CYBERSECURITY Three More States Sue TikTok Alleging Harm to Young Users
Following in the footsteps of Nebraska, the Attorneys General of North Carolina,
California, and New Jersey filed complaints against TikTok and its owner,
ByteDance, Ltd., on October 8, 2024. The suits are lengthy and full of
allegations against TikTok and how it is responsible for a “profound mental
health crisis” of American teenagers. The suits allege that TikTok designed its
social media platform to target youth and “manipulates them into habitual use,
and mines the data produced by their excessive and compulsive use for more and
more profit.” Read More ENFORCEMENT + LITIGATION Marriott and Starwood Settle on
Consent Agreement with FTC for Data Breaches This week, Marriott International,
Inc. and its subsidiary Starwood Hotels & Resorts Worldwide LLC (collectively,
Marriott) agreed to settle on the terms of a settlement order with the Federal
Trade Commission (FTC) for its alleged failures to implement reasonable security
measures which in turn led to three data breaches between 2014 and 2020,
affecting over 344 million consumers across the globe. The type of data affected
included names, passport information, payment card numbers, loyalty numbers,
dates of birth, email addresses, and other types of personal information.
Specifically, the FTC alleged that Marriott failed to implement appropriate
password controls, access controls, firewall controls, or network segmentation;
patch outdated software and systems; adequately log and monitor network
environments; or deploy adequate multifactor authentication. Read More PRIVACY
TIP Privacy Tip #416 – Impersonation is the Most Prolific Phishing Tactic in
2024 A new report published by the software company Egress this month, Phishing
Threat Trends Report, is a must-read. It outlines the proliferation of phishing
toolkits on the dark web (that basically allows any Tom, Dick, and Harry Hacker)
to launch successful phishing campaigns, how “commodity phishing attacks are
overwhelming security teams,” the anatomy of advanced persistent threats, the
most prolific phishing tactic in 2024, and how AI-assisted attacks are becoming
more challenging to detect. October is National Cybersecurity Month. The
Cybersecurity and Infrastructure Security Agency (CISA) states that this month
marks “time dedicated for the public and private sectors to work together to
raise awareness about the importance of cybersecurity.” Find out more in this
week's Privacy Tip. Read more RECENT EVENTS AND NEWS Sean Griffin Discusses
Tougher NIST Cyber Guidelines on The Federal Drive Podcast Data Privacy +
Cybersecurity Team and Artificial Intelligence Team lawyer Sean Griffin was the
featured guest on The Federal Drive podcast episode “Tougher cyber guidelines
coming for something you do every day,” discussing the National Institute of
Standards and Technology’s (NIST) recent proposal to tighten requirements for
identity management, proofing, and related procedures on September 24, 2024.
“They’re introducing a few things…[o]ne is expanded identity proofing
modules…[t]he second one is continuous evaluation and monitoring,” Sean stated
after being asked about the new guidelines from NIST. “The draft guidelines add
programmatic fraud requirements for credential service providers and government
agencies and organizations have to just basically keep their eye on evolving
threats and do so pretty aggressively.” In addition, Sean also discussed NIST’s
new guidelines related to machine learning and artificial intelligence (AI).
“[W]hat the new NIST guidelines do is they say the uses of AI and machine
learning must be documented and communicated to organizations that are relying
upon those systems,” said Sean. “All organizations using AI and machine learning
must provide information to entities that are using that technology on the
methods and techniques used for training those models. That goes back to
preventing bias and hallucinations…and you also have to describe the datasets
that you’re using. AI, like every other computer system, is garbage in, garbage
out.” Listen to the episode here. Kate Healy and Linn Freedman Present MHA

Where Do We Go From Here?” as part of the Massachusetts Health & Hospital
Association’s Hot Topic Webinar series on October 10, 2024. Kate and Linn’s

implement it into their workflows. Linn Freedman Discusses AI as a Mental Health
Solutions at RIDigi / NEIT AI Summit Artificial Intelligence Team chair Linn
Freedman will be among the panelists presenting the program “A New Frontier in
Mental Health Solutions” at the RIDigi / New England Institute of Technology
(NEIT) Artificial Intelligence (AI) Summit on October 23. With mental health
problems continuing to rise, finding methods to help patients and mental health
professionals is crucial to improve their well-being and mental health outcomes.
Linn is among the industry leaders, technologists, and healthcare professionals
that will explore how AI is revolutionizing the treatment of anxiety,
depression, substance abuse, burnout and more. The panel will also discuss how
AI can tackle today’s most pressing mental health challenges—improving
diagnostics, personalizing treatments, and scaling solutions to create lasting
change in mental health care.
