The suits allege that TikTok designed its social media platform to target youth and “manipulates them into habitual use, and mines the data produced by their excessive and compulsive use for more and more profit.” Read More ENFORCEMENT + LITIGATION Marriott and Starwood Settle on Consent Agreement with FTC for Data Breaches This week, Marriott International, Inc. and its subsidiary Starwood Hotels & Resorts Worldwide LLC (collectively, Marriott) agreed to settle on the terms of a settlement order with the Federal Trade Commission (FTC) for its alleged failures to implement reasonable security measures which in turn led to three data breaches between 2014 and 2020, affecting over 344 million consumers across the globe. The type of data affected included names, passport information, payment card numbers, loyalty numbers, dates of birth, email addresses, and other types of personal information. Specifically, the FTC alleged that Marriott failed to implement appropriate password controls, access controls, firewall controls, or network segmentation; patch outdated software and systems; adequately log and monitor network environments; or deploy adequate multifactor authentication. Read more RECENT EVENTS AND NEWS Sean Griffin Discusses Tougher NIST Cyber Guidelines on The Federal Drive Podcast Data Privacy + Cybersecurity Team and Artificial Intelligence Team lawyer Sean Griffin was the featured guest on The Federal Drive podcast episode “Tougher cyber guidelines coming for something you do every day,” discussing the National Institute of Standards and Technology’s (NIST) recent proposal to tighten requirements for identity management, proofing, and related procedures on September 24, 2024. “They’re introducing a few things…[o]ne is expanded identity proofing modules…[t]he second one is continuous evaluation and monitoring,” Sean stated after being asked about the new guidelines from NIST. “The draft guidelines add programmatic fraud requirements for credential service providers and government agencies and organizations have to just basically keep their eye on evolving threats and do so pretty aggressively.” In addition, Sean also discussed NIST’s new guidelines related to machine learning and artificial intelligence (AI). “[W]hat the new NIST guidelines do is they say the uses of AI and machine learning must be documented and communicated to organizations that are relying upon those systems,” said Sean. “All organizations using AI and machine learning must provide information to entities that are using that technology on the methods and techniques used for training those models. That goes back to preventing bias and hallucinations…and you also have to describe the datasets that you’re using.
