U.S. labor board makes it easier to hold companies liable for labor law
violations

A U.S. labor board has issued a final rule making it easier for workers and
unions to hold companies liable for labor law violations by their franchisees
and contractors. The rule treats companies as joint employers when they have
control, even if it is indirect or not exercised, over essential terms and
conditions of employment. A company found to be a joint employer would likely be
forced to become more involved in setting and implementing workplace policies,
and could be required to bargain with unions. The rule eliminates a regulation
adopted during the Trump administration that required companies to have "direct
and immediate" control over contract and franchise workers to be considered
joint employers. The new rule is seen as a return to common-law principles and a
practical approach to ensure that entities that effectively exercise control
over workers' terms of employment respect their bargaining obligations. The rule
will broadly affect industries such as manufacturing and construction that rely
heavily on staffing agencies and contractors to provide workers, and franchises
such as McDonald's. Supporters of the new rule, including labor unions, argue
that it is necessary due to an uptick in the use of contract labor in recent
years. Worker advocates say companies have avoided being held accountable for
labor violations under the more lax standard adopted during the Trump
administration.

Councils told not to adopt four-day working weeks

Ministers have formally warned councils in England against adopting four-day
working weeks for staff. Government guidance says local authorities that have
adopted the work pattern should end the practice immediately. While supporters
of the four-day week argue that it improves staff wellbeing and productivity,
the government believes that it does not represent value for money and is
concerned service quality will decline. Lee Rowley, the Minister for Local
Government, warned that councils which opt to disregard the guidance “are now on
notice” that ministers “will take necessary steps” to ensure that the practice
is ended within local government. Noting that more than nine in 10 councils are
experiencing staff recruitment and retention difficulties, Pete Marland, chair
of the Local Government Association’s resources board, said: “It is councils who
know what works best for their community, workforce and in their wider labour
market conditions.”

Racism against people of African descent is on the rise in Europe

The European Union's Agency for Fundamental Rights has published new
discrimination data, revealing that racism against people of African descent is
increasing in the EU. The prevalence of racism has risen in the last five years,
with almost half of the bloc's people of African descent facing discrimination
based on skin colour. The report highlights the challenges faced by black
communities in accessing jobs and housing. Discrimination was particularly high
in Germany, Austria, Finland, and Denmark. The study also shows that black
individuals are more likely to be underpaid and face temporary work contracts.
Housing discrimination is widespread, with private landlords refusing black
tenants in several countries. The study calls for reflection on the lack of
progress in combating racism and urges EU states to do more to protect black
communities. "Racism remains pervasive and relentless," said Michael O'Flaherty,
director of the rights group.

Employees are secretly using AI tools at work

Employers are increasingly concerned about the use of generative AI tools such
as ChatGPT in the workplace due to the potential leakage of sensitive
information and corporate secrets. However, many employees find these tools
helpful and have come to rely on them for various tasks. Some workers have
resorted to using AI tools discreetly, even if they are explicitly banned or
frowned upon. They block their screens from view or employ higher-tech solutions
to keep their usage hidden. Forums have emerged where employees share strategies
for avoiding detection, such as integrating AI tools into disguised workplace
apps or using privacy screens. A survey reveals that a significant number of IT
decision makers are considering or implementing bans on AI tools in the
workplace. However, restricting access to these tools without providing a clear
plan for their adoption can lead to frustration among employees. Some workers
have already found alternative AI tools, like Perplexity, to continue benefiting
from generative AI in secret.
