GS Engineering & Construction to build $1.9b desalination plant in Oman

South Korea based GS Engineering & Construction has been awarded a contract to
build, operate and own a desalination plant in Oman. The plant will be operated
by the company's water subsidiary GS Inima for 20 years. The facility will be
named Barka 5 Independent Water Plant and will be located 60km west of the
capital Muscat and will desalinate 100,000 m3/day as of 2024.
Nareva and Engie to build wind-powered desalination plant in Morocco

Nareva and Engie have announced the construction wind-powered desalination plant
in Morocco. The desalination plant has been awarded to Dakhla Water & Energy
Company (DAWEC), a joint venture between International Power, the subsidiary of
the French group Engie and Nareva, the subsidiary of the Moroccan group Al Mada.
The plant will supply 37 Mm3/year. 30 of the 37 Mm3 will be used for irrigation
of agricultural land.The facility will also provide drinking water to the
locations of Dakhla and Bir Anzarane.
Mueller Systems launches Mueller Cellular Node

Mueller Systems has launched Mueller Cellular Node, an addition to the Mi.Net
Advanced Meter Infrastructure (AMI) system. This enables utilities to connect
meters to their AMI network by leveraging existing cellular infrastructure. The
Mueller Cellular Node communicates with encoded water meters, including meters
that are already in operation. It sends near real-time consumption data directly
to the scalable Sentryx Water Intelligence Platform which provides insights into
the health of distribution systems.
AECOM to design Wisconsin’s first municipal PFAS treatment facility

Engineering firm AECOM has announced it will design the installation of PFAS
treatment systems at the City of Madison, Wisconsin. The treatment system will
return a municipal well to service, using granular activated carbon to remove
PFAS that has been detected since 2017.

US Supreme Court limits US EPA’s ability to regulate carbon emissions

The US Supreme Court limited the Environmental Protection Agency’s ability to
regulate carbon emissions from power plants under portions of the Clean Air Act
via a 6 – 3 decision in West Virginia v. EPA. Some legal experts believe that
the legal reasoning used in the case may also be used to limit EPA’s regulatory
power in other domains, like water, in the future. The court will be hearing a
challenge to aspects of the Clean Water Act, Sackett v. Environmental Protection
Agency, but more commonly known as the “waters of the United States” case in
October that may result in a similar outcome.
BlueTech Comment
The key legal issue was how specific Congress needs to be when granting power to
executive agencies to create regulations. The majority opinion ruled that the
Clean Air Act did not clearly give the EPA sweeping authority to regulate the
energy industry. In other words, the court ruled that the regulations were too
broad in scope to be issued via EPA’s ability to regulate pollutants of concern
under the Clean Air Act. The majority opinion relied on the “major questions
doctrine,” a theory that says Congress must authorize in plain and direct
language any sweeping actions by administrative agencies that could transform
the economy.
The upcoming Sackett v. EPA case disputes what constitutes the “waters of the
United States,” (WOTUS) which are protected by the 1972 Clean Water Act (CWA).
The case involves a long-running dispute between an Idaho couple, the Sacketts,
and the EPA in which the EPA determined the couple required a federal permit to
build their home on their land because it contains a wetland. The key question
is whether or how a wetland is connected to a river, lake, or other waterway
determine. In a 2006 case, Rapanos v. U.S., there was no majority opinion.
Instead, the 4 most conservative justices voted to strike down the rule,
defining WOTUS as only “relatively permanent, standing or continuously flowing
bodies of water” like streams, rivers, or lakes, and wetlands with a “continuous
surface connection” to other waters subject to the CWA. The 4 most liberal
justices agreed with the EPA’s interpretation of the rule. Justice Anthony
Kennedy agreed that the rule should be changed, but he argued that the Clean
Water Act covers wetlands with “a significant nexus” to those other bodies of
water, further explaining that a significant nexus exists when the wetland
significantly impacts the chemical, physical, and biological integrity of a
traditionally navigable water. Because there was no majority opinion, it
remained unclear which opinion determines wetlands jurisdiction, but lower
courts have generally applied the Kennedy rule. To clarify the scope of WOTUS,
the EPA promulgated new regulations in 2015, but they were stayed by a federal
appeals court. A new draft rule was proposed in 2021 that attempts to restore
the pre-2015 rules while respecting the Supreme Court’s rulings on the topic.
It is expected that the court’s conservative majority will again use the major
questions doctrine to narrow the definition of WOTUS to what the court’s most
conservative members suggested in 2006. This is a long-sought goal of business
groups like the US Chamber of Commerce and National Association of Home
Builders. A lawyer for the Sacketts suggested that the Clean Water Act has
become akin to “a mini federal zoning code.”
Some estimates by environmental groups suggest that the narrowed WOTUS
definition would reduce the amount of federally regulated waterways by 90%. The
EPA has argued that the ability to define and regulate WOTUS is granted to the
EPA by the CWA, and that wetlands must be protected because they protect and
improve water quality, provide fish and wildlife habitats, store floodwaters,
maintain surface water flow during dry periods, and sequester carbon. This case
is likely to be another landmark ruling against executive agencies’ ability to
regulate the environment, reflecting the Supreme Court’s new 6-3 conservative
majority’s skepticism of the “administrative state” writ large. With Congress
perennially deadlocked, new environmental rules are almost always created by
executive agencies as regulations under older statutes, some of which
deliberately left executive agencies leeway to regulate future potential threats
to human health or the environment which may not have existed at the time the
statute was written. The difficulty in finding 60 votes in the Senate and the
application of the major questions doctrine by the court’s majority suggests the
potential for significant new environmental regulations in the future is more
limited than in the past.

Italian multinational company De Nora has announced the completion of its IPO at
13.50 euros per share and is now listed on the Italian Stock Exchange valuing
the organisation at 2.7 billion euros (~$2.8b).

Here are some of my key highlights:
EBITDA at De Nora's water technologies division rose by nearly 103% last year to
€39M (~$40M), on revenues of €258M (~$265M) (up 23%).
EBITDA margin increased to a whopping 15.1% in 2021 compared to 6.3% in 2019.
Key segments driving the majority of water division revenues include swimming
pools, electrochlorination, and disinfection & filtration. The pools segment
drove 61% of the water business in Q1 2022.
The firm has acquired multiple technologies and businesses under the Water
Technologies division to diversify its product portfolio.
