DIANNE FEINSTEIN LEAVES BEHIND A LONG AND COMPLICATED LGBTQ+ LEGACY

U.S. Senator Dianne Feinstein died Thursday, September 28, at her Washington,
D.C. home. She was 90 years old, and left behind a storied and complicated
political legacy spanning more than four decades.

Feinstein’s chief of staff James Sauls confirmed her death in an official
statement Friday morning. “Senator Feinstein never backed down from a fight for
what was just and right,” Sauls wrote. “At the same time, she was always willing
to work with anyone, even those she disagreed with, if it meant bettering the
lives of Californians or the betterment of our nation.”

Feinstein began her political career in 1969 as a member of the San Francisco
Board of Supervisors, where she served until the fateful murders of Mayor George
Moscone and LGBTQ+ rights pioneer Harvey Milk, then city supervisor, in 1978.
Feinstein — who had herself been targeted for assassination in preceding years
by the far-left group New World Liberation Front — was the first person to find
Milk’s body, feeling for a pulse through one of the slain supervisor’s bullet
wounds.



After taking Moscone’s place as mayor of San Francisco, Feinstein transitioned
into national politics in 1992 when she was elected to the U.S. Senate, inching
out Barbara Boxer as the chamber’s first female Jewish member by a matter of
weeks. She would hold that seat for the rest of her life, and ultimately became
the longest-serving female senator in U.S. history.



Over time, Feinstein established a reputation as a moderate Democrat on most
issues, and became known for supporting LGBTQ+ causes, specifically gay
marriage.

“Senator Feinstein’s passing is a loss for us all,” Human Rights Campaign
President Kelley Robinson said in a statement Friday, adding that the senator
“was a fearless champion for equality, tireless fighter for justice, and paved
the way for a new generation of women in leadership.” Joe Hollendoner, CEO of
the Los Angeles LGBT Center, memorialized Feinstein for “championing LGBTQ+
rights as an early supporter of same-sex marriage and a lead sponsor on the
Respect For Marriage Act,” which passed into law last year.



But Feinstein’s full record on LGBTQ+ issues, like many other facets of her
political legacy, is more complex. While Feinstein was one of few senators to
oppose the Defense of Marriage Act (DOMA) in 1996, she vetoed a 1982 measure
during her tenure as San Francisco mayor that would have extended domestic
partnership benefits to the live-in partners of gay and lesbian city employees.

According to a 1984 profile in People, Feinstein was “respected rather than
loved by gays”; she appointed more than a dozen “avowed homosexuals” to city
positions, the profile noted, but also authorized police to infiltrate
bathhouses to arrest queer men who were suspected of spreading AIDS. In 2005,
the San Francisco Lesbian, Gay, Bisexual, Transgender Pride Committee awarded
Feinstein the ignominious “Pink Brick Award” for saying gay marriage activists
“energize[d] a very conservative vote” in reelecting then-President George W.
Bush. (Feinstein herself did support gay marriage rights before and after those
comments; in 2015, after the Supreme Court declared same-sex unions
constitutional in the 2015 Obergefell decision, Feinstein declared she “could
not be more thrilled” and called the fight for LGBTQ+ rights “one of the
defining civil rights issues of our time.”)

It's the latest in an uptick of anti-LGBTQ+ activism in California this year.

Since 2020, critics from both the political left and right had called for
Feinstein to resign, as concerns mounted over her deteriorating health. Last
year, the New York Times reported that Feinstein struggled to remember meetings,
calls, and some of the names of her colleagues, even missing dozens of votes as
a result, a “state of befuddlement” that was for years an open D.C. secret. And
while she remained one of the Senate’s most visible liberals, Feinstein
increasingly came under fire for resisting progressive initiatives on issues
like climate change, infamously dismissing youth activists who urged her to vote
for a 2019 Green New Deal proposal because “I know what I’m doing” and ushering
them “back to whoever sent you here.”

Feinstein’s death inarguably leaves a vacuum in U.S. and California politics;
although the senator had already announced she would not seek reelection in
2024, it remains to be seen who will fill her Senate role until then. California
Gov. Gavin Newsom — whose own recent record on LGBTQ+ legislation has been
uneven — told Meet the Press earlier this month that he would honor his promise
to appoint a Black woman to Feinstein’s interim seat if necessary, but ruled out
Rep. Barbara Lee, who is running for the seat in 2024. Lee responded on X,
formerly Twitter, that she was “troubled” by Newsom’s remarks.

“The idea that a Black woman should be appointed only as a caretaker to simply
check a box is insulting to countless Black women across this country who have
carried the Democratic Party to victory election after election,” Lee wrote.
