Personal Information We Collect When you use our services, we, or vendors acting on our behalf, may collect your personal information, which is any information that can be used to identify you directly or indirectly through combination with other information about you. This generally happens in one of three ways – you provide us with personal information, we collect personal information through automated methods, or we collect personal information from other sources. Personal Information You Provide to Us You may share certain personal information when you interact with us. For instance, when you create a MyWendy’s account or call our Customer Care line, you may give us personal information about yourself and your experience with Wendy’s. For example, you may provide: * Personal identifiers, such as your name, address, phone number, email address, date of birth, payment card information, and other personal characteristics * Purchase details, such as your favorite Wendy’s order or location and your purchase history * Information about your restaurant visit or a transaction when you call Customer Care, chat with us, use your MyWendy’s account, or interact with us on social media Personal Information Collected Through Automated Methods When you use our services, our technology has the ability to collect certain types of personal information. For example, when you use the Wendy’s mobile app to place an order, depending on your device’s location settings and your choices, we may use your location to determine which restaurant is closest to you to help you place your order from the right restaurant. We, as well as certain vendors we work with (including those that provide content and other functionality for Wendy’s services) may use cookies, web beacons, and other similar tracking technologies, and the information collected from such technologies, as part of our services. We also may collect: * Information about your online interactions with us, such as IP address, device identifiers, device advertising identifiers, mobile network, operating system details, language preferences, referring URLs, length of visits, anonymous traffic data, pages viewed, browsing history, search history, and information regarding interactions with our services or advertisements * Geolocation data such as real-time information about the precise or approximate location of your device (GPS and network-based) * Voice recordings or chat transcripts when you interact with our Customer Care team or chat with us Personal Information From Other Sources Sometimes we get personal information about you from other companies. For instance, we work with vendors who help us understand and use the information we collect. Some of these vendors may give us information about you from other sources to help us verify or improve the personal information we have about you. Additionally, when you mention Wendy’s or interact with us through social media, we may collect information related to your posts about or interactions with us. Wendy’s services also offer social networking sign-on services that allow you to use social networking credentials (for example, your Apple, Facebook, or Google login) to access our services. Compiling Personal Information We may combine certain personal information we collect with information we obtain about you from others, such as social media sites or data brokers. This information helps us understand your online activities over time and across different services, which gives us a better idea of the profile of a Wendy’s customer and helps us improve our services. For instance, we may combine information from various sources to help us give you more personalized experiences or offers that reflect your preferences and interests. 2. How We Use Your Personal Information We use the personal information we collect for various purposes – including providing you with our services, improving our operations, generating analytics to understand our customers, and preventing fraud and maintaining legal compliance – all of which help us learn about how our customers interact with Wendy’s services and provide you with a better Wendy’s experience. Our vendors, such as our marketing and advertising partners, may use, store, or access data from cookies, web beacons, and other storage technologies used on our services and elsewhere on the Internet. The information collected is used to understand how people interact with our advertising and to provide our marketing and advertising to potential customers, which may include targeted advertising. For instance, we may use your personal information to: * Personalize your experience by providing content on our services * Inform our marketing practices * Deliver content relevant to your interests, including targeted advertising * Improve our products and services * Assess promotional effectiveness * Administer surveys, rewards, and promotions We may also use third-party web analytics services, such Google Analytics, to help us understand and analyze how visitors use our services. We use this information, for example, to implement Google advertising features such as remarketing with analytics, interest-based advertising, demographics and interests reporting, user segment analysis, and impression reporting. For more information on how Google Analytics uses data collected through the Wendy’s services, visit www.google.com/policies/privacy/partners/. To Prevent Fraud and For Other Legal Purposes We may use any personal information to prevent, detect, and investigate fraud, security breaches, and prohibited or illegal acts; enforce our company’s policies and procedures, including this privacy policy and our Terms and Conditions; or otherwise comply with laws and regulations applicable to us. 3. How We Share Your Personal Information We may share your personal information with other entities in our corporate family, our franchisees, vendors acting on our behalf, and governmental agencies or other public authorities. Wendy’s Corporate Family We may share your personal information with our corporate family, including our affiliates, for a variety of purposes, including to: * Provide joint content and mutually provided services * Help prevent, detect, and investigate fraud, security breaches, and prohibited or illegal acts and enforce our company’s policies and procedures * Assist with decision-making affecting company products and services Franchisees While this privacy policy does not apply to personal information processed solely by our franchisees on their own behalf in connection with restaurants, websites, or applications they own and independently operate, we do share information with our franchisees to ensure you have a seamless experience. Vendors Acting on Wendy’s Behalf We may share your personal information with vendors who help with our business operations, such as fraud investigations, bill collection, payment processing, gift card support, analytics, operations, and delivery of marketing communications. Data obtained through SMS short code program will not be shared with any third parties for their marketing purposes. Government and Law Enforcement We may share your personal information with governmental agencies, law enforcement, public authorities, or other authorized parties in response to any activity that may expose us, you, or any other party to legal liability or when otherwise reasonably requested. Business Transactions We may share your personal information in connection with, or during negotiations of, any proposed or actual merger, purchase, sale, or other type of acquisition or business combination of all or a portion of our assets, including the transfer of all or a portion of our business to another company. Others We may disclose your personal information to other parties at your request, if you consent to such disclosure, or if such disclosure is otherwise legally permitted. 4. Your Privacy Choices When it comes to your personal information, you have choices. Depending on your state of residence, you may have additional rights regarding our use of your personal information, as explained in the state-specific sections in this privacy policy. Changing Your Personal Information If you have a MyWendy’s account, you may review, update, and change the personal information you provide to us at any time by accessing your account settings. You may also exercise your privacy rights, detailed in Sections 10 and 11 below, by submitting a form here. Opt Out of Marketing Communications If you do not wish to receive marketing communications from us, please do not select the option to get our communications and offers when you sign up for a Wendy’s account. If you already receive our marketing communications, you can opt out of future marketing communications by following the instructions provided in those communications, such as the unsubscribe link at the bottom of your Wendy’s email. You can also change your communications preferences by logging in to your account and updating your account settings. Please note that opting out of marketing communications will not affect our administrative communications to you, such as when we confirm your order or give you information about your Wendy’s Rewards. Tracking Technology Choices You can choose not to permit tracking technologies, such as cookies and web beacons, when you use our services, but blocking some types of these tracking technologies may interfere with your experience. For instance, we may not be able to recognize you as a returning customer, save your preferences, or find the Wendy’s closest to you. Browser-Based Opt Outs. You may be able to disable tracking technologies using your web browser settings. Please review your browser’s instructions or visit All About Cookies for general information. Note that your web browser may have settings that allow you to transmit a “Do Not Track” signal when you use online services. Like many websites, Wendy’s websites are not currently designed to respond to “Do Not Track” signals received from browsers. Self-Regulatory Program Opt Outs. Two self-regulatory programs are available to help you control the use of tracking technologies on your browsers — the Digital Advertising Alliance and the Network Advertising Initiative. Both programs help to regulate vendors in the digital advertising space. One function of their self-regulatory programs is to give you the ability to opt out of targeted (or interest-based) advertising, including the use of tracking technologies, from their member companies. You can visit the Digital Advertising Alliance’s Your Ad Choices website to opt out of targeted advertising for participating vendors. The Network Advertising Initiative similarly assists with opt outs through their Opt Out of Interest-Based Advertising webpage. Google Analytics Opt Out. To opt out of Google Analytics cookies, visit Google’s My Ad Center and/or download the Google Analytics Opt-Out Browser Add-On. 5. Wendy’s Rewards – Notice of Financial Incentive You automatically opt into Wendy’s Rewards when you sign up for a MyWendy’s account. You can terminate your Wendy’s Rewards and your MyWendy’s account at any time by emailing us at customercare@wendys.com or calling us toll-free at 1 (888) 624-8140. Please note that both must be terminated together. You are not required to have a MyWendy’s account or participate in Wendy’s Rewards to order from us. Wendy’s collects personal information, such as your name, email address, and a password, to operate Wendy’s Rewards and provide you with associated benefits. You may also provide Wendy’s with additional personal information if you choose to do so. We do not sell personal information we collect as part of the Wendy’s Rewards program. We may disclose this personal information to the vendors who help us administer the Wendy’s Rewards, such as our payment processors. Participants collect points through Wendy’s Rewards that can be redeemed for rewards, such as discounts. The benefits associated with the program, including how rewards accrue, are valued, and can be redeemed are outlined in the Wendy's Rewards Terms and Conditions, which also provide additional information about the Wendy’s Rewards program. 6. External Links For your convenience, Wendy’s services may include links to websites or other services that are not owned, operated, or controlled by Wendy’s. This privacy policy does not apply to those websites or services, which may have their own privacy policies or notices that you should review to understand how they collect, use, or disclose your personal information. Wendy’s is not responsible for the content or privacy practices of any linked websites or services that it does not own, operate, or control. 7. Data Security and Retention of Personal Information We protect personal information using technical and administrative security measures designed to reduce the risks of loss, misuse, unauthorized access, disclosure, and alteration. Although we implement industry-standard security measures throughout our services, you should be aware that Wendy’s cannot guarantee the security of your personal information. Except as otherwise permitted or required by applicable laws or regulations, we retain your personal information for as long as necessary to fulfill the purposes for which we collected it, as necessary to satisfy any legal obligations, or when required to resolve any disputes. To determine the retention period for personal information, we consider applicable legal requirements, the amount, nature, and sensitivity of the personal information, the potential risk of harm from unauthorized use or disclosure of your personal information, the purposes for which we process your personal information, and whether we can achieve those purposes through other means. 8. Children’s Privacy Our online and mobile app services are not intended for children under the age of 16, and we do not knowingly collect personal information online or through our mobile app from children under the age of 16. If we become aware that we have obtained personal information from a child under the age of 16, we will delete such information in accordance with applicable law. 9.
