Storage Terms & Conditions 1. INTERPRETATION in these conditions: “Agreement” means this storage agreement, including any cover page or delivery terms and conditions. “Agreement” is given on arrival of onsite (this been any of the locations of the business) when the customer enters the property terms and conditions are located on our website and around our office or when arranging / conducting any business between either of these companies (DKM). 2. FEES / Payment: 2a: Both trading companies (DKM) have the right to refuse any questioning/offering for credit. This is also displayed around the office. 3a. every item on the premises will be charged storage this making the owner responsible for making Payment. 4a: All / any items been delivered onsite by courier or customer should make a member of staff from the company they are conducting business with (DKM) aware that the items are been delivered and therefore pay storage from the arrival date. Customer should also have permission from a member of staff at the business (DKM)to have their items delivered to the property before arranging / or arrival of the item. Without business (DKM) consent items can be refused to be onsite. Any deliveries made to either companies (DKM) address made outside of the opening hours for that company (DKM) will result in access been denied onto the premises/ delivery not been made. The staff member of the companies (DKM) do not have to wait back for deliveries to be made after closing or arrive earlier the customer should make arrangements for delivery with knowledge of the company opening and closing hours. The same terms apply for collection. Arrival Appointment should be made and within the opening and closing hours and days of the companies (DKM). 5a: All packages / property / vehicles / machinery ect been delivered to the premises should also be named of the owner. If the company (DKM) are not aware of the delivery been made or do not have any details for the customer of the item/property been delivered they have the right after 1 day of trying to source the owner to remove/ return / dispose of the item left without any customer claiming the item/property ect. The company (DKM) will not be held responsible for any charges of missed delivery / lost delivery or removal of delivery not claimed. 6a: The companies (DKM) have the right to remove/dispose any property/items found on the premises been stored without payment been received for storage. Failure to pay your storage fees will result in removal/disposal of any items on premises under this circumstance of fee not been paid. The companies (DKM) will not be responsible for any loss of expenses on these items if they have been removed through failure to pay. Companies (DKM) will attempt to contact the Customer to be made aware and asked to make payment. (Stated also on any invoice that payment is due within 24 hours) 7a: Items/property also will not be loaded / transported for other purposes agreed if storage settlement/fees have not been cleared/paid in full by the owner/customer prior to any further agreements of the item been proceeded. 8a: Any items/property/ possessions found onsite without the knowledge or consent to the companies (DKM) can also result in removal or disposal if the company (DKM)have not been made aware of the item/property is onsite without permission including failure to mention items been stored / storing items without permission to avoid storage fees from the companies (DKM). These items may/will be removed or disposed of and the company (DKM) will not be held responsible/accountable for any damages or loss of expenses to these items left without knowledge or permission from the company (DKM) 9a: All necessary accessories for property / vehicles / machinery that are needed for the item to work should be given to a company (DKM) member of staff. All motor / vehicle keys should be left in the vehicles. If the owner or customer should remove or misplace any important accessories IE: keys the companies (DKM) will not hold responsibility for any loss or damages to these items. If the customer should take these items with him/herself they are responsible for the disruption of important movement / delivery of the item failed to be made and are in responsibility to insure the companies (DKM) receives these keys.(if posting keys to the property they should be signed and tracked delivery services and the company (DKM) will not pay any customs or fees on any delivery items and the company (DKM) should be made aware of the delivery been made and customer should have consent to arrange delivery from a member of staff at the company (DKM) please see 4a for complete t and cs in regards to delivery) 10a: Furthering the above the companies (DKM) will not be held responsible or will not purchase or pay for any stolen/missing/broken accessories / parts /items on site they are all stored at owners own risk and loaded for delivery at owners own risk. The companies (DKM) do work accordingly in regards to keeping the premises and the customers items safe and secure with multiple security features in places to deter any theft or damages. 11a: If a customer is found causing damage /theft or disruption to other workers items the property any items stored / customers items they will be asked to leave the premises refused further future entry and will be held responsible to the expenses/ damages caused. Customer should not damage or wander around the yard removing parts/accessories of other customers items or companies’ property. 12a: All/ any customers items/ property /possessions found leaking or causing damage to the property or other stored the company (DKM) will attempt to contact the customer/owner to insure they are aware and be asked by the company (DKM) to remove or dispose of the item/items their self. If this should account in failure to receive contact or refusal the company (DKM) have the right to remove or dispose of the item and will not be held accountable for loss of expenses. The customer/owner will be held responsible for the damages made by their property/item or the cost of any item removal necessary. 13a: storage fees once agreed are non-negotiable / credit will not be given /payment is to be made in full. The companies (DKM) it is in there own decision to charge storage fees daily , weekly or monthly. STORAGE: 3: All items are stored on any company property registered for (DKM) at owners own risk. And the companies (DKM) are not responsible or to be held accountable for any item missing / not received or damaged. Owner/ customer should make themselves fully aware in understanding the terms and conditions of conducting business with the companies (DKM) before agreeing to business. 3b: All items need to be made aware to a member of staff at the company (DKM) that they are onsite and been stored on the property.(failure to do so will result in removal) This is to insure safety also of the property and the item to insured it is stored correctly and is not in any way a hazard. 4b: If any vehicle or machinery is not running accordingly for purpose of use the company (DKM) have the right to load or move around any item with a forklift or crane to load the item or move the item from A to B. 5b: The companies (DKM) have the right to move/shift/remove any stored item if it is causing disruption of work to our companies (DKM) or the other companies working on site. This is also necessary if a item is imposing a hazard to the property the workers or the surroundings. The companies have the right to move any item that is not running working according to use with a forklift or crane to aid in the movement of the item. This meaning cars that will not start or drive or machines / generators , trailers , tyres etc that are unable to be lifted or towed by hand. The companies (DKM) will not be held responsible for any damages if caused in movement as items should be working accordingly for use and is on the owners responsibility to insure they are indeed working correctly. 6b: Most sites these companies (DKM) work from will already share onsite yard space with other companies conducting business from that address. Items are not to be left by customers in any way that causes disruption to another business or the workers gaining access to onsite/in office/there vehicles or there property. 7b:If a possession/ item been stored by the customer is found been stored on the property over a period of time that was not agreed the companies (DKM) are allowed to remove or dispose of any of the property been stored incorrectly (weather this be unpaid storage/improper storage) 8b: All customers are required to carry out the removal and disposal of there own rubbish. IE: any items/possessions a customer has fetched onsite to any of the addresses the companies (DKM) are located at to be loaded into trucks/cars ect should be taken home or else where with the customer if they can not be located inside of the owners/customers truck/car ect. 9b:If these items are left behind IE: settees/cookers / tyres ect customers will still be charged storage whether it be waste or valuable possessions. 10b:If the companies (DKM) have to aid/organize removal of the items/waste the customer will be charged the cost of removal. This includes personal rubbish/bins onsite are not for customers use. 11b: If the company (DKM) have attempted to contact a customer/owner of property/possession in order to remove or move a item and they do not arrange/organize or fail to get in contact the company (DKM) will not be held responsible for the removal/disposal of the item or any damaged caused in movement. DELIVERY/LOADING: 4: All delivery arrangements are to be given notice to the companies (DKM) in advance to the delivery date needed. 5c: All items needed/wanting to be loaded should be already on loading site of (DKM) before loading is attempted any delays caused by missing items is at owners own fault. 6c: any items missed of loads due to items not been onsite or customers/owners changing loading instructions is only the owners/customers responsibility. 7c : The companies (DKM) will not be held responsible or accountable for any damages occurred during loading or delivery. Both loading and delivery is at owners own risk. The companies (DKM) do insure correct safety in loads been made and delivery been made with the correct loading equipment been available if needed. 8c: If a member of staff at the companies (DKM) contact the customer/owner with notice of delivery or loading been unsafe or not possible this is for our workers safety or customers safety. If he or she does not comply with the authorisation of the companies decision it can result in delivery/loading not been made. 9c: if a customer gives wrong measurements of items to be loaded and these items do not load correctly or accordingly with any damages or faults been made by this process it is at owners own responsibility. 10c: if load or truck/vehicle/machine is refused at port for any reason it is not the companies (DKM) or the drivers responsibly only the customers/ owners. 11c : the companies (DKM) will not be held responsible or accountable for any fees or any fees for storage if a load/items are refused or missed at port. 12c: Full payment of any item been delivered or loaded should be received to the company (DKM) issuing the invoice due for payment before proceeding to attempt delivery or loading. 13c: fees /invoicing pricing once agreed is non negotiable / the company (DKM) will not allow credit to any customer. 14c all customer shipping/exporting should insure there documents/paperwork needed by the vessel/port are completed correctly and are in responsibility of their own shipping/exporting arrangement. 15c: The companies (DKM) do not book or arrange any shipping and will not pay for customers shipping. 16c: failure to make payment for loading or delivery or storage already in process could result in loss of items to cover the cost of the fees applying owned by the customer in debt with the company (DKM). Safety onsite This applies for all sites DKM are conducting business from. All customer are advised to wear PPI these been located in our office or customer is required to fetch their own. Health and safety requirements are to be met and complied with at all times on visiting our sites. *Children under 16 not allowed on site* No climbing on loads or vehicles / cars/vehicles used by customers visiting are required to be in designating parking. No speeding onsite 5mp required for safety of workers and other visitors. No smoking onsite / no smoking in offices *These terms and conditions are stated for all and every customer conducting business with any of the companies (DKM) and will not alter or be negotiated. * It is of the customers own responsibility to read and comply with these terms and conditions. A written agreement is not needed for a customer to agree to these terms and conditions as they are on our website and socials / linked in with emails sent for the customer to insure his or hers own research.
