You also agree to not open multiple accounts in order to bypass any restrictions or misuse the TasteWP affiliate program. 3. Membership: It is possible to look through our site without becoming a member, but becoming a member is easy and free! Enrollment can be done quickly and easily on our website. During registration, we will ask you for information that is necessary to get the most out of your membership. This information may include the following: your name, address, email address (required). Our collection and use of this information is governed by our Privacy Policy, available here. 4. Membership benefits: Membership is free. As a member, you can set custom names for your test WordPress sites, change the PHP versions, earn non-expiring sites, and more. 5. Non-transferrable: Membership is personal to you and not transferrable. 6. Keep your login information confidential!: When you sign up for a membership, you will be asked to select a password. It is your sole responsibility to maintain the confidentiality of your login information you may use to sign up for your membership. You agree not to use the membership, username, or password of another member at any time or to disclose your password to any third party. You are solely responsible for any and all use of your membership; unauthorized use of your membership may result in you losing work progress and/or access to your account. As described further below, TasteWP.com is not responsible for any of these losses when you have allowed your membership to be accessed by a third party, intentionally or otherwise. 3. Intellectual Property (IP) 1. We don’t own the content on the TasteWP.com sites: TasteWP provides a hosting platform where users can upload codes, software and other content; hence, the TasteWP users are responsible for all uploaded material, and we cannot be held responsible with respect to it. 2. TasteWP.com property: While we don’t own WordPress or its plugins and themes, we do own all the content which we put on the platform, including texts, design, copyright, trademarks and other content you find on TasteWP.com not provided by our users or WordPress. You are not permitted to copy, modify, translate, publish, broadcast, transmit, distribute, perform, display, or sell any of such content owned by us. 3. As a TasteWP user, you may not post, modify, distribute, or reproduce in any way any copyrighted material, trademarks, or other proprietary information belonging to others on TasteWP without obtaining the prior written consent of the owner of such proprietary rights. It is the policy of TasteWP to terminate membership privileges of any member who repeatedly infringes the copyright rights of others upon receipt of prompt notification to TasteWP by the copyright owner or the copyright owner's legal agent. 4. If you or any user of this site believes its copyright, trademark or other property rights have been infringed by a posting on any TasteWP website or property, you or the user should notify us via our contact form and send a notification to our Designated Agent immediately. To be effective, the notification must include: 1. Identify in sufficient detail the proprietary work that you believe has been infringed upon or other information sufficient to specify the copyrighted work being infringed). 2. Identify the material that you claim is infringing the proprietary work listed in item #1 above. 3. TasteWP.com reserves the right to investigate and take appropriate legal action against anyone who, in TasteWP.com's sole discretion, violates this provision, including without limitation, reporting you to law enforcement authorities. Prohibited activity includes, but is not limited to: * criminal or tortious activity, including child pornography, fraud, trafficking in obscene material, drug dealing, gambling, harassment, stalking, spamming, spimming, phishing, sending of viruses or other harmful files, copyright infringement, patent infringement, or theft of trade secrets; * advertising to, or solicitation of, any Member to buy or sell any products or services through the TasteWP.com Services unless explicitly allowed in selected areas (“advertising section”); * covering or obscuring the banner advertisements on your personal profile page, or any TasteWP.com page via HTML/CSS or any other means; * any automated use of the system, such as using scripts to send messages; * interfering with, disrupting, or creating an undue burden on the TasteWP.com Services or the networks or services connected to the TasteWP.com Services; * attempting to impersonate another Member or person; * using the account, username, or password of another Member at any time or disclosing your password to any third party or permitting any third party to access your account; * selling or otherwise transferring your profile; * using any information obtained from the TasteWP.com Services in order to harass, abuse, or harm another person; * displaying an advertisement on your profile, or accepting payment or anything of value from a third person in exchange for your performing any commercial activity on or through the TasteWP.com Services on behalf of that person, such as placing commercial content on your profile, posting blogs or bulletins with a commercial purpose, selecting a profile with a commercial purpose, or using the TasteWP.com Services in a manner inconsistent with any and all applicable laws and regulations. If you find any fraudulent activity, such as misrepresentation or phishing attempts, or material that infringes copyrights, please report it to our team by email to hi [at] tastewp [dot] com so we can promptly remove such content and take further action if necessary. 5. Payments and refund policy 1. TasteWP is offering premium features available to users which can be used upon the test site creation or from the user’s TasteWP Dashboard section from which expiring sites can be converted to premium sites. Users have the option to set up payment agreements with Sellcodes.com, our payment provider, allowing TasteWP to charge again once the monthly/yearly payment period has passed, as defined by the user. You can cancel your premium subscriptions anytime via your Sellcodes Account page, in which case you will not be charged once your current premium plan expires. 2. We reserve the right to modify our fee schedule at any time upon thirty (days) written notice by posting such fee rates on our pricing/premium page. 3. As a company policy, we do not issue refunds. Therefore, please consider carefully if you want to use our service before you make a purchase. Due to the free tier, you can get a perfect idea of what the functions will do which will be accessible after you become a premium user. If anything is not clear, please contact us. We'll respond within 24 hours. 6. Limitations on Liability & Indemnification 1. TasteWP.com is provided to our users “AS IS” or, to put it another way, “AS AVAILABLE.” As such, we do not make promises or make any warranties as to the suitability or quality of the content available on TasteWP.com or the products offered on TasteWP.com and hereby exclude, to the furthest extent permitted by law, all implied warranties in the same respect (including but not limited to warranties of non-infringement, merchantability, and fitness for a particular or specific purpose). The limitations on liability and indemnification in these Terms are a part of the bargain between the parties. 2. Your access to and use of TasteWP.com is your decision solely, and at your discretion and risk. We are under no obligation to make TasteWP.com available to you on any particular platform, and the platform we choose to offer TasteWP.com on may change. 3. We cannot make any promises that you will always be able to access the information here (that includes but is not limited to accessing any test site and content created). 4. To the extent permitted by applicable law, we (including our affiliates, our agents and employees) are not liable (which means you will not hold us responsible) for any damages or losses resulting directly or indirectly from, inter alia, content on TasteWP.com; access limitations or delayed availability on TasteWP.com; unauthorized access to and/or manipulation disputes or disagreements between users; failure of TasteWP.com to authorize an account or TasteWP.com decision to close or suspend membership or a license offering; any conduct or failure to act by any of our third-party service providers (including but not limited to Sellcodes.com) unless the damages or losses result directly from intentional conduct by TasteWP.com; viruses or other malicious software that is a result of accessing TasteWP.com, downloading the codes, opening any email or in your exchanges; any access of your account that is unauthorized by the Company. As the websites hosted on TasteWP are managed by its users, and not TasteWP, we cannot guarantee that they adhere to these Terms. As a visitor or member, you use the TasteWP services, which includes browsing and interacting with the sites on TasteWP, at your own risk and to your own responsibility. Although TasteWP has systems in place to prevent and ban unpermitted content, we have no obligation to monitor, validate, correct, or update users’ sites’ content in any way. If you have a dispute with another user on TasteWP.com, you agree to release us (and our agents and employees) from claims, demands and damages (both consequential and actual) of every kind and nature, known and unknown, arising out of or in any way connected with such disputes.
