NORTH DAKOTA OPTED FOR NATIONAL E15 STRATEGY, LEFT OUT OF YEAR-ROUND ORDER


NORTH DAKOTA GOV. DOUG BURGUM WAS AMONG THE ORIGINAL SIGNERS OF A 2022 LETTER TO
THE EPA REQUESTING YEAR-ROUND E15 SALES BUT THE STATE PULLED OUT OF THE REQUEST
MONTHS LATER.

BISMARCK, N.D. — When the Biden administration earlier this week approved a
request from a group of Midwestern governors to allow year-round sales of E15 ,
North Dakota was not on the list of states involved.

The U.S. government restricts sales of E15 gasoline — gasoline with 15% ethanol
— in summer months due to environmental concerns over smog, though the biofuel
industry says those concerns are unfounded. The EPA on Thursday, Feb. 22, acted
on a 2022 request from a group of Midwestern governors to allow year-round
sales, ruling that sales would be allowed beginning in summer of 2025 in
Illinois, Iowa, Minnesota, Missouri, Nebraska, Ohio, South Dakota, and
Wisconsin. The EPA previously has issued previous temporary orders for
summertime sales.

North Dakota Gov. Doug Burgum was among the original signers of the April 28,
2022, letter to Environmental Protection Agency Administrator Michael Regan
requesting sales of E15 be allowed during the summer months. That letter was
signed by governors of Iowa, Illinois, Kansas, Minnesota, Nebraska, North
Dakota, South Dakota and Wisconsin. Missouri's governor later signed on, too.

However, North Dakota decided to leave the effort in October 2022.

"We changed our approach and advocated for a national solution instead," said
Mike Nowatzki, a spokesperson for Burgum, in an email.

On Friday, North Dakota Corn Growers Association Andrew Mauch, who farms near
Mooreton, expressed his organization's mixed feelings about the Thursday EPA
announcement.

“We applaud the EPA granting the eight Midwest state governors their request to
offer year-round E15 in their states," he said. "It is unfortunate that our
state's governor, who was part of the initial request, ... rescinded, because we
would have been included in this week's announcement."

The Oct. 12, 2022, letter from Burgum to Regan said North Dakota was withdrawing
its request because of "unintended effects, including higher production and
distribution costs."

"We continue to support corn growers and the use of ethanol, while at the same
time understanding the concerns from our energy partners, including producers,
refiners, midstream operators, mineral owners and retailers. Our ongoing goal is
to ensure consumers have the freedom to choose while not creating burdensome and
unneeded regulations for commerce," the letter said.

Burgum's letter said North Dakota urged "industry leaders, along with state and
federal partners" to work together on a national solution.

North Dakota is ranked third in the nation in crude oil reserves and production,
according to the Energy Information Administration , behind Texas and New
Mexico. The EIA says the state also is in the top 10 for ethanol production, and
its six ethanol plants account for about 3.5% of the nation's ethanol output.
The state ranked 11th in corn production for grain in 2022 .

The North Dakota Ethanol Council did not respond to messages left seeking
comment by a deadline on Friday.

While the national corn and ethanol industries cheered the Thursday
announcement, they were disappointed that sales would not begin until 2025
instead of this summer. And they echoed Burgum's call for a national solution.

“While we are pleased with today’s decision, we still need a law that codifies
access to higher levels of ethanol and that eliminates the patchwork of state
regulations on the issue,” said National Corn Growers Association President and
Minnesota farmer Harold Wolle in a statement. “That is why we are pushing for
the passage of the Consumer and Fuel Retailer Choice Act in the Senate to solve
this issue once and for all.”



“If Congress passed the bipartisan Nationwide Consumer and Fuel Retailer Choice
Act, we wouldn’t be in this situation. But a couple of stubborn East Coast
refiners and their champions in the Senate continue to put up roadblocks to
enactment of this commonsense legislation that would slash emissions and reduce
fuel prices for consumers,” Renewable Fuels Association President and CEO Geoff
Cooper said in a statement.

Mauch said the North Dakota Corn Growers also continues to work toward a
national solution.

"We think that is likely to happen eventually. Like those eight neighboring
states, North Dakota’s residents also deserve to have year-round access to fuel
that is not only lower cost per mile than traditional fossil fuel-based fuels,
more than 40% cleaner burning and better for the environment, allows our country
to be more energy independent, and also one that supports North Dakotas
agriculture economy that all of our communities depend on," he said.
