Santa Clara County appears to be backing off a pledge to ditch plans to build a
new jail for a mental health center, citing the need to improve its crumbling
jail and inhumane conditions faced by inmates.

Supervisors unanimously accepted a report in January from County Executive Jeff
Smith and Deputy Executive Martha Wapenski that did not eliminate the
possibility of building a new jail in Santa Clara County. Smith said delaying
plans to build a new jail would be unconscionable.

“It borders on deliberate indifference,” he said.

That revelation is a stark difference from what county supervisors said in
November when they unanimously voted to halt the process of building a new jail.
Instead, they decided at the time, the county should explore building a mental
health center.

But building a mental health center instead of a jail would take years of
planning, Smith said, while more than 2,000 inmates are still living in the
county’s failing facilities at Main Jail North and Elmwood Correctional
Facility. This would “condemn” current inmates to deplorable living conditions,
he said.

Smith added a new behavioral health facility isn’t the solution for everyone,
citing previous experience in Contra Costa County, where he oversaw the county’s
jail and juvenile hall health facilities.

“Having practiced medicine at one of these (mental health) facilities, I can
tell you it’s not a pleasant place to be,” Smith said. “And it’s certainly not
an appropriate place for most of the inmates that we house right now.”

Facing this new opposition from the county’s top executive, supervisors now are
split on how to move forward.

“The proposed work plan (from the county executive) is not aligned with the
board’s prior direction regarding construction of a new jail and exploration of
other alternatives,” said Supervisor Susan Ellenberg.

But some lawmakers have changed their minds and now say the county needs a new
jail — regardless of other mental health facilities it builds.

“I feel pretty sure that two years, five years and 10 years from now, we’re
going to need a jail,” said Supervisor Joe Simitian at a January meeting.
Simitian acknowledged some inmates need a place for mental health treatment that
is “humane and effective.”

Ellenberg told San José Spotlight she’s open to ideas, too, but she’s heard a
resounding call from residents and criminal justice reform advocates to
reimagine the proposed jail.

“I have heard numerous times from community advocates and partner
(organizations) and families that we serve,” Ellenberg said. “(They say) the new
jail, as it was initially conceived, may no longer be appropriate to serve the
needs of the community.”

Supervisors in November directed county officials to look at Los Angeles
County’s decision to stop jail construction in favor of a mental health hospital
for inmates, and determine if Santa Clara County had enough mental health
workers to run a similar facility.

But Santa Clara County faces another obstacle — a 2018 court settlement after
the county faced allegations of overusing solitary confinement and inadequate
medical care at its jails. The settlement bound the county to make improvements
to living conditions for inmates.

It’s unclear why county leaders opted to scrap plans to build a new jail,
despite the legal obligations from the settlement.

The County Counsel’s Office told San José Spotlight that its office and
plaintiffs’ attorneys are in frequent communication and that “the consent
decrees and remedial plans remain unchanged, and their implementation is
ongoing.”

Advocates criticized the county’s reversal on the issue.

“The (Jan. 26) report does not include the data supervisors requested…” said
Leslie Zieger, a volunteer with Sacred Heart’s racial justice advocacy group.
“Instead, it presents a jail by another name. There are still no answers to the
questions about how many people in the jails are experiencing mental illness and
what services they need.”

Supervisor Cindy Chavez, who had previously been vocal about jail alternatives,
said she’s open to ideas from her colleagues, including building two separate
facilities or a new jail with a mental health unit inside.

Chavez served on the county’s Blue Ribbon Commission to improve custody
conditions after the 2016 murder of Michael Tyree, an inmate with mental health
issues, in a county jail.

“(There is) a very sincere openness from the board for what is the best way to
address public safety,” Chavez said. “That really is what we’re talking about —
public safety — doing it in a way that’s humane and really addresses
recidivism.”

Supervisor Mike Wasserman suggested building a new jail while using the Elmwood
facility as a mental health rehabilitation center.

Last year, then-Supervisor Dave Cortese was a driving force against building a
new jail. Cortese now serves as a state senator in District 15, which includes
most of Santa Clara County.

Cortese’s successor, Supervisor Otto Lee, tried to walk the line between his
colleagues.

“Maybe at the end of the day we are building two things,” Lee said.

But county administrators reiterated the deplorable conditions at the current
jail need to be addressed first.

“I don’t think anybody ever thought that Elmwood (Correctional Complex) and Main
Jail North were going to continue as they are forever,” Smith said. “As a matter
of fact, if I could blow them up today, I would.”

     Stop coddling dirt bag criminals. It is ridiculously easy to not end up in
     jail. The criminal justice reform that is needed is to make jails somewhere
     you really don’t want to go, not make them nicer. It’s mostly just gang
     banger waste of air trash that ends up in jail anyway.

     Minneapolis Defund the Police Results
     
     Minneapolis will spend $6.4 million to hire more police officers after
     spiking violent crime in 2020, the city council voted Friday.

     638 officers available to protect the 425,000-person city, down 200
     officers from 2019
     
     More than 400 people in Minneapolis were shot in 2020 – a five-year high
     
     There were 82 homicides in 2020…
     
     In 2019, there were 48 homicides.
     
     Early 2021 crime statistics show a 250% increase in gunshot victims
     compared to the same period one-year-ago. Rape is up 22% and robbery is up
     59% compared to last year.
     
     “The city recorded 5,422 violent crime incidents, including homicides,
     rapes, robberies and aggravated assaults, according to preliminary year-end
     Minneapolis police statistics. That is a dramatic jump over the previous
     five years, which averaged roughly 4,496 such crimes. Property crime saw a
     more modest 10% increase.”
     
     Interesting to note, violent crime growth was more than double property
     crime, so this isn’t about poverty and feeding your kids, its more about
     lawlessness and senseless violence.

     anyway , dangerous individuals included Crime all phases continues to grow
     at rapid rate here thank you for all that you are doing victims of crime a
     day are more then covid cases, that another issue so… sure Hell use it for
     homeless?? they keep coming in from all over the cities counties state ..
     because we house them and Buiold it!!!! they do what they want….. … keep
     giving it away monterey highway and parts of san jose even became New Dumps
     sites Fantastic … So thank you for that too … sammy trhe mayor .. san jose

     Supervisor Ellenberg. Please stop listening to these tiny yet vocal
     pressure groups and face the reality that we need prisons and jails.
     
     And, the more permissive we are with low level crimes and quality of life
     crimes, the more violent and serious crimes will increase.
     
     No bail and sanctuary county rules will cost lives. Just think back to
     Bambi Larson’s death. She wasn’t the first and she won’t be the last person
     to die because of your obsession was “equity“.
     
     “ Supervisor Susan Ellenberg in a statement. “Santa Clara County has long
     been a shining example of open and progressive thought, diversity and
     inclusion for the state of California and the nation.”
     
     The above quote says it all. Please stop focusing on being the leader on
     progressive thought and start focusing on protecting people that live in
     Santa Clara county, which is your primary job. Please stop the virtue
     signaling and start working to Improve the quality of life in Santa Clara
     County.

     Is ashamed that County of Santa Clara allows so much violence tours disable
     people and one of there own county employee of 21 years . li am aware this
     is not the place to say but when the system has labeled me as 5150 and
     mental .
     My civil rights been violated as well my 4th amendment with violation of
     Public corruption abuse of power tax payers money. USC 18 241 242 .
     I been mistreated by numerous of county employees in my community district
     6 sjpd per previous chief not taken seriously 19 complaints as victim of
     crime 230 all due to workers compensation asserting my rights although is
     not the investigators of workers comp is
     Valley medical center with an illegal medical human experiment I. Been
     arrested and beat under handcuffs by an officer , I been chased I been
     apprehended with batons I been bullied I been assault and battery it caused
     a divorce of 28 years together 31 all due to retaliation constant
     intimidation all my concerns weren’t taken seriously but placed on
     administrative leave with pay pending on 3rd party evaluation so this way I
     would be mental condition so the system could place me in a facility to say
     I need medication that would cause a adverse reaction and tell society
     commit suicide which I will never. Will so when you hear people are
     criminals then what yo I call county mgt
     I always said society kills not the police . unfortunately I am a genie pig
     another story as Tania Mccash tead her story she was killed by the system
     and criminal charges dropped basically I have a microchip illegal implant
     and done by County so yes I do agree county needs new jail system and as
     well a garage to protect those who are sjpd and county employees the future
     is going to be microchip did illegal implants. Protection is more important
     than money evil act . as an active employee still no pay since 7/31/20
     county wants me to retire and sign my rights not to sue . sos I need lawter
     for civil rights employment got the right to sue EEOC and unethical human
     experiment. #7 toy again my apologize let my story be told don’t judge
     mental people until you have walked there stepping stones

     This is a terrible idea because criminals exist, and prisons are necessary.
     
     I do agree that anyone with severe mental illness should have an
     opportunity to seek treatment at Mental Health Center/facility. The County
     has completely failed in terms of what their Behavioral Health Department
     is intended to do – a complete failure.
     
     Also, go look at the massive and I mean MASSIVE encampment near the County
     building – it is growing by the hour. Literally, someone built what looks
     like a log cabin.
     
     San Jose, and generally, California, is such a mess.

       The Victims Program failed me 8 times I went and the supervisor didn’t
       take my complaints seriously. Due to an officer telling them not to take
       me serious when iT was said in front of a close friend about me. The
       system picks who they want and as a Mexican I find this as a hate crime
       tours me .

     Dear Community,
     
     It will be much easier and a better use of Tax Dollars to put the New Jail
     in another location.
     
     It cost to much to Demolish and rebuild on the same sight.
     
     I suggest that the New Jail be built elsewhere.
     
     That location should be easily accessible by Freeway and Bus Lines. So
     visits are in and out(Attorney or Related).
     
     The Tax Dollars saved could be used to repurchase the old Jail and bring
     new County Offices to the Government Center.
     
     That way the County can save money on rentals.
     
     The Building can be repurposed with new everything and still save Taxpayers
     money by lowering other fees and Rental charges.
     
     Being in the Construction Industry for thirty years, you do nothing but
     waste money tearing down and rebuilding on the same site.
     
     You would basically have a blank canvas to restart the user’s in the
     building.
     
     Electric, Water, HVAC, Communication, all a blank Canvas.
     
     That is my opinion.

     Where would you suggest that this new jail be built? What area would make
     it easiest for relatives to visit using public transportation or even walk
     or bicycle to the jail?

     The county definitely needs an alternative to just a jail that deals with
     legal issues it does need a mental health facility.
     I’ve worked in corrections for more than 20 years as a medical professional
     and I can testify that most of the persons incarcerated have some sort of
     mental health issues which lead to criminal behaviors.
     There is no treatment in jail or even after they leave jail , no continuity
     of care .
     In a city with more than a million people we only have about 10 County
     detox beds .EPS ,Emergency Psychiatric Services trie to help but they treat
     them -street them with little follow up when discharged .
     I’m sure if the county prioritized it’s goals & resources they could work
     on a much needed mental health facility to test all who need it .
     They Ned to be proactive because it’s only going to get worse for those who
     suffer from mental health issues !!

       For clueless Sue Ellenberg, show me a mental health facility that can
       treat dangerous and violent persons that have a propensity to engage in
       criminal activity, and I will show you a jail.
       
       All of the people that Sue claims to have heard from are only
       pro-criminal advocates who want to replace incarceration with release,
       defund the police, and reimagine the jail as not being a jail.
       
       The thousands of victims of crime and all other taxpayers who work hard
       to get by in this area, want crime to go down, and criminals to be
       properly sentenced, and serve their sentence for their crimes. To do
       anything else will only turn this place in SF-South.
