HOW MUCH WE HAVE RECOVERED FOR OUR CLIENTS Case Studies £45,000 Our client suffered a hand injury after a fall and attended hospital for treatment. She was referred to another Health Board for surgery but there was no follow up which delayed her post-surgical physiotherapy treatment. As a result of the delay, our client suffered permanent damage to her dominant hand impacting her ability to work. We achieved settlement after extensive negotiations. £725,000 During labour and delivery our client’s shoulder became stuck (shoulder dystocia) resulting in significant stretching and damage to the nerves in his neck and shoulder (Erb’s palsy / brachial plexus injury). The Health Board defended the action but the court accepted our expert evidence and legal argument that the injury was due to negligence on the part of the treating midwife. £5,000,000 Our client suffered brain damage due to a lack of oxygen during labour and birth resulting in cerebral palsy. The midwives and doctors failed to detect obvious signs of fetal distress on the CTG monitors which should have resulted in earlier delivery. Had our client been monitored correctly and delivered at the correct time then he would have avoided damage. We successfully settled the claim so that our client could purchase or adapt suitable accommodation and put in place lifelong care to meet his complex needs. £185,000 We acted for Mr Andrews after his partner, Ms Graham, died as a result of negligence by hospital staff within the acute assessment unit of Glasgow Royal Infirmary.
