But policymakers opposed to reproductive freedom have always set their sights beyond restricting abortion and that agenda is playing out in state legislative sessions across the nation—from attacks on assisted reproductive technologies to targeting young people’s access to services. Visit the link in bio to see our brand in action! * GUTTMACHERINSTITUTE 7d Here are the major trends we’re seeing in state legislative sessions as of May 10: 15 states intro’d 32 bills to boost funding for anti-abortion centers (also called crisis pregnancy centers). These centers spread misinformation, posing as health clinics to dissuade and delay people from seeking abortions. Some states are taking action. MA, NC, NJ, NY, PA are pushing measures to regulate these centers by preventing deceptive ads and mandating qualified medical professionals for ultrasounds. In terms of protective measures, Colorado, Georgia, and Missouri are investing in STI testing, family planning and perinatal care. This funding is essential, but bans in GA and MO also undermine repro health and autonomy. Data privacy is also on legislators’ minds. NJ and MA recently introduced bills safeguarding reproductive health data, with MA extending protection to gender-affirming care. Findings from our Abortion Patient Survey show that, before the Dobbs decision, adolescents were more likely than adults to experience delays in accessing abortion care. Adolescents were also more likely to need help paying for services and getting to a clinic. Unfortunately, attacks on young people’s reproductive freedom aren’t slowing down. Anti-abortion politicians are intent on introducing policies that target adolescents’ access to abortion, including bans based on gestational duration that push care further out of reach. Our experts examined the circumstances and characteristics of adolescent abortion patients prior to the Dobbs decision and found that adolescents were more likely to experience delays in accessing care and have a 2nd trimester abortion. 41 states now have abortion bans based on gestational age, which is pushing abortion access further out of reach for adolescents. This has the largest impact on adolescents with lower incomes, Black and Brown youth, immigrants and LGBTQ+ individuals. Here’s what you need to know about the impact of this ban: Many people don’t know they’re pregnant at 6 weeks. Abortions in Florida have increased since Roe was overturned, largely due to travel from out-of-state patients. Florida was enforcing a 15-week ban in 2023, but the state was still a critical source of abortion care not just for state residents but also for people across the South and Southeast. Floridians will have a chance to weigh in on abortion access in their state this November—a measure that would enshrine abortion rights in the state constitution will appear on the 2024 ballot. This is the first time we’ve updated our lifetime incidence data since 2014. The latest estimate provides an important baseline for understanding the commonality of abortion just before the Dobbs decision. It’s important to note that US abortions increased 10% between 2020 and 2023, and that our current study didn’t capture self-managed abortions. This means that lifetime incidence is likely higher than the new estimate. These data emphasize that abortion is a common and normal part of reproductive health care. Implemented through presidential executive order, the GGR denies US funding to non-US NGOs if they use their own funds for abortion referral, provision or advocacy. While the policy was rescinded in 2021 by the Biden-Harris Administration, the harmful effects persist. Some background: For decades, the Emergency Medical Treatment and Labor Act (EMTALA) has ensured meaningful access to emergency health care for everyone. After the Dobbs decision, the Biden administration reiterated that EMTALA protections include abortion access, even in states where abortion is banned. Now, the Supreme Court is hearing a case on whether the state of Idaho can ignore EMTALA and enforce its total abortion ban even when an abortion is needed to stabilize a patient. Among the findings, 62% of respondents reported confiding in at least one person they trusted. Both states are contending with radical abortion bans, which are not yet in effect, but could have severe consequences across the Southeast and Southwest. Here's what you need to know: The FL Supreme Court issued two rulings on #abortion on 4/1. First, the Court upheld a 15-week ban, triggering an even more restrictive 6-week ban—passed by the state leg in 2023—to take effect on 5/1. This action not only impacts the 4.6 million women of reproductive age, plus trans and non-binary people, living in Florida, but also inhibits abortion access across the Southeast. The Florida Court also approved a ballot initiative for the November election that would enshrine abortion access in the state constitution. This initiative gives Florida voters the power to call for restoring #AbortionAccess in their state. In Arizona, on 4/9, the state’s Supreme Court ruled that Arizona’s 1864 total ban can take effect, overruling a 15-week ban that has already majorly impacted access to abortion care. (Yes, this outdated ban was enacted during the Civil War—before AZ was a state or women could vote.) If enforced, Arizona will join 14 other states enforcing total abortion bans and numerous others restricting access throughout pregnancy. These decisions in Arizona and Florida are massive violations of reproductive autonomy and are designed to cause chaos and confusion across both regions. Arizonans and Floridians deserve better. All abortion patients deserve better. Reminder: Abortion access remains unchanged in FL and AZ. Neither of these bans are in effect yet, and care is currently available up to 15 weeks in both states. While Arizona’s 15-week ban is not yet in effect, it’s still likely to cause significant confusion among patients and providers. We will continue to monitor closely. Reminder: This 1864 ban was enacted during the Civil War—before AZ was a state or women could vote. This is a devastating violation of reproductive autonomy. When this ban goes into effect and if it's enforced, AZ will join 14 other states enforcing total abortion bans and numerous other states restricting access throughout pregnancy. Many of the same states have abortion bans in effect. All of these bans have a similar goal: Limit people’s bodily autonomy and reproductive freedom. Barriers to essential health care also deepen the existing inequities experienced by marginalized groups such as young people, people of color and people living with low incomes. It includes protections for abortion, contraception, continuing pregnancy and more! Congrats to the Ohio voters and advocates that made that win happen! However, given the various restrictions still in effect that interfere with access in the state, Ohio does not change categories on our interactive map. Kansas's 24-hour forced waiting period was temporarily blocked by a judge in late October, along with other restrictions that created barriers to accessing care. 📢 With the waiting period blocked for now, Kansas changes categories from Restrictive to Some Restrictions / Protections! The stakes are high for 2024. Abortion rights measures are already on 2024 ballots in New York and Maryland, and more states are aiming to do the same. Here’s what you need to know: ✅ The #NewYork measure would enshrine protection based on characteristics like sexual orientation, gender and pregnancy in the state constitution. It would also protect residents from government actions that would curtail repro autonomy or access to care. ✅ The ballot measure in #Maryland would establish a right to reproductive freedom in the state constitution. This is a powerful safeguard against future attacks if state leadership changes. ✅ Campaigns are also underway to get an abortion rights measure on the ballot in 2024 in other states across the US. The overturning of Roe was a shock, but voters and policymakers are taking action at the state level to protect and expand abortion access. But post-Roe restrictions and bans will push care even further out of reach. Abortion bans will force more incarcerated individuals to continue pregnancies against their will.
