Official Rules

Karma Drive to Courtside Sweepstakes for Houston Rockets Home Games

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN THIS PROMOTION.

Sponsor.  The “Sponsor” of this promotion is Credit Karma, LLC, P.O. Box 30963,
Oakland, CA 94604. This promotion is in no way sponsored, endorsed or
administered by, or associated with a social media platform (including but not
limited to Facebook, Inc.).

Promotion Period. This promotion begins at 12:01 am Central Time (“CT”) on
Friday, February 17, 2023, and ends at 11:59 pm CT on Sunday, March 5, 2023 (the
“Promotion Period”). Sponsor’s computer is the official time-keeping device for
the promotion.

Eligibility. In order to be eligible, entrants must be (a) at least the age of
majority in their jurisdiction of residence; and (b) a legal resident of Texas
whose primary place of residence is within 150 miles of Houston, Texas.
Employees and immediate family members (spouses, parents, siblings, and children
and their respective spouses) of employees of the Sponsor, Rocket Ball, Ltd.
(“Houston Rockets”), the National Basketball Association (the “NBA”) and its
member teams, NBA Properties, Inc., and each of their respective parents,
subsidiaries, affiliates, directors, partners, officers, governors, employees,
and agents are not eligible to enter. VOID WHERE PROHIBITED AND OUTSIDE THE
PROMOTION AREA SET FORTH ABOVE.

How to Enter. During the Promotion Period, an entrant may enter using one of the
following two methods (limit one entry per person, regardless of method of
entry):

Enter by Enrolling in Karma Drive: To enter by enrolling in Karma Drive, you
must:

 * * * During the Promotion Period, an eligible entrant may enter this promotion
       by enrolling in Credit Karma’s Karma Drive experience, allowing location
       access permissions and allowing location sharing permissions. If entrant
       is not already a Credit Karma member, entrant will need to download the
       free Credit Karma app and follow the instructions to create an account
       before entrant can enroll in Karma Drive. Entrants will receive one
       Sweepstakes entry upon completing enrollment. Sponsor reserves the right
       to disqualify any entrant whose enrollment is incomplete, or otherwise
       not finalized by the end of the Promotion Period. Karma Drive subject to
       applicable terms and conditions.

Alternative Method of Entry:

 * * * During the Promotion Period, an eligible entrant may enter this promotion
       without enrolling in Credit Karma’s Karma Drive by sending an email to
       Sponsor at drivetocourtsidesweepstakes@creditkarma.com. The email entry
       must include: “Drive to Courtside Sweepstakes” in the subject line, the
       entrant’s complete name (no initials), a phone number where they can be
       reached, and city of residence. Email entries must be received by the end
       of the Promotion Period.

 

Conditions Applicable to All Entries. Any use of robotic, repetitive, automatic,
programmed, script, macro, or any other automated means or similar entry methods
or agents (including, but not limited to, contest-entry services or multiple or
different email addresses, identities, registrations, or logins) is prohibited
and will void all entries submitted by that entrant if discovered by Sponsor.
Entrants must use their own name. Sponsor reserves the right in its sole
discretion to disqualify any entry at any time that in Sponsor’s opinion does
not comply with these Official Rules. Sponsor is not responsible for lost,
incomplete, damaged, illegible, late, or misdirected entries, or for errors in
mechanical transmission, unavailability of phone lines or connections, cellular
phone service, or any other technical malfunctions or inability to transmit
messages or entries. Received entries become the property of Sponsor and will
not be returned or acknowledged.

Winner Selection, Notification, and Verification. After the close of the
Promotion Period, the winners will be selected by a random drawing from all
eligible entries received by Sponsor. Odds of winning depend on the number of
eligible entries. Sponsor will attempt to notify the potential winner in app, by
email, or by phone after the drawing. The potential winner must respond to the
initial notification attempt within five calendar days. Sponsor is not
responsible for lost, delayed, misdirected, or returned prize notifications.
Awarding of prize is subject to verification of eligibility and compliance with
these Official Rules. The potential winner may be asked to complete, sign, and
return the Affidavit of Eligibility, Waiver of Liability and Publicity Release
form and, if so, do so within five business days of the time Sponsor sends such
document to winner. By signing and returning an Affidavit of Eligibility, Waiver
of Liability, and Publicity Release, the winner agrees to be subject to a
personal background check. Winner’s guests (and parent or legal guardian of
guest who is a minor) may be required to sign and return release prior to
attending game with winner. All activity arising out of and relating to the
promotion, including any reference to an entrant’s status as a “winner,” is
subject to verification and/or auditing for compliance with the Official Rules,
and by participating in the promotion entrants agree to cooperate with Sponsor
concerning such verification and/or auditing. Potential winners also may be
required to complete and return certain tax documents. By entering or accepting
the prize, each winner consents to Sponsor’s use of their name, photograph,
likeness, voice, opinions, information, biographical information, hometown and
jurisdiction of residence for publicity and promotional purposes without further
compensation except where permitted by law. If a potential winner is not in
compliance with these Official Rules, if a potential winner does not respond
within five days of first notification attempt, if a prize notification or
attempted notification is returned as undeliverable, if a potential winner is
deemed ineligible for any reason, if a potential winner fails to sign and return
required documents and provide required identification by the deadlines
established by Sponsor, or if a potential winner declines prize offered, the
entrant forfeits the prize, and Sponsor will attempt to award the prize by
random drawing from remaining eligible, non-winning entries, time permitting.

Prizes.  There are seven prizes. Each prize is two courtside tickets to a
Houston Rockets home game during the 2022-23 regular season. The first winner
selected will receive tickets to the March 15, 2023 game against the L.A.
Lakers. The second winner selected will receive tickets to the March 17, 2023
game against the New Orleans Pelicans. The third winner selected will receive
tickets to the March 19, 2023 game against the New Orleans Pelicans. The fourth
winner selected will receive tickets to the March 20, 2023 game against the
Golden State Warriors. The fifth winner selected will receive tickets to the
March 31, 2023 game against the Detroit Pistons. The sixth winner selected will
receive tickets to the April 2, 2023 game against the L.A. Lakers. The seventh
winner selected will receive tickets to the April 4, 2023 game against the
Denver Nuggets. Location of courtside seats will be determined in Sponsor’s sole
discretion. The approximate retail value (“ARV”) of each prize is $5,000. The
total ARV of all prizes is $35,000.  Tickets are subject to terms and conditions
thereon and are subject to all NBA rules, regulations, guidelines, policies and
restrictions and to the same rules and regulations as regularly sold tickets. If
game is canceled or postponed, Sponsor will award a prize of equal or greater
value. Guest who is a minor must be accompanied by parent or legal guardian at
all times. In order to use the tickets, winner will be required to download the
free Rockets app. Winner and guests may also be required to comply with
Rockets/Toyota Center COVID-19 protocols, and failure to do so may result in
denial of admittance to game.

 

No substitution, assignment or transfer of the prize is permitted, except by
Sponsor, which has the right to substitute the prize with another of comparable
or greater value. Sponsor will not replace lost or stolen prize. The winner is
responsible for all taxes associated with the receipt of the prize. Please be
aware that taxes may be substantial. Winner is also responsible for all expenses
such as transportation and other expenses that are not expressly provided for
herein. All properly claimed prizes will be awarded, but in no event will more
than the stated number of prizes be awarded. If production, technical,
programming, or any other reasons cause more than the stated number of prizes as
set forth in these Official Rules to be available and/or claimed, Sponsor
reserves the right to award only the stated number of prizes by a random drawing
among all legitimate, unawarded, eligible prize claims.

Conditions of Participation. By submitting an entry for this promotion, you
agree to abide by these Official Rules and any decision Sponsor makes regarding
this promotion, which Sponsor will make in its sole discretion. Sponsor reserves
the right to correct typographical, printing, or clerical errors in any
promotion-related materials and to make other changes that do not materially
affect the substance of the Official Rules. Sponsor reserves the right to
prohibit any entrant from participating in the promotion if, at its sole
discretion, Sponsor finds such entrant to be tampering with the entry process or
the operation of the promotion, or if such entrant shows a disregard for, or
attempts to circumvent, these Official Rules, or acts: (a) in a manner the
Sponsor determines to be not fair or equitable; (b) in an annoying, threatening,
or harassing manner; or (c) in any other disruptive manner. If a dispute arises
regarding compliance with these Official Rules, Sponsor may consider, in its
sole discretion, data reasonably available to Sponsor through information
technology systems in Sponsor’s control, but Sponsor shall not be obligated to
consider any data or other information collected from any other source. Neither
the failure of Sponsor to insist upon or enforce strict performance of any
provision of these Official Rules nor the failure, delay, or omission by Sponsor
in exercising any right with respect to any term of these Official Rules, will
be construed as a waiver or relinquishment to any extent of Sponsor’s right to
assert or rely upon any such provision or right in that or any other instance.
If there is any conflict between any term of these Official Rules and any of the
entry or marketing materials used in connection with the promotion, the terms of
these Official Rules will govern.

Disclaimer, Release and Limit of Liability. SPONSOR MAKES NO REPRESENTATIONS OR
WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, REGARDING ANY PRIZE OR YOUR
PARTICIPATION IN THE PROMOTION. BY ENTERING THE PROMOTION, EACH ENTRANT AGREES
TO RELEASE AND HOLD HARMLESS ROCKET BALL, LTD. D/B/A THE HOUSTON ROCKETS, THE
NBA AND ITS MEMBER TEAMS, CLUTCH CITY SPORTS & ENTERTAINMENT, L.P., NBA
PROPERTIES, INC.,  FACEBOOK, INC., INSTAGRAM, TWITTER,  SPONSOR, AND THEIR
PARENTS, SUBSIDIARIES, AFFILIATES, PARTNERS, SUPPLIERS, DISTRIBUTORS,
ADVERTISING AGENCIES, PROMOTION AGENCIES, FRANCHISEES, AND PRIZE SUPPLIERS, AND
EACH SUCH COMPANY’S OFFICERS, DIRECTORS, EMPLOYEES, GOVERNORS, SHAREHOLDERS,
REPRESENTATIVES, RELATED PERSONS, AND AGENTS (COLLECTIVELY, THE “RELEASED
PARTIES”) FROM AND AGAINST ANY CLAIM OR CAUSE OF ACTION, INCLUDING, BUT NOT
LIMITED TO, PERSONAL INJURY, DEATH, OR DAMAGE TO OR LOSS OF PROPERTY, ARISING
OUT OF PARTICIPATION IN THE PROMOTION OR RECEIPT OR USE OR MISUSE OF ANY PRIZE.
THE RELEASED PARTIES ARE NOT RESPONSIBLE FOR: (1) ANY INCORRECT OR INACCURATE
INFORMATION,WHETHER CAUSED BY ENTRANTS, PRINTING ERRORS, OR BY ANY OF THE
EQUIPMENT OR PROGRAMMING ASSOCIATED WITH OR USED IN THE PROMOTION; (2) TECHNICAL
FAILURES OF ANY KIND, INCLUDING, BUT NOT LIMITED TO MALFUNCTIONS, INTERRUPTIONS,
OR DISCONNECTIONS IN PHONE LINES OR NETWORK HARDWARE OR SOFTWARE; (3)
UNAUTHORIZED HUMAN INTERVENTION IN ANY PART OF THE ENTRY PROCESS OR THE
PROMOTION; (4) TECHNICAL OR HUMAN ERROR THAT MAY OCCUR IN THE ADMINISTRATION OF
THE PROMOTION OR THE PROCESSING OF ENTRIES; OR (5) ANY INJURY OR DAMAGE TO

OF ANY PRIZE. If for any reason an entrant’s entry is confirmed to have been
erroneously deleted, lost, or otherwise destroyed or corrupted, entrant’s sole
remedy is another entry in the promotion, if possible. If for any reason, this
promotion is not capable of running as planned, including infection by computer
virus, tampering, fraud, technical failure, or any other cause that corrupts or
threatens the administration, security, or integrity of the promotion, Sponsor
reserves the right, in its sole discretion, to terminate or suspend the
promotion. If Sponsor terminates the promotion, it will determine the winners by
random drawing from among all eligible, non-suspect entries received as of the
termination of the promotion, if it is possible to do so. If Sponsor terminates
or modifies the promotion, Sponsor will post notice on the official promotion
website.

Privacy and Use of Promotion Information. Sponsor collects personal information
from you when you enter this promotion. Sponsor reserves the right to use any
information collected in accordance with its privacy policy, which may be found
at https://www.intuit.com/privacy/statement/

GOVERNING LAW AND DISPUTES.  ANY CONTROVERSY OR CLAIM ARISING OUT OF, OR
RELATING TO, THESE OFFICIAL RULES AND THE PROMOTION (“CLAIM”) IS GOVERNED BY
THIS SECTION, AND WILL BE CONSTRUED IN ACCORDANCE WITH, THE LAWS OF THE STATE OF
CALIFORNIA, AND THE FORUM AND VENUE FOR ANY DISPUTE WILL BE IN THE COUNTY OF SAN
FRANCISCO, CALIFORNIA. IF THE CLAIM IS NOT OTHERWISE RESOLVED THROUGH DIRECT
DISCUSSIONS OR MEDIATION, IT MUST THEN BE RESOLVED BY FINAL AND BINDING
ARBITRATION ADMINISTERED BY JUDICIAL ARBITRATION AND MEDIATION SERVICES, INC.,
IN ACCORDANCE WITH ITS STREAMLINED ARBITRATION RULES AND PROCEDURES OR
SUBSEQUENT VERSIONS THEREOF (“JAMS RULES”). THE JAMS RULES FOR SELECTION OF AN
ARBITRATOR MUST BE FOLLOWED, EXCEPT THAT THE ARBITRATOR MUST BE EXPERIENCED AND
LICENSED TO PRACTICE LAW IN CALIFORNIA. Any Claim will be arbitrated on an
individual basis and may not be consolidated in any arbitration with any claim
or controversy of any other party or in any form of class action. THE REMEDY FOR
ANY CLAIM WILL BE LIMITED TO ACTUAL DAMAGES, AND IN NO EVENT WILL ANY PARTY BE
ENTITLED TO RECOVER PUNITIVE, EXEMPLARY, CONSEQUENTIAL, OR INCIDENTAL DAMAGES,
INCLUDING ATTORNEYS’ FEES OR OTHER SUCH RELATED COSTS OF BRINGING A CLAIM, OR TO
RESCIND THIS AGREEMENT OR SEEK INJUNCTIVE OR ANY OTHER EQUITABLE RELIEF. Some
jurisdictions do not allow for limitations on the ability to pursue class action
remedies, or certain kinds of damages, and so these limitations may not apply to
you.

FORCE MAJEURE. The Released Parties shall not be responsible for the failure or
interruption of any website, webpage, social media platform, or mobile
application mentioned herein, any email server, or the cancellation or
postponement of a Houston Rockets game or any drawing for any reason including,
but not limited to, equipment failure or malfunction, electrical service
interruption, or any act of God. In addition, in the event that Sponsor is
prevented from continuing with the Sweepstakes by any event beyond its control,
including, but not limited to, fire, epidemic, flood, hurricane, earthquake,
explosion, labor dispute or strike, act of God or public enemy, communications
or equipment failure, utility or service interruptions, riot or civil
disturbance, terrorist threat or activity, war (declared or undeclared),
interference with the Sweepstakes by any party, or any federal state or local
government law, order, or regulation, order of any court or jurisdiction, or
other cause not reasonably within the control of Sponsor, Sponsor shall have the
right to modify, suspend or terminate the Sweepstakes.

List of Winners. For the names of the winners (first name and last initial),
send an email with “Drive To Courtside Sweepstakes Winner List Request” in the
subject line to winnername-request@creditkarma.com, to be received within 60
days of the end of the Promotion Period.
