PROHIBITIONS


Several legislative measures contribute to the implementation of the Biological
Weapons Convention in the criminal legislation of Türkiye. Articles 314 and 315
of the Criminal Code of 2004 prohibit the transport or storage of weapons, which
pursuant to Article 6(1)(f)(5) of the same law includes biological weapons, by
producing, purchasing or smuggling them into the country, with the intention of
using them in terrorist activities, punishable by imprisonment from ten to
fifteen years. Articles 82(c) and 152(2)(c) of the same law prohibit the use of
biological weapons. Articles 35 and 37-40 of Criminal Code outline participatory
offences. In accordance with Articles 8 and 11 of the Criminal Code the
aforementioned prohibitions apply to crimes committed or partially committed in
Türkiye, or the result occurs in Türkiye and to crimes committed by Turkish
citizens abroad. Article 54 of the Criminal Code, Article 127 of the Criminal
Procedure Code and Articles 3, 6, 12-15 and 19 of Regulation on Collection of
Evidence of 1983 authorizes confiscation and seizure of material potentially
linked to offences.

The purpose of this Regulation is to regulate the procedures and principles
regarding the collection, packaging, transportation, import and export of
veterinary biological samples to be sent to national or international
laboratories, institutions and organizations for the diagnosis, research,
development, training and other purposes related to animal diseases, and the
principles regarding biosafety conditions.

EXPORT, IMPORT AND TRANSFER CONTROLS


Türkiye has a number of legal measures relevant to the control of exports and
transfers of materials related to biological weapons. The country adopted a
control system for the export of dual-use materials. Articles 2 and 6 of
Communiqué on Control of Export of Dual-Use and Sensitive Materials No. 2003/12
provide that materials and technologies listed in the Wassenaar Agreement of
Dual-Use Materials and dual-use materials and technologies not included in the
Wassenaar Agreement that may be suspected of being used in the development of
weapons of mass destruction are subject to permission from the Undersecretariat
of Foreign Trade, General Directorate of Exports. Türkiye has also adopted a
military export control list and system. Article 7 of Law No. 5201 on the
Control of Industrial Enterprises Producing Vehicles and Equipment of War and
Arms, Ammunition and Explosive Material and Articles 19(4), 19(5) and Article 20
of the related Regulation No. 26514 on the Inspection of Industrial
Establishments Producing War Equipment and Weapons, Ammunition and Explosives
provide general principles and controls for the export of dual-use materials and
technologies and materials and technologies which may be suspected to be used in
the development of weapons of mass destruction. Penalties for violation of this
law range from imprisonment of one to five years and a find of not less than
eight billion liras. Further requirements relating to transfers of controlled
items are found in Articles 8-12 of Regulation No. 27710 on Transport of
Infectious Substances which covers the microorganisms listed in Annex 4 as well
as Articles 8-13 of Regulation No. 31228 on the Collection, Transportation,
Import, Export and Laboratory Conditions of Veterinary Biological Samples of
2020 which covers infectious substances listed in Annex 1 of the regulation. End
user certification is required under Article 2 of Communiqué on Control of
Export of Dual-Use and Sensitive Materials No. 2003/12 and Articles 21(2) and 24
of Regulation No. 26514 on the Inspection of Industrial Establishments Producing
War Equipment and Weapons, Ammunition and Explosives. Specific requirements for
transit and carriers are included in Articles 5-12 of Regulation No. 27710,
Articles 8, 13 of Regulation No. 31228 and Article 44 of Regulation on Control
of Hazardous Waste.

Biosafety and Biosecurity Association of Türkiye is a non-governmental,
non-political association that officially registered by the Ministry of Internal
Affairs, General Directorate of Relations with Civil Society.


Engagement with life scientists

The Scientific and Technological Research Council of Turkiye (TUBITAK), which
operates under the Ministry of Industry and Technology, has a research centre
