USE OF ONLINE SERVICES The following terms and conditions apply to the use of blue Cinema online services via the blue Cinema customer account and the blue Cinema Club on the website and/or in the blue app. CUSTOMERS ACCOUNT The use of online services requires registration with blue Cinema (hereinafter also referred to as “Customer Account“). Registration requires that users enter correct data in the customer account (Swiss mobile number, first name and surname, email address, date of birth). All information must be truthful. The use of imaginary names and pseudonyms is therefore not allowed. Registration requires identification, which generates access data for the customer account. In case of false information, blue Cinema reserves the right to delete the customer account. In case of changes of the deposited information (e.g. surname, email address and mobile number), these must be adjusted promptly. The user takes the necessary precautions to keep his password secret and to prevent the use of his customer account by unauthorized persons or misuse. In case of continuous inactivity of a customer account, it can be deactivated by blue Cinema. Holders of a customer account automatically participate in the blue Cinema Rewards points program as stated on the blue Cinema website (“Rewards“). 2. BLUE CINEMA CLUB MEMBERSHIP It is possible to purchase a blue Cinema Club membership (hereinafter referred to as “Club” or “Club membership”). Existing blue Cinema Club memberships are stored in the customer account and can be added to the Wallet. A membership entitles the holder to purchase discounted cinema tickets and kiosk products at reduced prices according to further details on the blue Cinema website. The offers and benefits can be used at blue Cinemas theaters, on the blue Cinema website and in the blue app. Club membership is available on the blue Cinema website and app at the price communicated online and is automatically added to the existing or newly opened customer account. The term begins immediately after the purchase is made. The duration of the subscription can be checked at the box office and online in the customer account. The minimum duration of the subscription for the Club is one year and can be extended for a further year at the price communicated online. Points from the “Priority Points” program with existing memberships are migrated to the “Rewards” point system. 2.1 ONLINE PURCHASES The offer to conclude a contract is made by the user as soon as they have electronically sent the order for their online tickets or online gift cards. A return or exchange of tickets or online gift cards purchased online is generally excluded. All online services accessed will be attributed to the user concerned. In the case of print@home tickets and online gift cards purchased and printed out at home, as well as in the case of mobile tickets, the user must ensure that they are protected against misuse (e.g. copying, modification or printing out by unauthorized persons). Tickets purchased online and online gift cards may not be used commercially. print@home tickets and online gift cards must be stored in a way that all details on the ticket or gift card, and in particular the barcode, remain legible. print@home tickets and mobile tickets must be presented for screening on admission in the same way as conventional tickets. Gift cards can be redeemed for a maximum of ten years from the date of purchase. 2.2 PRICE REDUCTIONS/CONCESSIONS The price reductions/discounts are only valid with an active Club membership for all regular cinema screenings and blue Cinema events. A maximum of ten discounted tickets can be purchased per screening. For cinema performances in special formats and for seats with additional services, a surcharge per ticket applies. The kiosk discount cannot be cumulated with other promotions, discounts or coupons and does not apply to predefined product combinations. 2.3 RESERVATIONS Reservations made with the Club remain valid until 20 minutes before the start of the screening and can be collected at blue Cinema movie theater upon presentation of the Club membership and the reservation number. Online reservations can be converted into a ticket purchase at any time in the customer account. 2.4 CREDIT BALANCE Any remaining credit (also for the physical Carte Bleue) will be issued as a gift card and deposited in the customer account. A refund or cash payment of the credit is excluded. 2.5 FURTHER PROVISIONS The Club membership is non-transferable. It may only be used by the holder of the customer account to which the subscription is deposited. Any form of misuse entitles blue Cinema to terminate the Club Membership and to block the customer account. blue Cinema accepts no liability whatsoever towards the holder or third parties in the event of misuse of the Club membership. When purchasing tickets, the applicable regulations regarding the age of admission must be observed. In case of non-compliance, tickets will be cancelled and the ticket price will be refunded in the form of a gift card. 3. MARKETING By concluding the contract, customers agree to forward their personal data processed for marketing purposes to Entertainment Programm AG and companies of the Swisscom Group for their own use for marketing purposes as well as for market and competition analyses. blue may also pass on the processed personal data to third parties for its own marketing purposes, for example for market research and competitive analyses or for the commissioned implementation of marketing measures. By concluding the contract, customers agree that the aforementioned third parties may contact them for marketing purposes. Customers can choose at any time which notifications (offers, newsletters, etc.) they receive from blue. In each notification, there is an unsubscribe link at the bottom of the message. Customers can use this to adjust their settings or inform our customer service of their preferences. 4. GENERAL blue Cinema reserves the right to change these GTC at any time and to change or terminate the Club. TICKETS CAN BE PURCHASED AT THE BOX OFFICE, IN ADVANCE OR DIGITALLY. 2.2 TICKETS CANNOT BE RETURNED OR EXCHANGED UNLESS THE EVENT IS EXPRESSLY CANCELLED OR POSTPONED. IN THIS CASE, THE TICKET PRICE WILL BE REFUNDED. 2.3 THE TICKETS AUTHORISE ADMISSION TO THE SPECIFIED PERFORMANCE ONLY. LATER ADMISSION CANNOT BE GUARANTEED FOR REASONS OF SAFETY AND CONSIDERATION FOR OTHER VISITORS. 3. VISITOR BEHAVIOUR 3.1 VISITORS MUST BEHAVE APPROPRIATELY DURING THE PERFORMANCE AND FOLLOW THE INSTRUCTIONS OF THE STAFF. 3.2 VISITORS ARE GENERALLY NOT PERMITTED TO BRING THEIR OWN FOOD AND DRINK. EXCEPTIONS REQUIRE THE EXPRESS CONSENT OF BLUE CINEMA. 3.3 SMOKING IS ONLY PERMITTED IN THE DESIGNATED AREAS. 3.4 ANY FORM OF NOISE DISTURBANCE AND THE USE OF SOUND OR IMAGE RECORDING DEVICES DURING THE PERFORMANCE ARE PROHIBITED. 4. LIABILITY AND SAFETY 4.1 BLUE CINEMA ACCEPTS NO LIABILITY FOR DAMAGE TO PROPERTY OR PERSONAL INJURY UNLESS CAUSED BY GROSS NEGLIGENCE OR INTENT ON THE PART OF BLUE CINEMA. 4.2 VISITORS ENTER THE EVENT SITE AT THEIR OWN RISK. YOU ARE RESPONSIBLE FOR YOUR OWN PERSONAL BELONGINGS. 4.3 THE PERFORMANCES TAKE PLACE IN ALL TYPES OF WEATHER.
