WHY HAVE I RECEIVED MAIL FROM COEO? Our client has provided you with goods or services against payment. As of yet, they have no record of having received payment and have therefore instructed coeo to collect this outstanding claim. Details of the client and the outstanding items in question can be found in the letter we sent to you. WHY AM I NOW TO MAKE PAYMENT TO COEO AND NOT TO THE CLIENT? Following instruction by our client, we are your sole contact partner in all matters relating to the outstanding claim. If a payment is made to the client, there is a risk that it will not be possible for this to be correctly allocated and therefore the collection measures will be continued. Furthermore, our client’s employees have been instructed to refer to us in the event of all queries. WHERE DO THE ADDITIONAL COSTS COME FROM? If a customer does not pay for goods already delivered or services already rendered even after a payment reminder, the company providing the service often hands over the case to a specialised collection service provider. According to Sections 280, 286 German Civil Code (Bürgerliches Gesetzbuch, BGB), however, it is entitled to claim these costs as damages from the debtor in addition to the original claim (main claim) and the statutory default interest up to the amount regulated in Section 4(5) Introductory Act to the Legal Services Act (Einführungsgesetz zum Rechtsdienstleistungsgesetz, RDGEG). The collection of this claim for damages is also part of the collection company's mandate. Therefore, your collection letter will show the main claim as well as the interest on arrears and the claim for damages (collection costs).
