MUMBAI: “It is clear that direction for compensation to a person surrendering
his right of parking does not dispense with the need for providing parking,”
said NGT on April 18 to a Mumbai builder who said residents are accepting
compensation in lieu of parking space.
The National Green Tribunal (NGT) principal bench at New Delhi not accepting
builder’s stand of compliance, directed that Maharashtra Pollution Control
Board(MPCB) and SEIAA, as statutory regulators, may take measures such as
assessment and recovery of compensation for past violations, using coercive
powers such as attaching the property and “black listing’’ the developer for not
complying with its 2015 order.
The NGT had in 2015 directed that an Environmental clearance (EC) granted in
2013 to a developer of a Slum Rehabilitation Area (SRA)
residential-cum-commercial project in Mulund (west), Mumbai be “deemed
inoperative’’ till the State Environmental Impact Assessment Authority (SEIAA)
reconsiders the extent of parking spaces, green and recreational ground in the
project premises and ensure that sewage is scientifically treated.
The NGT after hearing both sides said “SEIAA has still not taken any decision’’
seven years later.


The tribunal order said, “Thus, the status of EC remains that of “deemed
inoperative”. The PP (project proponent) stands restrained from carrying out any
further work till the issue is decided by SEIAA in terms of order of this
Tribunal.’’
Sandhya Kulkarni and others had filed an appeal before NGT against the EC
granted to the builder, Arihant Realtors and others, for being issued without
provision for parking, green belt and recreational area. In 2019 she approached
the NGT again and her lawyer Aditya Pratap sought orders for enforcement of the
2015 order. Pratap submitted that requirement of parking spaces could not be
waived when there was a court order in force and any compromise of parking space
is inimical to public interest.
Arihant Realtors through its advocate Saurabh Kulkarni said it had complied with
the NGT order.
He said a sewage has been connected to the BMC sewerage system and unless one
temple on the DP road is shifted final fire no objection certificate cannot be
granted, without which the Occupancy certificate (OC) is pending.
Developer also said residents are accepting “parking compensation in lieu of
parking space.’’
The NGT bench of Justice AK Goel, chairperson and Justices Sudhir Agarwal, DK
Singh, Prof A Senthil Vel and Dr Vijay Kulkarni on April 18, said the
developer’s stand of compliance “cannot be accepted’’ .
In April 2019, the NGT called for a joint panel of MPCB and State level impact
assessment authority to submit a compliance status report.
The report filed in July 2020 said 24 car parking spaces for rehabilitation
buildings are not earmarked by the developer.
Any work done so far after the NGT order would be “illegal” and joint committee
has pointed to “continuing non compliance.’’
