YILLIK TEHLİKELİ MADDE FAALİYET RAPORU NEDİR?

Firmaların tüm faaliyet kollarında (alıcı – boşaltan – gönderen – dolduran –
paketleyen – taşıyan) 1 yıllık süreçte (1 Ocak / 31 Aralık) yapmış oldukları
faaliyet miktarlarının beyan edildiği bir raporlama sistemidir.

Her yıl mart ayının sonuna kadar geçilen sene özelinde raporlamalar firmaya
hizmet veren Tehlikeli Madde Güvenlik Danışmanları tarafından hazırlanarak
sisteme girişleri yapılmaktadır.

ADR MEVZUATINDA TEHLİKELİ MADDE FAALİYET TARAFLARI NELERDİR?

Alıcı: Taşıma evrakı, sevk irsaliyesi, taşıma irsaliyesi veya taşıma senedinde
belirtilen tehlikeli maddenin teslim edileceği işletmeyi veya taşıma işlemi,
taşıma sözleşmesi olmadan gerçekleştiriliyorsa, varış noktasında tehlikeli
malların idaresini üstüne alacak işletmeyi,

Boşaltan: Tehlikeli madde yüklü konteyneri, çok elemanlı gaz konteynerini,
tank-konteynerini, portatif tankı bir araçtan indiren; paketli tehlikeli
maddeleri ve portatif tankları bir araç veya konteynerden indiren; bir tüplü gaz
tankerinden, çok elemanlı gaz konteynerinden, bir araçtan veya dökme yük taşıyan
konteynerden boşaltan işletmeyi,

Dolduran: Tehlikeli maddeleri; tankerlere, tanklara, portatif tanklara ya da
tank-konteynerlere, tüplü gaz tankerlerine, çok elemanlı gaz konteynerine veya
konteynere dökme olarak dolum yapan işletmeleri,

Gönderen: Kendi adına veya bir üçüncü şahıs adına tehlikeli maddeleri gönderen
işletmeyi veya taşıma işlemi bir taşıma sözleşmesine bağlı olarak yürütülüyorsa,
sözleşmede “Gönderen” olarak belirtilen kişiyi,

Paketleyen: Tehlikeli maddeleri, büyük paketler ve orta boy hacimli konteynerler
de dahil olmak üzere değişik cinsteki kaplara yerleştiren ve gerektiğinde
paketleri taşınmak üzere hazır hale getiren işletmeleri,

Tank-konteyner/portatif tank işletmecisi: Tank-konteyner veya portatif tankları,
adına kayıtlı olduğu ya da bunları bir sözleşmeye dayalı olarak işleten
işletmecileri,

Taşımacı: Karayolu Taşıma Yönetmeliğine göre C1, C2, C3, K1, K2, K3, L1, L2, M1,
M2, N1, N2, P1, P2, R1, R2 ve TİO yetki belgesi sahiplerini,
Yükleyen: Paketli veya dökme tehlikeli maddelerin içerisinde bulunduğu ambalaj,
konteyner veya portatif tankları bir aracın içine veya üzerine veya bir
konteynerin içine yükleyen işletmeleri, ifade eder.

TEHLİKELİ MADDE TAŞIMACILIĞINDA TÜNEL KISITLAMALARINA UYMAM GEREKİR Mİ?

Taşınan tehlikeli maddeye göre ADR mevzuatında her ürünün A / B / C / D / E
olmak üzere ya bir tünel kodu vardır ya da tünel kodu sekmesinde – işareti
bulunmaktadır. Burada “–“ işareti olması o ürünün tüm tünellerden geçebileceğini
gösterir. Örnek olarak tünel kodu sekmesinde C yazıyor ise ürün A ve B
tünellerinden geçerken C , D ,ve E tünellerinden geçemez.

Tünel kısıtlamalarında A en iyi tüneli temsil ederken E en düşük kalitede ki
tüneli temsil etmektedir. Fakat tünel kısıtlamaları henüz ülkemizde
uygulanmamakta olup Tehlikeli maddelerin tünellerden geçişi şu an için tamamen
yasak durumdadır.

Not; Yönetmelikte 2019 sonuna kadar tünellerin harflendirileceği belirtilmekle
beraber (yönetmelik geçici madde 3) konunun tekrar uzatılmasını beklemekteyiz.
