PRIVACY POLICY This “Privacy Policy” governs your use of the Tia (“Tia” or “Company” or “we” or “us”) websites and all features, tools, content, downloads and other services (“Services”) that we make available through those websites (collectively, referred to herein as the “Platform”). If we provide you notice of a different privacy policy for a different service, this Privacy Policy will not apply. This Privacy Policy also does not apply to information collected by us offline, or collected by any third party, including through any application or content (including advertising) that may link to or be accessible from or our websites. Tia is not a medical group or a health care provider. Tia contracts with affiliated medical groups (collectively defined as “Medical Groups”), to provide online telehealth, in person medical consultations and secure messaging between Medical Groups’ providers (each a “Provider” and collectively “Providers”) and their patients. Any telehealth consultations through the Platform are provided by independent medical practitioners in Medical Group. Medical Groups or Providers are responsible for providing you with a HIPAA Notice of Privacy Practices describing their collection and use of your health information. By using our Platform you consent to our Privacy Policy and our collection, use and sharing of your information and data, and other activities, as described below. If you do not agree to be bound by those terms, you are not authorized to access or use the Platform, and you must promptly exit the Platform. If we make any changes to our Privacy Policy, we will post the revised Privacy Policy and update the "Last updated" date of the Privacy Policy. Our Platform and Services are not intended for children under the age of 18. If you are under the age of 18, please do not access our Platform. If we learn that we have inadvertently collected personal information from someone under the age of 13, we will promptly delete that information. If you believe we have collected personal information from someone under the age of 13, please contact us using the contact information at the end of this privacy policy. 1. WHAT INFORMATION DOES THE PLATFORM COLLECT? On the Platform, we may ask you to provide certain categories of information such as: * Personally identifying information (such as your name, e-mail address, phone number, and billing and physical addresses (“PII”); * Your login, user ID, password, password hints, and similar security information use for authentication and account access; * Demographic data (such as your gender, date of birth and zip code (“Personal Demographic Information”)); * Information about your health (such as your medical history or information about your menstrual cycle) and information about the medications you are taking (such as your current and past birth control methods) (“Health Information”); * Your health insurance information; * Computer, mobile device and/or browser information (such as your IP address, mobile device ID information, operating system, language preferences, referring URLS, location, connection speed, bandwidth, browser type, referring/exist web pages, web page requests, cookie information, hardware attributes, software attributes); * Third-party website, network, platform, server and/or application information (such as Facebook, Twitter, Instagram); * Usage activity concerning your interactions with the Platform and/or third-party websites, networks or applications accessed through the Platform (such as viewing habits, viewing preferences, viewing history, number of clicks on a page or feature, amount of time spent on a page or feature, identity of third-party websites, networks, etc.); * Billing, payment and shipping information, such as credit card number, the security code associated with your payment instrument, purchase history, and invoices; * Electronic signatures; * Photographic or video images submitted for identification or non-diagnosis or treatment purposes; * Information about third parties that you refer to us (such as name, email, and/or other contact information, relationship); * Statements or content (such as comments, videos, photographs, images) and information about such statements or content, which you submit or publish on or through the Platform or which are accessed via your public or linked social media pages (e.g., Facebook, Twitter, Instagram); and * Any other information you provide when you contact or communicate with us including: 1) forms filled out by a user on the Platform; 2) information provided by a user in connection with any services offered on the Platform; and 3) surveys, polls, blogs and postings and submissions. “PII”, “Personal Demographic Information” and “Health Information” are referred to in this Privacy Policy as “Your Information.” HOW INFORMATION IS COLLECTED We might collect information directly from you when you use the Platform; when you register with or subscribe to the Services or obtain any products or services available through the Services; when you "sign in," "log in," or the like to the Platform; when you allow the Platform to access, upload, download, import or export content, or otherwise interact with your computer, mobile device, or any other device to visit, access or use the Platform or online accounts with third-party websites, networks, platforms, servers or applications (such as your online social media accounts, your cloud drives and servers, your mobile device service provider); or whenever we ask you for such information, for example, when you enter information through the Platform or when you answer an online survey or questionnaire. In addition, if you or a third party sends us a comment, message or other communication (for example, an email, letter, fax, phone call, or voice message) about you or your activities on or through the Platform, then we may collect that information. In addition to the information we collect directly from you, we may also collect certain information from health care providers. This information may include, but is not limited to, diagnoses, treatment plans (including prescription details) and notes. We may also receive information from third parties that pay for your care or provide you with treatment, laboratory care or prescription medication, such as your prescription history, insurance policy, insurance eligibility and coverage, and laboratory test results. Finally, we might use various tracking, data aggregation and/or data analysis technologies, such as cookies and web beacons. WHAT ARE COOKIES? * Cookies, which are small data files (such as text files) stored on the browser or device you use to view a website or message. Like regular cookies, Flash cookies may help store user preferences and activity, and may allow a website to recognize a particular browser or device. Flash cookies are not managed by the same browser settings that are used for regular cookies. * Web beacons, which are pieces of code embedded in a website or email to monitor your activity on the website or your opening of the email, and which can pass along information such as the IP address of the computer or device you use to view the website or open the email, the URL page on which the web beacon is located, the type of browser that was used to access the website, and previously set cookie values. Interest-based ads are ads presented to you based on your browsing behavior to provide you with ads more tailored to your interests. HOW WE USE COOKIES: * Meta Platforms. We use Meta platforms, such as Facebook and Instagram (collectively called “Meta”), for web analytics and advertising services. These services allow us to keep track of what users do after they see or click on a Meta advertisement, keep track of users who access our Platform or advertisements from different devices, and better provide advertisements to our target audiences. The data from Meta is also saved and processed by Meta. For example, in order for Tia to provide you with a list of gynecologists in your area, we may provide our third party service provider with your age, zip code, desired birth control method, and health insurance information. These third parties may retain any information used or provided in any such communications or other activities and these third parties’ practices are not subject to our Privacy Policy. We may not control or have access to your communications through these third parties. Further, when you use third-party apps or services, you are using their services and not our services and they, not we, are responsible for their practices. You should review the applicable third-party privacy policies before using such third-party tools on our Platform. California Do Not Track Disclosures Various third parties are developing or have developed signals or other mechanisms for the expression of consumer choice regarding the collection of information about an individual consumer’s online activities over time and across third-party web sites or online services (such as browser do not track signals). Currently, we do not monitor or take any action with respect to these signals or other mechanisms. 2. HOW DO WE PROTECT THE INFORMATION COLLECTED? We may de-identify your information and use, create and sell such de-identified information for any business or other purpose not prohibited by applicable law. 4. HOW AND WHEN DO WE DISCLOSE INFORMATION TO THIRD PARTIES? We may disclose your information to: * Our service providers (collectively “vendors”) to assist us with the activities outlined in Section 3, above; * Our vendors that provide services to enable us to provide the Platform, such as the hosting of the Platform, data analysis, IT services and infrastructure, customer service, e-mail delivery, and other similar services; * Our vendors that provide services to enable us to run our business and administrative operations, such as legal and financial advisory services, auditing services, analytics and similar services; * Our vendors that provide services to enable us to promote and advertise the Platform and the products and/or services offered via the Platform, such as advertising or ad-retargeting services, as well as to comply with contact removal requests or requirements, such as mailing list removal services, do not call registries, and similar services; * Pharmacies laboratories, and providers to enable them to provide services to you and to collect payment on their behalf; * Our vendors as we believe necessary or appropriate to comply with applicable laws; * Third parties in the event of any reorganization, merger, sale, joint venture, assignment, transfer, liquidation or other disposition of all or any portion of our business, assets or stock with such third party, or other corporate change, including, during the course of any due diligence process; * Third parties for administrative and Legal Reasons. DO THIRD-PARTY CONTENT, LINKS TO THIRD-PARTY APPS AND/OR THIRD-PARTY APPS APPEAR ON THE PLATFORM? The Platform may contain content, links or apps that are supplied by a third party“In addition, when you are on the Platform you may be directed to other websites and apps that are operated and controlled by third parties that we do not control. We are not responsible for the data collection and privacy practices employed by any of these third-party websites or apps. These third parties may have their own terms of service, privacy policies or other policies, and may ask you to agree to their policies. For example, if you “click” on a link, the “click” may take you off the Platform to a different location. Be sure to review third-party policies before submitting any personally identifiable information to a third-party website or app or otherwise interacting with it. 6. HOW DO I CHANGE MY INFORMATION AND COMMUNICATIONS PREFERENCES? You are responsible for maintaining the accuracy of the information you submit to us. If so, we will make good faith efforts to make requested changes in our active databases as soon as reasonably practicable (but we may retain prior information as business records). Please note that it is not always possible to completely remove or delete all of your information from our databases and that residual data may remain on backup media or for other reasons. We may need to retain certain personal information as permitted by law, such as to complete the transaction for which the personal information was collected, maintain an electronic medical record for a Medical Group or Provider, provide a requested good or service, detect security incidents, protect against malicious, deceptive, fraudulent or illegal activities, comply with legal obligations or to enable solely internal uses that are reasonably aligned with your expectations or lawful within the context in which you provided the information. We reserve the right to charge a reasonable fee where permitted by law, such as where your request is unfounded or excessive. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request. * Right to Opt-Out of Sale or Sharing. You have the right to opt-out of the sale or sharing of your personal information by us. While we do not sell your personal information, we do share a limited set of data with third parties in order to allow you to see tailored digital advertisements. California “Shine the Light” Law California Civil Code § 1798.83 permits California residents who have supplied personal information to request and obtain certain information regarding our disclosure, if any, of personal information to third parties for their direct marketing purposes.
