N.Y. STATE IS FREE TO TEAR DOWN I-81 IN SYRACUSE, APPEALS COURT RULES

A New York appeals court dismissed a legal challenge to the I-81 project in
Syracuse on Friday, clearing the way for the state to tear down the highway
viaduct that runs through the city.

The state Supreme Court’s Appellate Division for the Fourth Department
overturned a year-old decision by a Syracuse judge that the state Department of
Transportation must complete additional environmental studies before the viaduct
can be removed. The five judges were unanimous in the decision.

State Supreme Court Justice Gerard Neri ruled in February 2023 that the DOT must
study factors including the traffic impact of Micron Technology’s planned
microchip complex. The appeals court overturned Neri’s order.




Renew 81 for All, the group opposed to the state’s plan to tear down Interstate
81 in Syracuse, argued to a panel of state Supreme Court appellate justices in
Rochester in November that the state should throw out its $2.25 billion plan and
start over.

The court on Friday said Renew 81′s argument was “without merit.”

But Renew 81 will appeal the decision to the state’s highest court, the Court of
Appeals, said Onondaga County Legislator Charles Garland, a member of the group.

“I am certain we will appeal,’’ Garland said. “We feel that the facts are very
clear, and that the Court of Appeals will certainly agree with Judge Neri.”

Mayor Ben Walsh said it would be a waste of time and money to appeal. He urged
the members of Renew 81 to reconsider.

“What’s the point?” Walsh said. “Their strategy from Day One has been delay,
delay, delay.”

DOT crews have already begun work on parts of the project north and south of
Syracuse. Work on the viaduct is expected to begin in 2026.

Lawyers for the state Department of Transportation argued the project should
move forward. Any delay will cost at least $25,000 a day, they said.
Construction has already begun on Interstate 481 in the suburbs and the state
DOT is working on bids for the next contract, for construction near Destiny USA
and the Inner Harbor.

The state and federal governments, in 2022, chose among several options to tear
down the aging viaduct in Syracuse, sending local traffic on improved city
streets and high-speed traffic around the city on an improved Interstate 481.
They call it the community grid.



The community grid option was chosen after 14 years of study and discussion.



Gov. Kathy Hochul cheered Friday’s ruling, saying it allows the project to
proceed on schedule.

“There’s more work to do to reunite and reconnect communities in Syracuse and
today’s decision is a landmark step in the right direction,’’ Hochul said in a
prepared statement.

The group Renew 81 for All sued to stop the project. The group prefers an option
that would keep high-speed traffic moving through downtown and has advocated for
a 70-foot skyway over the city.

Renew 81′s lawsuit threatened to bring more delay to a project years in the
making. Lanessa Owens-Chaplin, a lawyer for the New York Civil Liberties Union,
said she hopes the community can move on now to discuss other important elements
of the project, such as how to use land that can be developed after the viaduct
is removed.

“This has been a long and winding road, and I’m glad the project can move
forward,’’ she said. “Ending this litigation is the first step towards being
able to start to have those conversations with the DOT about the future land
use.’’

Neri ruled in February 2023 that state should conduct three more environmental
reviews before removing the 1.4-mile viaduct through downtown Syracuse. He
allowed construction to begin in the suburbs.

One of the three supplemental reviews would have considered the announcement,
made after the state chose the highway design, that Micron Technologies would
build a massive microchip plant in Clay. Neri also ordered the state to study
the 81 project’s potential impact on air quality along Interstate 481 in DeWitt
and stormwater runoff into Onondaga Lake.



Attorney Alan Knauf argued for Renew 81 that the Micron project changes
everything. The state argued that details about Micron’s development are nothing
more specific than a press release and that, eventually, Micron will have to do
its own environmental impact study.

Knauf could not be reached immediately following Friday’s court ruling.

Walsh said Renew 81′s plan to appeal today’s decision will distract from solving
problems that face Syracuse.

“It’s just an additional waste of time and resources that will be better
invested not just in the community grid, but in the underlying systemic issues
that we face as a community, from concentrated poverty, to structural racism to
the many other challenges we face,’’ he said. “That’s what we all need to come
together and focus our attention on and I hope they reconsider their position
and come to their senses.”

Renew 81 for All is backed by the towns of Salina, DeWitt and Tully; DeWitt
resident Nathan Gunn; Legislator Garland and Garland Funeral Home; and Ann Marie
Taliercio, president of the Central New York Area Labor Federation. Frank
Fowler, the former Syracuse police chief, is the group’s president.

The group has also sued the federal government. That case is pending in federal
court.
