TERMS & CONDITION


GENERAL

These terms and conditions apply to all purchase orders submitted to BARA
Sportswear webshop on www.barasportswear.com (in the following referred to as
the ”webshop”), this covering all purchase agreements that a consumer enters
into from a distance with Northern Apparel AS, hereinafter referred to as ”BARA
Sportswear”). We encourage you to read these terms and conditions in their
entirety before submitting an order. These terms and conditions may be updated
and vary from time to time why we ask you to read the terms and conditions
previous to every order you place in the webshop.

A binding purchase agreement is entered into as soon as your order has been
confirmed by us and an order confirmation has been sent from BARA Sportswear to
the e-mail address you submitted. If an item happens to run out of stock before
the status has been correctly updated on the webshop, BARA Sportswear will
notify you of this by e-mail. We may then suggest an alternative item, or cancel
the order in question. If incorrect price information has been shown on the
webshop you will be offered to either purchase the item to the correct price, or
cancel the order. BARA Sportswear reserves the right to decline or rescind a
purchase agreement if fraud or other actions similar to fraud, such as unlawful
use of another person’s credit card, can be suspected.

To place an order in the webshop you must be at least 18 years old and not under
guardianship. BARA Sportswear presumes that minors who carry out purchases
on www.barasportswear.com submit truthful information of their age and/or
possess the necessary consent from their custodian to purchase the item(s). If
not, the buyer may become liable for the possible costs an invalid agreement may
involve. 

In order to offer you Klarna’s payment methods, we might in the checkout pass
your personal data in the form of contact and order details to Klarna, in order
for Klarna to assess whether you qualify for their payment methods and to tailor
those payment methods for you. Your personal data transferred is processed in
line with Klarna’s own privacy notice


PRICE & PAYMENT


DUTY DELIVERY PAID (DDP)

Pricing is inclusive of duty and tax in EU & Norway.

(applicable tax shown at checkout)

Orders will be sent duty paid, meaning that no further import duty or tax will
be payable after the order has been placed on the site.

The prices at the webshop are current prices and may be changed at any time.
BARA Sportswear is not bound by price indications in the webshop which the buyer
must reasonably or apparently understand are incorrect and which, for example,
have occurred due to technical problems in the web platform or rates that have
been manipulated by the customer. Prices are inclusive of local VAT and are
payable in the currency indicated at the webshop. Payment can be made by credit
card, direct debit invoice or as may otherwise be instructed at the webshop.
Where payment is subject to validation and/or authorisation by a card issuer or
bank or to credit validation, any Order Confirmation is subject to such
validation or authorisation. We co-operate with an authorized payment service
provider (STRIPE), who processes your personal details in accordance with the
international security standard PCI DSS, developed by international credit card
companies such as VISA, MasterCard and Diners. All transactions will be sent
through SSL (Secure Sockets Layer) in encrypted form and all card details and
payment information will be protected and processed with a high level of
security.

PROMOTIONS & DISCOUNT CODES

All campaigns with reduced price are limited in time. Multiple offers can
normally not be combined. A discount code or voucher is only valid once per
customer and purchase. In case of obvious misuse of offers, such as coupons and
promotion codes, the webshop reserves the right to cancel the order in question.

On orders eligible for a gift or discount the value of the gift/discount is
considered as a general discount on the total amount of the order. If part of or
the entire order is sent back for exchange or refund the value of the returned
merchandise is recalculated and the purchase price minus the relative share of
the overall discount will only be credited.

Promotions and discount codes are only valid on new orders and cannot be applied
retrospectively.

If you choose to return one or more products at promotional purchases where a
product was followed on the purchase, the free product should also be returned
in unopened / original order. If you choose to keep the free product, we will
send an invoice for the product's value.

You can not use multiple discounts at the same time. 


DELIVERY

We always want to deliver your order as soon as possible. Normally orders of
items in stock ship within 1-2 business days from Order Confirmation and can be
expected to be delivered in 1-5 business days within Norway and 7-15 business
days on International orders (1-3 days with DHL Express). Delivery times are
estimates only and particularly during high season (e.g. Christmas) deliveries
may take longer than normal. We currently ship to most countries but may not
ship to certain countries outside the European Union. Should you have an inquiry
as to whether or not we ship to a specific location, please contact our Customer
Service. You are asked to inspect delivered items upon delivery and report any
deviations found as stated under Returns below. In case you fail to collect your
products upon delivery, we reserve the right to debit you a charge to cover our
cost for return freight and administration.


RIGHT OF WITHDRAWAL AND RETURNS

We offer you a 14-day right-of-return from your purchase, calculated from the
date you receive the goods. If you wish to make such a return please follow out
our return instructions. Items shall be returned hereunder properly wrapped and
packed in their original packaging in unused and saleable condition. As soon as
we have received the returned items, and have been able to confirm that the
requirements above are met, we will refund your payment. Please enclose a return
note with order number and kindly return the product in its original packaging.
When withdrawing your purchase you will have to pay for the cost for returning
the product to our warehouse. Please keep in mind that you will have the risk of
the return (in case something happens to your shipment). Therefore we recommend
always using tracked shipping. Please note there will apply a restocking fee of
79 kr when you choose to receive a refund. If a customer refuses delivery,
or uncollected goods: If the buyer fails to collect ordered goods, a fee will be
charged the buyer, to cover return and handling costs. This fee is NOK 199,- for
Norwegian orders and 40 EUR for international orders, as well as accrued
interest and fee on invoice purchases. The fee must cover the seller's actual
outlay to deliver the goods to the buyer. No returns are accepted for products
purchased on sale. In case you find that an item delivered by us to you is
defective you should contact Customer Service as soon as possible with a formal
complaint, to get a replacement delivery or, if that is not possible, a refund.
The same applies in case you identify that a product has been damaged during
transportation or you identify other deviations in the delivery, e.g. that the
number of items or the product model delivered is not in line with your order.
Returns hereunder shall be sent to Customer Service or to the other address
specifically instructed by us. If you want to make a complaint it has to happen
no later than 7 days after delivery. Returns hereunder shall be sent to Customer

return, the risk (for loss or damage during delivery) is on the customer. All
returns, except exchanges, will be charged a restock fee to cover our shipping
costs to you.


DAMAGED PRODUCTS

BARA Sportswear ensures that all products are meticulously checked in quality
control before being dispatched to our customers. We work hard to avoid the
emergence of damages or defects in our products. Should you find that an item
despite this is damaged or otherwise defective, you will be replaced with a new
sample of the item in question, if a new one is available. If not, you will be
refunded with the original cost of the item and the return cost, unless the
defect can be repaired. If the damaged item followed an order containing other
purchased items the cost of the original delivery will not be repaid. You are
asked to always examine your received products already at the time of delivery
and as soon as possible report any deviations from your order confirmation to
us.

We will return your funds as soon as possible, at the latest within 15 days from
the date you returned the item and it was received by BARA Sportswear, and we
have established that the item is damaged or otherwise defective. Always save
your receipt. The funds will be returned to your original method of payment. If
you paid using your credit card, the amount will be repaid to the same card.


COLOURS

We cannot guarantee that the colours appearing on the online store in detail
reflect the product colours. The colours can be reflected in different ways
depending on for example your computer or phone screen, graphic card and the
computer settings.
