He has been charged with two counts of DWI causing death to human or unborn child; two counts of homicide - negligent manslaughter by vehicle killing of human being or unborn child; two counts of DWI damage to property or person of another; and two moving traffic violations for reckless driving causing damage to person or property; but at least he wasn’t drinking under age, or buying for somebody younger than 21 who drinks alcoholic beverages responsibly, and that is what matters to the hate-mongering bogots at so-called Mothers Against Drunk Driving. At 0:05 CDT on Sunday, 6 April 2008, they were riding in a Mazda 626 on the Interstate 10 Service Road at west of LA Hwy 3246 in East Baton Rouge Parish, Louisiana, returning from the movies. A Toyota Pickup truck, traveling at a high rate of speed, crashed into the rear of the Mazda 626. The impact forced the Mazda to rotate and rollover several times prior to coming to rest in a ditch to the right of the road. The Toyota continued east, exited the roadway to the left and stopped in a ditch on the left side of the road. The driver of the Toyota, Mr. Chris Michael Bourgeois (Male/Age 56) of Peachtree, GA, was not injured and refused medical attention. He was placed under arrest and booked into the East Baton Rouge Parish Jail. Virtua Health paramedics pronounced the Nissan driver dead at the scene. Investigators say the Chrysler driver was driving without her headlights on, driving drunk (0.188% BAC), driving west in the eastbound lanes and driving faster than 90 miles per hour, but at least she wasn’t drinking under age or buying for somebody younger than 21 who drinks alcohol responsibly, and that is what matters to MADD. The drunk driver also died. He was driving drunk, reportedly about 0.22% BAC, and going the wrong way on the interstate, but at least he wasn’t drinking under age or buying for anybody and that is what matters to MADD. He was in his 2008 Chevrolet Silverado pickup truck, waiting at a stop sign at the Exit 1 on-ramp of Interstate 89 on Logging Hill Road in Bow, New Hampshire on 30 April 2018 at 21:21 local time, when a drunk (0.16% BAC) driver, age 35, with two prior DWI’s, drove a 2017 Nissan Altima into him at 60 miles per hour (96 km/h), killing him 61 days short of his 21st birthday. The New Hampshire drinking age was raised from 18 to 20 on 24 May 1979. It was raised again on 1 June 1985 to 21. They still did not have an open container law. It was still lawful to drink alcoholic beverages while driving, if you were 21 or older, but unlawful to drink alcoholic beverages responsibly if you were younger than 21. It wasn’t until 16 August 2021 that Governor Sununu signed a bill allowing judges to mete out longer prison sentences to killers with prior DWI’s. The defendant pled guilty to aggravated drunk driving, but the vehicular homicide charge was dropped on a technicality because her lawyer wouldn't be able to cross-examine the doctor who performed the autopsy, because he no longer worked for the agency. Had prosecutors moved more quickly this might not have happened, but authorities obviously do not prioritize getting inebriated drivers off the road. They’d rather dedicate resources to enforcing underage drinking laws. Tragedy has sticken your family, and now your own past DWI crimes are haunting you. You are desperately trying to convince yourself that those crimes are not your fault, but the fault of a society that failed to stop you from drinking alcoholic beverages when you were younger. You want to convince yourself that you did not know any better, despite the thorough coverage in driver ed, or that you had no choice about it. You are trying to convince yourself that the solution is to stop persons born during the past 21 years from exercising their right to drink alcoholic beverages. Drunk driving crimes are no excuse to impose the drinking age on somebody who did not commit any of those crimes. Naming other crimes the person never committed is equally absurd. If crime statistics go up after the slaves are emancipated, should they be enslaved again? By the way, abolitionists met a lot of crazy persons who offered reasoning every bit as absurd as yours. What you really hate is that every day, millions of outvoted discrimination victims all across the United States of America responsibly exercise their right to drink alcoholic beverages. So why did you get behind the wheel when you shouldn’t have? What right to drink alcoholic beverages, you ask. The right to liberty is not a gift from the government, doled out at the discretion of politicians. Some persons call liberty a natural right that inheres in the individual. Other persons say that liberty is a God-given right. It makes no difference whether God, or a godless nature, makes the tide rise. Either way, the tide rises. It makes no difference whether God, or a godless nature, gives humans the right to be free. Either way, liberty is an unalienable right which no government can justly infringe. Unalienable rights, by definition, preempt the Rule of Law whenever the two things conflict with each other. This is why the government never had any right to impose restrictions on alcoholic beverages, even when Prohibition was in force under the 18th Amendment to the U.S. Constitution. Governments cannot acquire authority by manufacturing documents. Liberty is the freedom to do whatever does not violate anybody’s rights. Any other definition is meaningless. The right to do as you wish as long as you obey any laws the government enacts, is no more than the right to do as you are told. Liberty is not the freedom to put other persons in danger. Imposing a danger on other persons violates their right to safety. However, the underage drinker does not put other persons in danger by drinking alcoholic beverages. The inebriated driver puts persons in danger by operating a vehicle he or she is too clumsy to handle safely. If you put one bullet into a revolver, spin and put it to somebody’s head, and you pull the trigger, it is random whether you will kill the person. The person has a right not to be put in such danger. When you drive over the top of a hill, it is random whether the driver ahead of you will be stopped to let oncoming traffic pass before turning left. If you are going too fast or if you have had too much alcohol to drink, you won’t be able to stop in time. That is why the government has a right to punish a drunk driver, even if the drunk driver did not crash. That does not extend to a right to punish persons younger than 21 who drink alcoholic beverages responsibly. On 7 November 1978, a Michigan referendum on raising the drinking age from 18 to 21 passed with 57% of the vote. What good is the right to vote if you’re outnumbered by hypocrites who would rather do this to you than impose tougher DWI laws on themselves? It’s not like they’re voting on changing the State flag of Mississippi, or shortening the name of the State of Rhode Island and Providence Plantations to State of Rhode Island. Those referenda passed in 2020, and did not involve violating anybody’s rights. Some supporters of this unforgivable hate crime might even convince themselves that if they simply vomit forth their absurd excuses, the outvoted victims will be okay with it, even as some victims resort to counterfeiting the official identification documents of the hostile government, with all the pride of Underground Railroad workers counterfeiting birth certificates so escaped slaves can pass themselves off as free; and even as some victims even flee the country, especially during Spring Break, for the sole purpose of drinking alcoholic beverages where enemy officers cannot touch them. The typical supporter of the drinking age law is telling a state senator to vote for tougher penalties for underage drinking, to save lives on the road; meanwhile driving 40 miles per hour in a 30 mile-per-hour zone, unbuckled, talking on the telephone. They only care about traffic safety when it is an excuse to violate Mr. and Mrs. Twenty’s right to liberty. Some of the punishment for fatal DWI crashes is taken away from that criminal and meted out to other persons who drive drunk, because they put innocent persons in danger. When you extend that to meting out some of the punishment to innocent persons younger than 21 who drink alcoholic beverages responsibly, so much punishment is taken away from the guilty killers that you get cases like this. Note that the drunk driver could have gotten a ride. What are persons younger than 21 who drink alcoholic beverages responsibly supposed to get, a time machine? You cannot deter somebody from being younger than 21. Look over the chessboard for moves that will reduce the bloodshed on the roads, without violating anybody’s rights. If you are against alcoholism, tell your elected representatives to let you specify, when signing an organ donor paper, that no lifelong teetotaler will have to die waiting for a liver transplant while your liver goes to a drunkard who chose to destroy original equipment. If Dad gets drunk instead of bringing his child to the school play that evening, he is a creep, and family members and friends need to discuss this with him, not wield gun-toting goons in bulletproof vests to enforce alcoholic beverage restrictions on everybody. It would also help if society stopped levying war on pedestrians. If they have money for a street, they have money for a sidewalk. If they have money to plow the street, they have money to plow the sidewalk, instead of plowing snow onto the sidewalk and leaving it there, to make way for persons in cars, persons who matter. If they have money for traffic lights, they have money for crosswalk lights. Did you know that when the traffic lights are flashing late at night, the crosswalk lights don’t work? Pushing the button does nothing. Many folks never knew that because, after a night of heavy drinking, they never walk home, they always drive. At some corners, a person walking is lucky to find a painted crosswalk, but when a freight train crosses the street, lights flash, bells clang and gates drop, to protect the lives of persons in cars, persons who matter. Many local bureaucrats see the world through a windshield, and they see nothing wrong with designating certain parts of town for residential buildings, other sections for commercial or industrial use. They put distances between homes and work, shopping and drinking. In a free country, there would be no such restrictions. In a free country, anybody could buy any house on the market and open a saloon. There would be no licensing laws. Patrons could walk home. Bureaucrats review a site plan and are stumped. Where is the parking lot? You cannot build without a parking lot. Typically, for 10 apartments, they force you to add 17 spaces. The potholes do not give a fire truck about how this robs families that have better things to do with their money than participate in somebody else’s love affair with the automobile, just as you do not give a fire truck about the rights of persons born during the past 21 years to drink the beverage of their choice. In a free country, there would be no requirement to add a parking lot. More folks would take the bus. Zoning restrictions intentionally limit population density, which means fewer persons waiting at each bus stop. Abolish zoning and bus companies will have more riders, allowing them to extend their hours and their routes. More teenagers would be able to find jobs without owning cars, which does not sit well with MADD’s sponsors in the automobile industry. MADD is helping automakers get teenagers addicted to driving. Do you understand how that addiction compels defendants to drive under suspension? MADD members, of all people, know how it is because they hear the stories of persons under suspension who cannot find a way to the courthouse to report to their probation officer. So great is the hardship that lawmakers in some States put convicted drunk drivers into an assigned risk pool for insurance when they get their license reinstated. The premiums are high but not enough to cover the exposure, so it would be unfair if one insurance underwriter got more than its share of them. This means good drivers are forced to subsidize drunk drivers. It is especially harsh to rob persons younger than 21 this way while punishing the ones who drink alcoholic beverages legally. The war on walkers oppresses a lot of persons. Some do not wish to spend all that money on a car, and local bureaucrats have no right to punish them for that. Some persons with various handicaps cannot drive. Some of the elderly folks really should not drive, but they are pressured to do so anyway. Alcohol and driving don’t mix, but that does not mean you have a right to force somebody else to choose driving. Note that persons 21 years and older are free to buy all the booze they want, and even present their driver license when buying it, but when they cause a DWI crash they are forbidden to drink alcoholic beverages and forbidden to drive. Figure that out. Attitudes also play a role. When you finally manage to earn a paycheck without owning a car, you might find that bank is closed, but the drive-up window is still open, for persons in automobiles, persons who matter. Try explaining that your truck won’t fit under the canopy and the teller might serve you, believing you are somebody with a vehicle, somebody that matters. Most motorists would never lean on the horn and scream profanities at the person up ahead who signals a left turn and stops to let oncoming traffic pass, unless of course the person is on a bicycle. When you gave your victim impact statement, the drunk driver might very well have wanted to say, “Look, if they didn’t want me driving drunk, they shouldn’t have put the nearest bar so far from my house. What am I supposed to do, blow fifty dollars round trip every night on taxi fares? Are you going to pay for it?” Maybe you feel the person shouldn’t be getting drunk every night, but that does not entitle you to impose outrageous burdens on the person’s right to liberty. In a free country, the individual would decide whether to drink water, wine, or turpentine.
