A mum who was caught drink-driving after an argument with her partner has been
slapped with a 'sobriety tag' to help curb her drinking.

Kerry Green, 39, had been drinking wine at home when her partner of 16 years
went out to watch a football match following a business trip and was out longer
than expected, a court heard.

After he returned, she got in her car to go and see a friend but was pulled over
at 1.30am after officers on patrol spotted her driving with no headlights on in
the dark and almost colliding with lampposts as she swerved over the road.

Her 'eyes were glazed and her speech was slurred' as she spoke to the officers,
the court was told. Two breath samples showed she was around four times the
legal drink-drive limit but Green was unable to complete a full breath test
procedure and she kicked out at a police officer as she was being searched.

The mother of two from Macclesfield, Cheshire, later claimed her partner, an
engineer who inspects potentially hazardous workplaces, regularly went away on
business and she had to spend ''an awful lot of time at home alone'' with their
children aged 12 and 14.



At South Cheshire Magistrates Court, Green, a former bistro assistant, admitted
failing to provide a breath sample and assaulting a PC and was banned from
driving for three years. She was also ordered to wear a 'sobriety tag' for four
months to help curb her drinking.

According to the government website, these electronic tags take a sample of the
wearer’s sweat every 30 minutes and provide a 'continuous record of whether the
offender has been drinking.' If the tag detects alcohol or is tampered with, an
alert is sent to the Probation Service.


GREEN SEEN 'SWERVING CAR ALL OVER THE ROAD'

Clare Oliver, prosecuting, told the court: “This matter goes back to just after
1.30am on January 15 on Park Green in Macclesfield. Police officers saw a
vehicle being driven erratically. There were no lights on and it was swerving to
the side of the road.

“It nearly hit a number of items of street furniture. Fortunately, nothing
appears to have been hit but the vehicle was stopped. The defendant was sitting
in the driver’s seat. There was a strong smell of intoxicants, her eyes were
glazed and her speech was slurred.

“The defendant blew 136 at the roadside. Following this, she was arrested,
cautioned, and taken to the custody suite for the drink-drive procedure. When
being searched she lifted her right leg and kicked out at a PC Nanchollis.

"The defendant's foot connected with the officer's right shin causing pain and
discomfort. In the custody suite, she provided one of two required evidential
samples. The sample was 152 in breath but there was no second sample provided.

“She was interviewed the following afternoon. She said she had been drinking
with a friend and had two and a half glasses of wine and then went to drive to
another friend for a chat and got arrested.

"She remembered getting angry when being searched but did not remember hitting
out.” The drink-drive limit is 35 micrograms of alcohol in 100 milliliters of
breath.

Stuart Flood, mitigating on behalf of Green said: “She is highly embarrassed and
ashamed about these events. There are no previous matters recorded against her
and there is nothing on her driving licence either. This is the first time she
has ever come to the attention of the authorities.

“It is a serious matter. There was a high level of impairment in terms of
driving and she was driving without lights in the early hours. I think she
assumed the lights would come on automatically. Thankfully there were no further
incidents.

“Whether it was a deliberate refusal, she clearly cooperated at the roadside and
then because of the reading she was then taken to custody where she clearly
cooperated for one reading. Whether reality set in or she was highly agitated as
she is asthmatic. I do not think it was a deliberate refusal but she failed to
provide.

“Being taken to the police station for the first time in your life can be very
traumatic. Having said that, this was a very high reading and clearly, she was
heavily intoxicated and clearly seriously impaired, added to that she kicked the
officer.

"I think that was a reaction to being arrested. She got upset and kicked out at
the shin and that is something she bitterly regrets."


'SHE HAS AN AWFUL LOT OF TIME ALONE'

Mr Flood said that Green's partner of 16 years regularly works away and that she
looks after their two children aged 12 and 14.

"She has an awful lot of time alone," the solicitor said, “He had been away but
had returned and had gone to watch a football match in Manchester. He went in
the morning and came back later.

"She starts to drink in the evening and that has led to an argument between
them. She felt she had spent very little time with her partner in the last
fortnight and did not expect him to be out as long as he was.

“She stupidly got in her car to see a friend, to break away from the tension in
the house. She had booked a taxi but the taxi did not arrive and she made the
extremely grave decision to drive. It was a massive mistake. CIearly, it could
have led to more serious consequences.

“She acknowledges that it was an extremely high reading and she is going to be
off the road for a long period of time.

"She has two children to look after on a regular basis and also with her mother
she cares for her grandmother who has had a very nasty fall. I think this is
very much an isolated incident.”

A probation report about Green read at the hearing said: “She said she is a
social drinker usually on weekends. She is remorseful, her partner works and she
is the sole carer for the children while he is away. She is at low risk of
re-offending.”

Green, of Peter Street, Macclesfield was also sentenced to 200 hours of unpaid
work, made subject to 120 days of the alcohol abstinence monitoring programme,
and ordered to participate with up to ten days of rehabilitation with the
probation service.

She was also ordered to pay £50 in compensation to the PC Nanchollis and made to
pay £224 in costs and a victim surcharge.
