This CLE course will guide healthcare counsel on the National Practitioner Data
Bank (NPDB) reporting obligations for hospitals. The panel will address
navigating through the gray areas of reporting and examine how the courts have
dealt with immunity from liability for reporting, as well as discuss the
physician's perspective.
DESCRIPTION
The NPDB was created to help improve healthcare quality and protect the public.
In late 2020, the Health Resources and Services Administration sought public
comment on proposed changes to the NPDB information collection and the forms
used in registering with, reporting information to, and requesting information
from the NPDB.
There are many circumstances when it is not clear whether or not to file a
report. For example, a practitioner may informally agree not to exercise
privileges while there is an ongoing investigation or corrective action was
taken based on action taken at another hospital; questions may arise as to
whether reporting is necessary.
Hospitals, physicians, other practitioners, and their counsel need to understand
the NPDB reporting requirements to assess what is required by federal law and
regulations.
