Mandatory e-Filing for Attorneys

Effective February 1, 2020, attorneys are required to make all filings with the
Michigan Supreme Court and Michigan Court of Appeals electronically using the
MiFILE system unless excused by court order upon a motion for good cause.

The plaintiffs filed suit in the Court of Claims, challenging the
constitutionality of several provisions of 2018 PA 608, which changed the
procedures for citizen-circulated petitions. The challenged provisions include
the requirement that no more than 15% of the petition signatures could come from
any one congressional district, the requirement that the petitions include
checkboxes to indicate whether the petition circulator was a paid or volunteer
signature gatherer, and that paid signature gatherers must sign an affidavit
acknowledging their paid status before they could circulate a petition.  The
Supreme Court issued its majority and several partial concurring-partial
dissenting opinions on January 24, 2022, without hearing arguments in the case.

SUPREME COURT ORDER DENYING THE COMPLAINT

 

164090, 164120 RAISE THE WAGE MI V BOARD OF STATE CANVASSERS

No. 164090 is a bypass application filed with the Michigan Supreme Court that
challenges certain adverse decisions by the Board of State Canvassers regarding
the signature petitions for a ballot initiative to raise the minimum wage in
Michigan.  After the Court of Appeals dismissed the action in that court on
jurisdictional grounds, the plaintiff filed a verified complaint and supporting
brief as an original action in the Supreme Court.  That action was assigned a
different docket number, 164120.
