DECLARATION ON DATA PROTECTION


§ 1 INFORMATION ABOUT THE COLLECTION OF PERSONAL DATA

(1) The following paragraphs give you information about the collection of
personal data in connection with the use of our web-based services. Personal
data is understood as being all data which can be referred to you personally,
e.g. name, address, e-mail addresses and user behavior.

(2) When you use one of our services, we only register the name and e-mail
addresses of users, so as to make it possible for the user to be identified on
our system. It is a mandatory requirement of the system that the IP address of
the user is registered, but it is not assigned to the user personally. No
further processing or collection of data takes place.

(3) After having been registered on the system, the data referred to in the
above paragraph 2 is stored on the Predix platform of our partner and
collaborator GE. The server is located in the USA. In accordance with SW’s
regulations for data protection and information security, storage of the data by
third parties is subject to the provisions of the relevant data protection
ordinance that applies in the EU, even if the data itself is not located in the
EU.

(4) When the data referred to in the above paragraph 2 is no longer needed in
connection with the given service (because the service agreement has come to an
end, has been terminated etc.), we delete the data provided that no statutory
right of data retention applies.


§ 2 YOUR RIGHTS

(1) You have the following rights in relation to SW with reference to data that
concerns you personally:

 * the right to be informed
 * the right to have the data corrected or deleted
 * the right to restrict processing of the data
 * the right to forbid processing of the data
 * the right to determine or limit the passing on of the data

(2) You furthermore have the right to lodge a complaint with a data protection
supervisory authority about the processing of your personal data by SW.

(3) Please be aware that if you exercise your right to have the data deleted, SW
will no longer be able to supply the services in question. Your obligation to
pay the agreed use fee for the duration of the contractual period will not be
affected thereby.

(4) Responsible as understood by article 4, paragraph 7 of the EU General Data
Protection Regulation is (Jochen Heinz, Seedorfer Str. 91, 78713 Waldmössingen,
GERMANY, j.heinz@sw-machines.de). SW’s data protection officer may be reached by
e-mail at datenschutz@sw-machines.de, or else you can write to our postal
address for the attention of “The Data Protection Officer”.
