WHAT TO CONSIDER WHEN BUILDING A GARDEN GAZEBO

In most cases, you will not require planning permission for a gazebo. There are
three main factors to consider when looking to install a gazebo, in terms of
whether you will require planning permission or not:

 1. If the structure is less than 2.5m in height from the existing ground level
 2. If the installation is less than 2m from the property boundary
 3. Gazebos and outbuildings should not be closer to the road or public walkway
    than the original house itself.
    

If your oak framed garden, patio or deck gazebo meets the above criteria, you
typically should not need to apply for planning permission.




INSTALLING A GAZEBO WITHOUT PLANNING PERMISSION

If you install a temporary garden gazebo (up for less than 28 days), you will
not require planning permission for any structure. If you are looking to install
a permanent gazebo, you will need to ensure that the size, measured externally,
does not exceed 3 metres in height. Your gazebo must also have no plans to be
used for sleeping accommodation.

You will also need to ensure that your gazebo is located within 2m of your
property boundary or public highway. Your property’s legal boundary is usually a
line, fence or marking which divides one property from another.




WHEN DOES A GAZEBO REQUIRE PLANNING PERMISSION?

If your gazebo installation exceeds more than 3m by height and is within 2m of a
neighbour, you will need to seek permission before continuing. If more than 50%
of your garden land is already inhabited by garden buildings such as sheds,
summerhouses, pergolas etc, you will need planning permission before
constructing a new building. In most cases, you will be asked to remove one of
your existing garden buildings before you can install your gazebo.




LISTED BUILDING AND DESIGNATED LAND CONSENT

If you are looking to install an oak gazebo onto the land of a listed building –
structures that have been judged as a List of Buildings of Special Architectural
or Historical Interest – you will need to speak to your local council and will
most likely require planning permission.

If your property is located on designated land; national parks, World Heritage
Sites or conservation areas, you will also require planning permission and will
need to contact your local council. If you are not in a conservation area, you
will need to keep the floor dimensions under 10m² or apply for permission. If
your building is located in a conservation area, planning permission will be
required in all circumstances.
In most circumstances, for one-storey gazebos, you will not require planning
permission. If your gazebo plan does require planning permission, this does not
mean that you will be rejected, or that you cannot build a gazebo, it simply
means that you will need your property inspected and your plans reviewed by your
