Even though the judge was sympathetic and agreed that the HVNL was overly complex and the logbook examples were confusing, Ballantyne was still fined the maximum penalty. It is imperative to count time correctly and that you have systems in place to stop situations like the Ballantyne case, from occurring in your business. - Supreme Court of South Australia Ballantyne vs National Heavy Vehicle Regulator 2019 IN THE CASE OF BALLANTYNE V NHVR BECAUSE HE DIDN'T UNDERSTAND FINED $15K What started out as an intent to keep budgets on track and operators safe from just tapping a few buttons, has led to a much simpler way of doing business and reducing stress levels. People make better decisions and are better to be around when they’re not as stressed. We knew that if we could reduce stress from the industry then we could also increase safety and productivity. This means that if you are driving a regulated heavy vehicle, you need to consider where you are travelling too before you start the vehicle. Think - will this travel take me outside my 100 km Radius? This also means that you will need to record the odometer reading at the start of each day just in case. Check - your odometer and record it so I don’t have to work it out later. WHEN DO I HAVE TO RECORD TRAVEL? Rest time is all time that is not work time.
