AFFIDAVIT OF ELIGIBILITY AND RELEASE I being duly sworn, depose and say: I am at least 18 years of age, am a legal resident of the United States and am not an employee of Ola Balola LLC or Lenovo Group Ltd. I am agreeing to the terms of this Affidavit to Ola Balola LLC (the “Sponsor”) with the understanding that it will be relied upon to determine whether I am entitled to receive the prize for which my entry has been selected in The Game Awards Lenovo Legion Go Sweepstakes (the “Sweepstakes”). As stated, I understand that the prize I won is one (1) Legion Go 512GB. The Approximate Retail Value (“ARV”) of the Prize is six hundred and ninety-nine and 99/100 dollars ($699.99). No cash equivalent for the prizes, the prizes are non-transferable and no substitution will be made except as provided herein at the Sponsor’s sole discretion. Sponsor reserves the right to substitute the listed prize for one of equal or greater value for any reason. Winner is responsible for all taxes, duties, and fees associated with prize receipt and/or use. All federal, state, and local tax liabilities, as well as any other costs and expenses not specified herein as being awarded are the sole responsibility of the Winner. Winner may be required to complete and return an IRS W-9 form (i.e. Request for Taxpayer Identification Number and Certification). Prize will be awarded only if the Winner fully complies with these Official Rules. I represent that I have fully complied with all of the Official Rules of the Sweepstakes. I have committed no fraud or deception in entering the Sweepstakes or claiming the Prize. I further represent that as of the date I entered this Sweepstakes and date of this Affidavit, I was an eligible entrant in the Sweepstakes. If any statement made by me in this Affidavit is false, then, in addition to any other remedies that may be taken against me, I agree that I will forfeit the prize. As provided in the Official Rules of the Sweepstakes, I hereby agree to be responsible for all federal, state and local taxes on the Prize. I hereby grant to Sponsor and its agents and assigns, without limitation in perpetuity, the right to use my name, image and likeness for purposes of advertising, publicity and trade in any medium without further compensation. As a condition of acceptance of the Prize, I hereby release, waive, discharge, absolve, agree to hold harmless and covenant not to sue Sponsor, Sync Marketing LLC, Lenovo Group Ltd., and their respective parents, subsidiaries, affiliates, suppliers, accounts, distributors, marketing agencies, promotional agencies, advertising agencies, successors, assigns and their respective directors, officers, employees, contractors, agents and representatives, from and for any and all actions, suits, claims and demands of any kind whatsoever (whether in law or equity), which I, my heirs, executors, administrators and assigns, had, now have or hereafter may have, by reason of any matter connected in any way with the Sweepstakes, including but not limited to the awarding of the Prize, any loss or damage to the Prize, any actions for personal injury, death or loss or damage to property in connection with the receipt and use of the Prize or while preparing for, participating in, and/or traveling to any prize-related activity, or any claims based on publicity rights, defamation, invasion of privacy or merchandise delivery.
