NAR CALL FOR ACTION: PROTECT INDEPENDENT CONTRACTOR STATUS

The National Association of REALTORS® has launched a CALL FOR ACTION asking
Members of Congress to cosponsor H.R. 5419 the Direct Seller and Real Estate
Agent Harmonization Act, to ensure real estate agents maintain their independent
contractor status under the Fair Labor Standards Act (FLSA).

In California, 85% of real estate agents choose to do business as independent
contractors. C.A.R. successfully included provisions in state laws and
regulations, including AB 5, protecting REALTORS® ability to work as independent
contractors. At the federal level, the Internal Revenue Code carves out real
estate professionals who choose to work as independent contractors.
Unfortunately, the Department of Labor ignores these carve-outs in its Final
Rule on determining independent contractor or employee status. This has made the
rules unclear for how real estate agents can ensure they are doing business as
independent contractors.

H.R. 5419 will align the FLSA with the Internal Revenue Code to ensure real
estate professionals in California and nationwide can continue to operate their
businesses without uncertainty from conflicting statutes and regulations.

JULY 2024 FORMS UPDATE WEBINARS

REALTORS® must implement business practice changes resulting from the NAR
settlement in less than four weeks!

Make sure you’re ready for the August 17, 2024, deadline!

C.A.R. has prepared numerous resources to help members prepare for the changes.
Starting today, July 24, several new and revised standard forms are now
available in zipForm and other platforms. If you haven’t previewed them yet,
access them here.

To learn how to use these forms and prepare for the upcoming NAR settlement
practice changes, join C.A.R.’s legal staff for a live July 2024 Forms Update on

THE NEW CONCESSIONS IN PRICE FIELDS FUNCTION VERY DIFFERENTLY FROM PREVIOUS
OFFERS OF COMPENSATION
LET’S CLEAR UP SOME CONFUSION

Here is our complete (as of now) elaboration on what to expect with the new
concession fields that have just been added to the MLS and what it means for
when compensation fields go away in August.

Important Dates
On May 29, CRMLS introduced new entry fields to our MLS systems which we call
the Concessions in Price (CiP) fields. You can read more about them in our CiP
FAQ. In addition, starting August 13, following the settlement of the NAR
commissions lawsuit, new Rules and Policies updates will remove mentions of
compensation in the MLS. You can find more information in our Rules & Policy

The training must meet specific learning objectives and criteria established by
the National Association of REALTORS®. Training may be completed through NAR’s
online courses or through another method, such as online or classroom courses
