If your property sustained damage, you may be eligible for a reassessment. A disaster declaration has been issued for our area. This allows property owners to request a reassessment of their property value if the damage significantly affects its market value. Tax Code Section 11.35, Temporary Exemption for Qualified Property Damaged by Disaster, allows qualified properties that are at least 15 percent damaged by a disaster in counties included in the declaration to receive a temporary exemption of a portion of the property’s appraised value. Qualified property includes: * tangible personal property used for income production; * improvements to real property; and * certain manufactured homes. Property owners must apply for the temporary exemption no later than 105 days after the governor declares a disaster area. Market Value and The Homestead Cap Per the Texas Property Tax Code, all taxable property must be valued at 100 percent of market value as of January 1 each year. This value is shown on your notice as “Market Value.” Because it is based on recent sales, the Market Value may change upwards or downwards any amount... Do You Qualify for a Pro-Rated Exemption? Starting January 1, 2022, state law allows property owners to claim a pro-rated general residence homestead exemption on a property that becomes their principal residence at any point in the year. Previously, property owners could only claim this exemption if they owned and lived in the home as of January 1. Pursuant to Sec. 11.1825(r) of the Texas Property Tax Code, The Montgomery Central Appraisal District must give public notice of the capitalization rate to be used for tax year 2024 to value properties receiving exemptions under this section. * Rent restricted properties vary widely. * These variations can have an affect on the valuation of the property.
