Access Credentials 4.1 Marsh has provided you with a confidential password and a login account (LOGIN-ID) that will permit access to this Site. Only Users who have proper authentication are permitted to access the documentation, data and information contained in this Site. Upon receiving such notice, Marsh and your employer company will respectively verify your identity and assign new access credentials to you within a reasonable period of time. Re-issuance and reactivation of access credentials is subject to Marsh's and your employer company's security and validation procedures. You will not receive new access credentials if you have violated, or allowed others to violate, Marsh's and your employer company's security or validation procedures. 6. Termination or cancellation of this Agreement shall not affect any right or relief to which Marsh may be entitled, at law or in equity. Sanctions and Export Controls. Use of this Site and this Agreement are expressly made subject to any economic or trade sanctions and export control laws, regulations, orders or other restrictions which may be imposed by the Government of the United States of America, the Government of Canada, and other applicable laws. Licence. User acquires no rights or licenses in or to the Services and materials contained therein other than the limited right to utilize the Services in accordance with the Agreement. 13. Governing Law. This Agreement shall be governed by and construed in accordance with the laws of the India Any dispute arising out of or relating to this Agreement shall be subject to the exclusive jurisdiction of the courts in India. 14. Severability. If any provision of this Agreement is found to be unlawful or unenforceable in any respect, the court shall reform such provision so as to render it enforceable (or, if it is not possible to reform such provision so as to make it enforceable, then delete such provision). As so reformed or modified, the court shall fully enforce this Agreement. 15. Entire Agreement. This Agreement constitutes the entire agreement between the parties, and no other agreement, written or oral, exists between you and Marsh as to your use of this Site. This Agreement is between you and Marsh. 16. Access Outside India. If you choose to access the Service from outside Singapore, you are responsible for compliance with foreign and local laws. Marsh does not provide insurance brokerage, third party administrator, or other services to governments, governmental agencies, other groups, individuals, or any of their agents which are subject to U.S. trade sanctions, including, without limitation, to the following Embargoed Persons: (i) governments, government agencies, businesses organized in, and nationals or residents of any embargoed governments or regimes or (ii) to anyone on the U.S. Treasury Department's Office of Foreign Asset Control's lists of Specially Designated Nationals, Specially Designated Global Terrorists, and Foreign Terrorist Organizations. Client Personal Information Collection Statement 1. It is often necessary for our current or prospective individual clients, or, where our clients are corporate or business entities, their individual representatives and employees (collectively referred to as "clients" and otherwise referred to as "client", "you" or "your") to provide to Marsh India Insurance Brokers Pvt Limited* (hereinafter referred to as "MARSH", "we", "our" or "us", and references to Marsh include the appropriate Marsh Affiliate(s)) personally identifiable data about yourselves ("Personal Information")in connection with our business process execution, including delivery of services and/or products, preparation of proposals, provision of quotations, arranging insurance cover, managing claims, client relationship management and conducting internal conflicts checks. Such Personal Information may include information or data provided by you or other parties or from other source, and may include, but is not limited to, historical or existing data and/or data to be collected in the future. MARSH may provide or disclose this Personal Information to its Affiliates for the purposes stated in paragraph 2 above. Collection and Disclosure 1. You acknowledge that you assume all the risks involved in using our online payment facility and we shall not be in any way liable for any damage, loss, expense or detriment caused (directly or indirectly) by a defect in the online payment facility purported to have been caused or caused by reason of your use of such online payment facility or for whatsoever reason. We shall be under no liability whatsoever in respect of any loss or damage arising directly or indirectly out of the decline of authorization for any Transaction or on Account of the Cardholder having exceeded the pre-set limit mutually agreed by us with our acquiring bank from time to time. CANCELLATION & REFUND POLICY Cancellation of the health check appointment once payment is made should be done by raising a request from our website by giving the Appointment ID and refund in such case will be made to the payee after deducting 3% of the transaction amount not exceeding Rs. 300/- (Rupees three hundred only). Please note that the refund process may take 10 working days from the date of appointment cancellation Cancellation of Pharmacy Order shall l not be accepted once you confirm the order on call.
