On Friday, 13 September 2019, the NSW Government published the Workers Compensation Amendment (Pre-injury Average Weekly Earnings) Regulation 2019 (PDF, 0.2 MB)(external link). It states that, for injuries sustained on or after 21 October 2019, the employer and worker have the option of agreeing on the PIAWE amount to be used for determining the worker's weekly compensation payments. While PIAWE agreements aren’t mandatory, they can be a useful way to fast track weekly payments and help injured workers to focus on recovery and return to work. If you do not enter into an agreement, your agent will calculate PIAWE in accordance with the legislation and make a work capacity decision.
