אנו רואים במחאה נגד הרפורמה מפקדי משטרה שמתחבקים עם מפגינים. מי בעצם הריבון פה?
לדברי נצ"מ בדימוס אבי וייס, "אנו נמצאים בכאוס שלטוני שלא התחיל הבוקר". על פי
החוק, המשטרה כפופה לממשלה, ותפקידה לדאוג לסדר – "זכותם של אנשים לנוע בכבישים
עולה על הזכות להפגין, כך אמר בזמנו נשיא בית המשפט העליון אהרון ברק".
כמו כן, יש שני חוקים הקובעים מפורשות שאסור לשוטרים להזדהות עם המפגינים ולמתוח
ביקורת על הממשלה.

וייס מבהיר כי לא חלה על המשטרה חובה לציית לבתי המשפט – אפילו אם בג"ץ יוציא צו
מעצר נגד נתניהו בשל התערבותו ברפורמה, אין לאף שוטר סמכות ליישם זאת. אין שום סעיף
שנותן סמכות לבית המשפט או ליועמ"שית להתערב בניגודי העניינים של נתניהו.

עוד מתייחס וייס להודעתו של עו"ד בעז בן צור, המייצג את נתניהו בתיק 4000, על כך
שלא ייצג אותו עד להפסקת החקיקה. וייס מדגיש כי "עו"ד אינו יכול לסחוט את הלקוח
שלו, וגם לו ימצא תחליף".

בסיום הראיון עלה עניין "חוק ההתנתקות", אך לנוכח המצב עולה השאלה – האם באמת יש גב
למתיישבים? וייס סבור כי יישום החוקים תלוי במשילות, שאותה יש לפתור. עם זאת הוא
אופטימי: "יש היום מספיק ח"כים ומספיק כח ציבורי להחזרת המשילות – אך זה לא יקרה
ביום אחד, ויידרש תהליך עומק שילווה את הממשלה לאורך כל הקדנציה".

היסטוריה אישית מספקת ומספיקה. אני 25 שנה עצמאי ואין לי כל כוונה לשנות את הסטטוס
