To Whom Does this Privacy Notice Apply?

This Privacy Notice applies to individuals that are listed in our Talent
Database (“Candidates”).

What Data is Being Collected and Processed?

hireEZ collects data from third parties who legally sell or provide data they
collected and are authorized to share.  Through these sources we collect data
such as: names, email addresses, phone numbers, city or region, educational
background, career background, social media profile picture, social media
profile links, job skills, projects, and publications.  We may also
automatically collect certain electronic information about your interaction with
our service, such as whether an email was opened or responded to.

We do not knowingly collect personal data from children under the age of 16. If
we become aware that we have inadvertently received personal information from a
child under the age of 16, we will delete such information from our platform.

With Whom is Data Shared?

The data we collect is shared with hireEZ customers, who are employers and
recruiting teams looking to discover talent to fill their current and future job
openings.  We also share data with our sub-processors, who are contractually
bound to only process data in accordance with our instructions for limited
purposes.  The list of our third-party sub-processors can be found here:

We further share data with hireEZ’s data suppliers to ensure data is accurate
and up to date.  Such sharing is only performed with suppliers that pass our due
diligence process, maintain strong data privacy and security safeguards, and are
contractually bound by stringent Data Processing Agreements.

How is Data Processed and What is the Purpose?

We process your data to help make great matches between employers and
prospective employees.  We process your data by combining information we receive
from third parties regarding your contact information, employment history,
skillset, and similar information.  Employers and recruiters are then able to
search our platform for potential candidates that they believe may be fit for a
job opening.  If an employer is interested in you for a potential job
opportunity, they will reach out to you directly via email, phone, or text
message, if and as permissible under applicable law.

Our platform does not infer any skills that you may have. Instead, this data is
received directly from third parties, often traced back to information from
other publicly available platforms and websites on which you have disclosed this
information.  Our platform also attempts to predict whether you may be available
for a potential job opening by analyzing previous patterns of similar
candidates, current employment status, recent job applications, and market
trends, though this prediction does not affect search results.

We also assist employers at their request with their diversity, equity, and
inclusion recruiting goals and/or affirmative action plans.  This is done by
assessing publicly available data (such as job candidates’ pronouns, school(s),
languages spoken, and participating memberships) to infer whether a candidate is
a member of an underrepresented group.  This information helps ensure that
companies are complying with anti-discrimination laws and proactively building a
diverse workforce.  

For Candidates of the European Union (EU), European Economic Area (EEA), United
Kingdom (UK) and other regions that require similar lawful purposes to process
personal data, What is the Legal Basis for Data Processing?

hireEZ has performed an assessment and determined that the applicable legal
basis for processing candidate data is found under EU and UK GDPR Article
6(1)(f) - the legitimate interests of all parties involved, which are as
follows: 1) candidates’ interest in learning about job openings that fit their
skillset and experience, 2) employers’ and recruiters’ interests in discovering
and contacting potential employees to fill their job openings, 3) society’s
interest in reducing unemployment and increasing employee retention by
efficiently matching candidates to job openings, and 4) hireEZ’s interest in
providing these services and competing with other talent sourcing providers.

Where is the Data Being Processed?

hireEZ stores and processes personal data in the United States.  For data being
transferred from the EU/EEA/Switzerland to the United States, we use the
European Commission-approved Standard Contractual Clauses, and the EU-U.S. Data
Privacy Framework and/or Swiss-U.S. Data Privacy Framework, as applicable, as
the appropriate data transfer mechanisms.  For data being transferred from the
UK to the United States, we use the UK Parliament-approved International Data
Transfer Agreement (IDTA), and the UK Extension to the EU-U.S. Data Privacy
Framework, as the appropriate data transfer mechanisms. 

Data Privacy Framework

HireTeamMate, Inc. dba hireEZ complies with the EU-U.S. Data Privacy Framework
(EU-U.S. DPF), the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. Data
Privacy Framework, as set forth by the U.S. Department of Commerce. HTM has
certified to the U.S. Department of Commerce that it adheres to the EU-U.S. Data
Privacy Framework Principles (EU-U.S. DPF Principles) with regard to the
processing of personal data received from the European Union in reliance on the
EU-U.S. DPF and from the United Kingdom (and Gibraltar) in reliance on the UK
Extension to the EU-U.S. DPF. HTM has certified to the U.S. Department of
Commerce that it adheres to the Swiss-U.S. Data Privacy Framework Principles
(Swiss-U.S. DPF Principles) with regard to the processing of personal data
received from Switzerland in reliance on the Swiss-U.S. DPF.  If there is any
conflict between the terms in this privacy policy and the EU-U.S. DPF Principles
and/or the Swiss-U.S. DPF Principles, the Principles shall govern.

For How Long is Data Retained?

We retain candidate data for as long as such data would be useful to potential
employers and recruiters.  This could conceivably be for the duration of your
career in the workforce, but we have committed to retain data for no longer than
thirty years.  Of course, you may request that we delete your data at any time,
and we will promptly comply with such a request.

What are my Data Subject Rights?

hireEZ provides Candidates with all required data subject rights available under
applicable data privacy regulations, including: the right to access, correct,
and delete your data, the right to restrict and/or object to processing, the
right to withdraw any consent provided, the right to data portability, and the
right to opt out of any sale of data, targeted advertising, or profiling
activities that produce legal or similarly significant effects.  You may
exercise these rights by using our portal here -
https://app.hireez.com/ownyourdata, or by e-mailing privacy@hireez.com.  You may
also call our toll-free phone: +1 888-797-9291 ext. 1.  You are not required to
pay any charge for exercising your rights. If you make a request, we have one
month to respond to you.  You have the right to not receive discriminatory
treatment by us for the exercise of your privacy rights.  To complete a request,
you, or an authorized agent, may be required to verify your email address or
other personal information.

If our response to you is not to your satisfaction, you may appeal a decision
with regard to your request by emailing legal@hireez.com. 

For EU Candidates, if our response to you is not to your satisfaction, you may
also lodge a complaint with the supervisory authority in the Member State where
you have your habitual residence, place of work, or where an alleged
infringement of the GDPR has taken place. 

For UK Candidates, if our response to you is not to your satisfaction, you may
also lodge a complaint with the Information Commissioner’s Office.

Candidates can find the categories of Personal Data hireEZ collected,
sold/shared and disclosed in the past 12 months in our Privacy Policies here:

“Sold or Shared” was done with our customers as part of the hireEZ Outbound
Recruiting Platform product to assist with our customers’ talent acquisition
needs.  Any information disclosed by HTM for a “Business Purpose” was done with
our sub-processors and data providers as described above.
