PROPERTY CONTAMINATION

The Fifth Circuit reversed a Louisiana federal court’s determination that
Chevron conceded that it had contaminated a property and must evaluate it and
create a remediation plan. The appellate court says this was a misinterpretation
of the oil giant’s limited admission, and notes the relevant law allows Chevron
to determine whether remediation is necessary. Its plan to evaluate the property
without a remediation plan complies with the law’s requirements.




LIFE SENTENCE FOR DAESH FIGHTER

The Fourth Circuit affirmed the convictions and life sentences for El Shafee
Elsheikh, a fighter for the Islamic State group and former U.K. citizen who
participated in a “brutal scheme” of capturing and torturing hostages, some of
whom were traded in negotiations while others were executed on camera.




ONLYFANS BEATS PRIVACY CLAIMS

The parent company of OnlyFans beat a privacy class action filed against it in
Illinois federal court. The platform of choice for many subscription-based
pornographic content creators, OnlyFans allegedly collected creators’ biometric
data via the site’s age verification process; another user says a paid video
featuring him appeared on the site without his consent. Despite the allegations,
the court lacks personal jurisdiction because the claims do not arise from this
Delaware corporation’s contacts in Illinois.




TEXAS LIBERTARIAN PARTY

Libertarian Party members in Texas suffered a setback in their challenge to a
new state law requiring payment of a filing fee, in certain cases, “in order for
a third party to be considered at a nominating convention.” The federal court
barred the libertarians’ claims for damages on sovereign immunity grounds, but
noted they have brought a valid free association claim, as the requirement
impedes “voters’ rights to make free choices and to associate politically
through the vote.”




GUNS IN ARKANSAS COURTROOMS

The Arkansas Supreme Court clarified the authority of judges to control security
in their courtrooms, and expressly stated that all judges may regulate firearm
possession in all rooms where court business is routinely conducted.

The Utah Division of Consumer Protection accuses TikTok of profiting from
deceptive design features in live video streams that facilitated sexual
