiliate links to your public content. These terms only stand for your public hands of course: if you restrict the core privacy of your content to 'private' or 'friends' privacy, those links will no longer work. 3.3.3. Recurring billing & refund Policy CheckDecide offers subscription plans which allows you to access premium content and advanced services. When purchasing a subscription plan, you accept recurring billing, meaning you are going to be charged automatically in each month on the date you signed up. You can stop recurring billing any time by switching it off in the settings. We offer money back guarantee on the subscription plans (30 days on the Premium plan and 7 days on the Mosaic plan). If you are disappointed by the service for any reason, please send us an email to support@checkdecide.com indicating your username and we are going to issue a refund. Please note: this guarantee is only automatic for your first purchase. If it’s not your first month of the subscription, but you are disappointed with the service and you think we should refund you, please still send us an email to support@checkdecide.com! We are going to investigate every single refund request carefully and issue a refund if we find the complaints valid. If it’s you who sold content or service and the user who purchased content or service from you requests refund or starts a chargeback process, we have the right to cancel the original transaction between the two of you and deduct the referred amount of tokens from your account. Similarly, if you had received affiliate commission or refer-a-pro bonus from a transaction that later was cancelled based on a refund request or chargeback, we have the right to deduct the referred amount of tokens from your account. CheckDecide has the right to suspend or close your account if you repeatedly use misleading title or description for your content either in the platform or in your related advertisements. 3.3.4. Taxes Please note: According to the anti money-laundry regulations before completing a cash out transaction for you, we have to check your identity and of your address. This practically means a copy of a government issued picture ID and a copy of a utility bill sent to verification@checkdecide.com. We are not aware of the taxes you may have to pay after your earnings at CheckDecide. CONTENT 4.1 CheckDecide helps you become a better poker player by providing unique platform to practice the game. We provide features to compare plays, and we help you with reviews and detailed statistics. Still, your hands are yours, moreover we are going to release additional features enabling you to insert media elements - photos, comments, links, videos and other materials - to your content. Anything you post or otherwise make available on CheckDecide is referred as User Content. You retain all rights in, and are solely responsible for the User Content you post to CheckDecide. 5. HOW CHECKDECIDE CAN USE YOUR CONTENT As the integrity of the accounts is crucial for CheckDecide, you are only allowed to upload poker hands you personally played and videos you personally created. Also you accept that if we have a reasonable suspicion to believe that you uploaded someone elses content or that you made up or modified contents to mislead other users, CheckDecide has the right to delete them. You are free to set the privacy level for all your uploads. Your options: PRIVATE MODE – noone else can access your content but you FRIENDS MODE - only you and your in-app friends are able to access your hands. You are free to create friendship with any member on CheckDecide, the friendship comes into existence with the acceptance of the friend invitation. PUBLIC MODE – anyone who has the link of your content or visits your profile page is able to access your content. If you have set core privacy level of a content friends or private, you can extend access by setting a price, creating a ’moneymaker’ content - as we call it. In this case, anyone who pays the price, receives instant access to the content. The revenue generated is shared according to your ranking. See point 3.3.2. CheckDecide has the right to generate free-access coupons to any moneymaker content, up to 10% of the number of entries you already sold. E.g. you sell 100 entries for 20$ each: we can generate 10 free coupons to your moneymaker content and use those to promote CheckDecide or to reward most valuable members. Users with the Premium plan enjoy 20% discount on any of their purchases in the marketplace. This means that if a Premium user purchases a content of yours, the total sales is discounted by 20%. So the discount affects you (the content creator), the affiliates and CheckDecide proportionally. In case a security or integrity issue arises, a limited number of trusted employees (admins) are allowed to access any hand in our system, with maximum respect towards the privacy of your content. Please note: anyone who can access a content can create their own affiliate link by clicking on the SHARE button. This means other users can create their affiliate links pointing to your content and you can also create your affiliate links pointing to their content. It is always the creator of the LINK who receives the affiliate commission (Point 3.3.2.). The content creators are rewarded by the revenue share. CheckDecide has the right to serve the affiliate partners with lists of all the PUBLIC content. If you have any public content, the affiliate partners of CheckDecide (e.g. SharkScope) may display a ’CheckDecide content creator’ tag beside your screennames in their system. They also have the right to create and use affiliate links pointing at your PUBLIC content. These terms only stand for your PUBLIC hands of course: if you restrict the core privacy of your content to 'PRIVATE' or 'FRIENDS', those links will no longer work. 6. HOW LONG WE KEEP YOUR CONTENT? Following termination or deactivation of your account, or if you remove any User Content from CheckDecide, we may keep your User Content for one year of time for backup, archival, or audit purposes. Genaral rule: those who made a review to a hand cannot loose access, if the user does not violate our policy. In addition: if your content had moneymaker (pay-to-access) status, or was subject of a replay request, copies of content shared with others may remain accessible for certain users even after you delete the content from your account. 7. LINKS AND IMAGES POSTED BY OTHER USERS 7.1. Links: CheckDecide may contain links to third party websites, advertisers, services, special offers, or other events or activities that are not controlled by CheckDecide. We do not endorse or assume any responsibility for any third party sites, information, materials, products, or services. If you access any third party website, service, or content from CheckDecide, you do so at your own risk and you agree that CheckDecide has no liability arising from your use of or access to any third party website, service, or content. 7.2. Images: in the comment section below the replayer and on the profile pages visited you may see images posted by other users. Images might contain hidden, malicious code aiming to infect your computer. CheckDecide applies advanced security protocol to protect you from this threat, but we do not endorse or assume any responsibility for any harm caused by images posted by other users. If you access the street comment section or a profile page, you do so at your own risk and you agree that CheckDecide has no liability arising from third party images being displayed to you. 8. OUR COPYRIGHT 8.1 We have adopted and implemented the CheckDecide Copyright Policy in accordance with the Digital Millennium Copyright Act and the European Union applicable copyright laws. CheckDecide respects the intellectual property rights of others and we expect everyone on CheckDecide to do exactly the same.
