GERMAN INTERIOR MINISTERS AGAINST CRITICISM OF ISRAEL

The federal states have adopted some new measures on the „Middle East conflict“

Interior ministers and senators of the 16 German Länder want to strengthen their
cooperation against „Israel-related anti-Semitism“. Among other things, they
have decided to „convey a realistic image of Israel“ in schools. The responsible
agencies are to develop „assistance“ for teaching staff and students. The
promotion of encounter and exchange formats is also mentioned.

The measures can be found in the resolutions released for publication, which
have now been put online. The actual meeting of the Standing Conference of the
Ministers and Senators of the Interior of the Länder (IMK) already took place on
2 December in Munich. Bavaria currently holds the chair. In its resolutions, the
IMK welcomes the implementation of already existing formats for the prevention
of anti-Semitism. The „engagement against Israel-related anti-Semitism“ is
described as one of the permanent tasks of the federal and state governments.

LEGAL ACTION AGAINST COMMISSIONER COMPUTER

German Constitutional Court hears case on automated data analysis by the police

Is a company allowed to use technical tools on behalf of the police to create a
profile of people and determine their supposed dangerousness? Is this a „data
mining“ and is it also in line with fundamental rights to prevent dangers? On
Tuesday, the Federal Constitutional Court in Karlsruhe heard a case on this
issue. It was preceded by two constitutional complaints filed by the Society for
Civil Liberties (Gesellschaft für Freiheitsrechte e.V., GFF) and other civil
rights organisations against police laws in Hesse and Hamburg.

In Hesse, the authorities have purchased the „AI-enabled“ software „Gotham“ from
the US company Palantir. Called „Hessendata“, it is supposed to find out if a
person has connections to so-called dangerous persons and to show connections

GERMAN DISPUTE OVER EU CHAT CONTROL

Coalition agreement „interpreted differently“ by SPD and FDP

A planned EU regulation on the scanning of internet communications is causing
dissent in the federal government. Platform operators are to be obliged to
inspect even encrypted connections of their customers for depictions of
sexualised violence against children and adolescents. For this purpose, the
companies are to install software for “ client-side scanning“ on mobile phones.

At the Federal Press Conference, the Minister of the Interior, Nancy Faeser
(SPD), spoke of wanting to „get closer“ to this so-called chat control. However,
the two FDP-led ministries of justice and digital affairs reject this as a „red

EU AERIAL SURVEILLANCE FOR LIBYA MAKES TRIPOLI COASTGUARD DOING THE „DIRTY WORK“

The European border agency observes boats with refugees from the air and lets
them be brought back to North Africa. A new report by human rights organisations
criticises this as „Airborne Complicity“.

The European Union has withdrawn ships from the central Mediterranean and is
investing in aerial surveillance instead. Refugees who find themselves in
distress at sea on their way to Europe are less and less likely to be brought to
safe ports in Italy or Malta this way. In order not to be accused of this,
Brussels lets Libyan actors do this „dirty work“.

MISSILES ON ROJAVA AGAIN WITH TECHNOLOGY FROM GERMANY

Supplies of components were intended for ambulances, company says

For weeks, the Turkish military has been constantly bombing the Autonomous
Administration of Northern and Eastern Syria in Rojava. Many of these attacks on
towns and villages are carried out with „Bayraktar TB2“ combat drones.

Once again, it has been proven that technology from Germany is involved.
According to the London-based organisation Conflict Armament Research (CAR),
electromagnetic brakes are used to control drone missiles. These come from the
Dutch company Kendrion, but are produced at the German site in

ALLEGEDLY HARDLY ANY „REICHSBÜRGER“ AMONG GERMAN SECURITY AUTHORITIES

Unlike right-wing extremism in general, the number of known cases of „Citizens
of the Reich“ among police and military is conspicuously low

„The accused are united by a deep rejection of state institutions and the free
democratic basic order of the Federal Republic of Germany,“ writes the Federal
Prosecutor General at the Federal Supreme Court about the raids on the
„Reichsbürger“ („Citizens of the Reich“) milieu the day before yesterday.
According to its press release, some of those arrested as terrorist
organisations formed a „military arm“ with a leadership of nine persons. Their
aim was to set up „homeland security companies“ and to arm them as well as to
carry out shooting exercises.

Recruitment efforts had focused on members of the Bundeswehr and the police.
Some of the accused were themselves active members of the Bundeswehr, the
federal authority writes. The investigations are also directed against a soldier
of the Bundeswehr’s Special Forces Command (KSK), according to which his house

EU FINANCES DEFENCE AGAINST „HYPERSONIC THREATS“

Russia, China and North Korea have missiles with very high velocities. The EU
cannot yet combat such systems.

For the first time, the EU Commission has released funds from the European
Defence Fund. The first €1.2 billion is to be spent on 61 projects, including
the development of sixth-generation combat aircraft. The largest chunk, about
€100 million, will go to the European Hypersonic Defence Interceptor (EU-HYDEF)
project, which is working on systems to detect and defend against so-called
hypersonic weapons. This refers to aircraft that fly faster than five times the
speed of sound (Mach 5).

Hypersonic weapons exist in various designs. Ballistic missiles, for example,
can reach Mach 6 when launched from a fighter jet, which itself flies at
supersonic speeds. Hypersonic gliders are constructed in a completely different
way. They are transported by a rocket up to a hundred kilometres into orbit,
where they circle around the earth. Above the target, they then plunge back into

GERMAN FOOTBALL FANS SPEAK OUT AGAINST REPRESSION

Umbrella organisation defends itself against surveillance and arbitrary police
violence

Football fans are demanding less violence and surveillance from the police in
Germany. At the annual general meeting of their umbrella organisation in
Hanover, 22 local associations published a joint catalogue with five central
demands against „permanent surveillance, restrictions on freedom, unlawful data
collection, lack of action against police violence and the planned control of
all digital communication“. The massive police presence at football matches in
and around stadiums is criticised.

Often, fans are „treated worse than other citizens“ and are approached
particularly harshly by the police. At matches abroad, there are also reprisals
against the travelling fans, including the refusal to allow them to go to the
toilet. „Water cannons, full-body checks and even drone surveillance are now
part of the standard police repertoire – even at 3rd division football matches.
This reveals a completely exaggerated general suspicion of all fans,“ says Linda
Röttig, a member of the board of the umbrella organisation. This hostile image

The German Campaign for Victims of Racist Police Violence (Kampagne für Opfer
rassistischer Polizeigewalt, KOP) calls for documenting police actions with
video footage. Initially, the police defended themselves against this with the
Art Copyright Act, now the police often describes its spoken word as
„non-public“. I spoke about this with Maren Burkhardt, who represented and
supported the campaign as a lawyer.

For years, police authorities have tried to hinder the filming of operations.
The prohibitions imposed in this context have gained a new variant in the form
of § 201 of the Criminal Code (StGB). The section protects the confidentiality
of the spoken word. Would it be permissible to film police operations, but not
to record them with a microphone?

§ Section 201 of the Criminal Code serves to protect the right to preserve the
impartiality of the non-publicly spoken word. Accordingly, the provision only
refers to the oral voice. The wording of the provision is therefore clearly not
directed at the visual recording of persons. Filming without sound is therefore

NEW EU CONTROL SYSTEM: WAITING TIMES AT GERMAN BORDERS TO TRIPLE

In six months‘ time, travellers from third countries will have their passports,
fingerprints and facial images checked automatically. Because of the
time-consuming procedure, the German Federal Police is hoping for the timely
delivery of self-service machines and is considering a call for help to Frontex.

End of May 2023, the European Union will put a new biometric database into
operation. All travellers to the EU will then have to provide four fingerprints
and their facial image as part of the Entry/Exit System (EES) and have their
passport automatically scanned. This will affect citizens of those countries
that benefit from the visa-free regime for short stays in the Schengen area. It
makes no difference what the reason for the journey is.

With the EES, the EU member states want to identify so-called „overstayers“.
This refers to persons who overstay a maximum of 90 days and do not leave within
the prescribed period. The new system also eliminates the manual stamping of
